HomeMy WebLinkAbout07142 ORD - 02/05/1964JKH:2 -5 -64 AN ORDINANCE ABANDONING A PORTION OF THE RIGHT OF WAY, BEING FIVE (5') FEET OF RIGHT OF WAY ON EACH SIDE OF BOWIE STREET AND BONHAM STREET, BETWEEN SOKOL DRIVE AND SACKY DRIVE, SO AS TO RETAIN A 50 -FOOT RIGHT OF WAY AND A 10 -FOOT RADIUS AT EACH CORNER; AND DECLARING AN EMERGENCY. WHEREAS,NDTICE OF THE INTENTION TO CLOSE A PORTION OF THE RIGHT OF WAY, BEING FIVE FEET (5') OF RIGHT OF WAY ON EACH SIDE OF BOWIE STREET AND BONHAM STREET, BETWEEN SOKOL DRIVE AND SACKY DRIVE, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS ABUTTING SAID STREETS AND WITHIN 450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON THE 29TH DAY OF JANUARY, 1964, BY THE CITY COUNCIL, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE AD- VANTAGE OF THE CITY TO ABANDON SAID PORTION OF SAID RIGHT OF WAY SO THAT THE SAME MAY BE USED FOR OTHER PURPOSES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THERE IS HEREBY CLOSED FOR PUBLIC USE THE FOLLOWING: THE 5 -FOOT RIGHT OF WAY ON EACH SIDE OF BOWIE STREET AND BONHAM STREET, BETWEEN SOKOL DRIVE AND SACKY DRIVE, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE PORTION OF THE RIGHT OF WAY HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE 11I12 OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE DAY OF FEBRUARY, 1964. ATTEST: THE CITY OF CORPUS CHRISTI, TEXAS IT APPROVED AS TO LEGAL FORM THIS DAY OF FEBRUARY, 1964: CITY ATTORNEY CORPUS CHRISTI, TEXAS _.S4 __DAY OF �9 S TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; i, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO - DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
