A RESOLUTION
EXPRESSING THE WILLINGNESS OF THE CITY TO ACCEPT
CONVEYANCE OF LAND TO THE CITY TO BE USED AS A
PORTION OF A SCIENCE PARK IN ACCORDANCE WITH THE
PROPOSAL HERETOFORE MADE TO THE CITY OF CORPUS
CHRISTI BY FOUNDATION FOR SCIENCES AND ARTS, INC.,
WITH CERTAIN RESERVATIONS IN THE CITY; PROVIDING
FOR THE FUTURE CREATION AND APPOINTMENT OF A SCIENCE
PARK ADVISORY BOARD; AND DECLARING AN EMERGENCY.
WHEREAS, A PROPOSAL HAS BEEN MADE TO THE CITY OF CORPUS CHRISTI
BY THE FOUNDATION OF SCIENCES AND ARTS, INC., FOR THE FURNISHING OF
CERTAIN LAND TO BE USED BY THE CITY AS A PART OF A BAYFRONT SCIENCE
PARK; AND
WHEREAS, THE CITY COUNCIL HAS HERETOFORE ON OR ABOUT 30TH
DAY OF OCTOBER, 1963, BY MOTION APPROVED THE PLAN FOR THE DEVELOPMENT OF
A BAYFRONT SCIENCE PARK; AND

WHEREAS, THE CITY COUNCIL FINDS THAT IT IS IN THE INTEREST
OF THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS TO ESTABLISH A
BAYFRONT SCIENCE PARK ON THE BAYFRONT NEAR THE SHIP CHANNEL, WHICH
WILL INCLUDE THE LAND AREAS NOW WITHIN BLOCKS 93, 942 95, 104 AND 105,
BEACH PORTION, SOMETIMES ALSO KNOWN AS BEACH ADDITION, TO THE CITY OF
CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY MAP OR PLAT OF SAID
BEACH PORTION, SOMETIMES ALSO KNOWN AS BEACH ADDITION, ON FILE IN THE
OFFICE OF THE COUNTY CLERK OF NUECES COUNTY, TEXAS; AND
WHEREAS, SAID FOUNDATION FOR SCIENCES AND ARTS, INC., PRO-
POSES TO CONVEY TO THE CITY AS A GIFT RESTRICTED, HOWEVER, TO THE USE
OF THE SAME AS A PART OF THE CITY BAYFRONT SCIENCE"PARK, ALL OF LOTS
11 2 AND 10 AND THE WEST ONE -HALF OF LOT 3, IN BLOCK 105, AND ALL OF
BLOCK 95, BEACH PORTION, SOMETIMES ALSO KNOWN AS BEACH ADDITION, TO THE
CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS AND TO EITHER ACQUIRE FOR
THE CITY OR PROVIDE FUNDS FOR ACQUISITION BY THE CITY OF LOTS,8, 91 11
AND 12, IN BLOCK 105, BEACH PORTION, SOMETIMES ALSO KNOWN AS BEACH
ADDITION, TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SAID GIFT
OF FUNDS, HOWEVER, TO BE LIMITED TO THE AMOUNT OF SEVENTEEN THOUSAND FIVE
HUNDRED DOLLARS (17,500.00):

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE PROPOSAL TO CONVEY TO THE CITY OF CORPUS
CHRISTI THE LANDS AND FUNDS HEREINABOVE DESCRIBED, RESTRICTED TO THE USE
BY THE CITY FOR A BAYFRONT SCIENCE PARK, IS HEREBY ACCEPTED AND THE CITY
COUNCIL, AS THE ELECTED REPRESENTATIVES OF THE CITY, HEREBY EXPRESS THEIR
GRATITUDE TO THE DONORS OF SAID PROPERTY FOR THE BENEFIT AND WELFARE OF
THE PUBLIC. THERE IS HEREBY, HOWEVER, RESERVED TO THE CITY, NOTWITH-
STANDING THE TERMS OF SUCH PROPOSAL, THE EXERCISE OF MUNICIPAL AUTHORITY
OVER SAID PARK AND THE DETERMINATION OF SUCH QUESTIONS AS MAY ARISE CON-
CERNING THE ACQUISITION OF SUCH LAND AS IS NECESSARY TO BE ACQUIRED BY
THE CITY.
SECTION 2. THE CITY COUNCIL HEREBY DESIGNATES THE AREA, IN-
CLUDING BLOCKS 93, 94, 95, t04 AND 105, BEACH PORTION, SOMETIMES ALSO
KNOWN AS BEACH ADDITION, OF THE CITY OF CORPUS CHRISTI, TEXAS, AS A SITE
FOR A BAYFRONT SCIENCE PARK AND DIRECTS THE CITY MANAGER TO INVESTIGATE
THE POSSIBILITY OF ACQUISITION OF SAID LAND AND THE PROBABLE COST THEREOF,
IF ANY, TO THE CITY AND THE MEANS AND METHOD FOR PROVIDING THE FUNDS FOR
THE ACQUISITION THEREOF AND MAKE SUCH RECOMMENDATIONS TO THE CITY COUNCIL
IN THESE MATTERS AS PROMPTLY AS POSSIBLE TO CARRY OUT THE OBLIGATIONS OF
THE CITY UNDER TERMS OF SAID PROPOSAL TO MAKE LAND AVAILABLE TO THE CITY
FOR THE DEVELOPMENT OF SAID BAYFRONT SCIENCE PARK.
SECTION 3. THAT IN THE NEAR FUTURE AND AS PROMPTLY AS THE
COUNCIL DETERMINES, A BOARD, TO BE DESIGNATED AS THE BAYFRONT SCIENCE
PARK ADVISORY BOARD, BE CREATED AND APPOINTED BY THE COUNCIL WITH SUCH
DUTIES AND TERMS IN OFFICES AS MAY BE DESIGNATED IN THE ORDINANCE CREAT-
ING SUCH BOARD TO ASSIST THE COUNCIL IN THE ACQUISITION AND SUPERVISION
OF SAID BAYFRONT SCIENCE PARK AND THE DEVELOPMENT THEREOF, AND TO ADVISE
THE COUNCIL ON SUCH MATTERS AS ARE SUBMITTED TO SUCH BOARD FOR ADVICE.
SECTION 4. THE NECESSITY FOR IMMEDIATE ACCEPTANCE OF THE
PROPOSAL BY THE CITY OF THE PROPOSED GIFT OF A PORTION OF THE SITE
OF A BAYFRONT SCIENCE PARK SO AS TO COMMENCE AS PROMPTLY AS POSSIBLE

