WHEREAS, NOTICE OF THE INTENTION OF CLOSING AN UNOPENED STREET, BEING THAT PORTION OF FIRST STREET BETWEEN ABERDEEN AVENUE AND THE SOUTH LINE OF THE SEASIDE CAMP MEETING GROUNDS, IN THE CITY.! OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS ABUTTING SAID UNOPENED STREET AND WITHIN 450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON JANUARY 29, 1964, BY THE CITY COUNCIL IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, AT SAID PUBLIC HEARING, EVIDENCE WAS SUBMITTED THAT THE CLOSING OF THE STREET WAS DONE BY THE COUNTY OF NUECES IN 1937, AND THAT IN ORDER TO HAVE SUCH CLOSING ON FILE SO THAT THE TITLE COMPANIES WOULD HAVE THIS INFORMATION READILY AVAILABLE AND THE FACT THAT THE ACTION TAKEN BY THE CITY COUNCIL FOR THE CLOSING OF THIS STREET WAS NOT IN CONFLICT WITH THE PREVIOUS ACTION BY THE COUNTY IN THIS MATTER, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE ADVANTAGE OF THE CITY TO ABAN- DON WHATEVER RIGHTS, IF ANY THE CITY HAS IN SAID AREAAS A PUBLIC STREET: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THERE IS HEREBY CLOSED FOR PUBLIC USE THAT PORTION OF FIRST STREET BETWEEN ABERDEEN AVENUE AND THE SOUTH LINE OF THE SEASIDE CAMP MEETING GROUNDS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AND ABANDONING THE SAME TO THE ABUTTING PROPERTY OWNERS, WITHOUT PREJUDICE TO ANY PROPERTY RIGHTS OF SAID ABUTTING PROPERTY OWNERS HERETOFORE EXISTING. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AREA HEREINABOVE DESCRIBED AND THE ABANDONING OF THE PROPERTY TO THE ABUTTING PROPERTY OWNERS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING 71-45 THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THATSUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF FEBRUARY, 1964• ATTEST THE CITY OF CORPUS CHRISTI, TEXAS ITY SECRETAIRY APPRO ED AS TO LEGAL FORM THIS/ DAY OF FEBRUARY, 19614: CITY ATT RNE` CORPUS CHRISTI, TEXAS 0`DAY OF 9y, 19 TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