THE DEVELOPMENT OF SUCH BAYFRONT SCIENCE PARK, CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED SUCH PUBLIC EMERGENCY AND
NECESSITY TO EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE
SUSPENDED, AND THAT THIS RESOLUTION BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO RESOLVED, THIS THE
DAY OF DECEMBER, 1963.

PROPOSAL TO THE CITY OF CORPUS CHRISTI

The Foundation for Sciences & Arts, Inc.
For
The Development of the-Bayfront Science Park
The Foundation for Sciences and Arts, Inc. proposes to make a gift
to the City of Corpus Christi of the following described property, subject to
the conditions hereinafter provided: All of lots 1, 2 and 10, and the West
one -half of lot 3, Block 105, and all of Block 95, Beach Addition to the City
of Corpus Christi. The deed to this property will be conditioned upon the
City's performing the hereinafter provided acts and will contain a provision
that title will revert to the Foundation at the election of the Foundation, in
the event the City fails to perform such acts. The deed will contain the fur-
ther provision that the property will revert to the Foundation, its successors
or assigns, at any time that the City fails to dedicate the same to civic
purposes, and at no time shall the property ever be sold, traded or transferred
in any way from City ownership.
The Foundation is undertaking to acquire Lots 8, 9, 11 and 12, Block
105, Beach Portion Addition. In the event the Foundation is unable to acquire
these properties, the City shall acquire such property and the Foundation will
agree to make a money gift to the City for the purpose of acquiring the
properties, such gift not to exceed $17,500.00, estimated to be the fair value
of such properties. Therefore the total lands given to the City, or made
available to the City, at the cost of the Foundation will approximate 3.59 acres.
The gift deed to the City will be specifically conditioned upon the
City performing the following acts:
1. The City will acquire Block 94 in its entirety within one year
from January 1, 1964; Block 93 in its entirety within tvo years from January 1,
1964; and Block 104 in its entirety within three years from January 1, 1964.

2. The City owns certain p'rdperty, within Block 93, all of Block 92
and all of the area designated as "Barge Docks ". It agrees that such publicly
held lands will not be disposed of or otherwise transferred and that such lands
shall be set aside as part of this project. It further agrees that as such
properties are acquired within the designated areas, all intervening streets
shall be vacated and closed as may be permitted by the police powers of the
City.
3. The area covered by Blocks 92, 93, 94, 95, 104, 105, and the
dock area and the intervening streets are to be designated by the City and
zoned as a Science Park. Such park to consist of buildings and facilities dedi-
cated to the advancement of scientific and cultural activities.
4. Upon the recommendations of the Foundation for Sciences and Arts
and the Corpus Christi Arts Council, the City will make available to various
non- profit organizations a sufficient amount of land within the Science Park
area to permit the construction of scientific or cultural facilities by such
non - profit organizations. The locations and land requirements of such facil-
ities shall be in conformity with a land use pattern to be hereafter agreed to
by the City and the Foundations. Such land shall be made available at no
charge to the proponents of such facilities on a perpetual easement or on such
other basis as may be required to permit the financing of the proponent's pro-
ject. The City shall maintain all areas within the park surrounding the scien-
tific or cultural facilities as landscaped park and parking area for the use of
the general public.
5. In the event that a non - profit organization recommended by the
Foundation for Sciences and Arts and the Corpus Christi Arts Council is pre-
pared to build qualified facilities on any of the land covered herein prior to
the time that such land is acquired by the City, then in such event the City
will use its best efforts to accelerate its acquisition program so as not to
delay the installation of any facilities contemplated herein.

6. In the event that the City fails to comply with any of the
conditions herein set forth, then title to the property in Blocks 95 and
105 shall revert to the Foundation at its election.
7. The City shall join with the Foundation for Sciences and Arts,
Inc. in joint endeavor to acquire from the U. S. Engineers all of the land
and dock area now occupied by said Engineers to the end that such area be
incorporated in the science park. This area, when acquired, is to be
dedicated to the development of a seaquarium for the advancement of scienti-
fic and educational knowledge in marine life.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT'
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
