AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AN AGREEMENT WITH JOE BARSHOP, AGREEING TO THE
EXTENSION OF CERTAIN CONDITIONS HERETOFORE IMPOSED
ON THE DELIVERY OF A QUITCLAIM DEED BY THE CITY AS
TO THE ALLEY IN WATER BLOCK 6 (REVISED) IN THE CITY
OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AUTHORIZING
DELIVERY OF SAID QUITCLAIM DEED UPON EXECUTION BY ALL
PARTIES TO THE AGREEMENT HEREIN AUTHORIZED, A COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND
DECLARING AN EMERGENCY.
WHEREAS, BY ORDINANCE N0. 7117, DATED DECEMBER 27, 1963, THE
CITY MANAGER WAS AUTHORIZED BY THE CITY COUNCIL TO EXECUTE AND DELIVER A
QUITCLAIM DEED FROM THE CITY TO THE OWNERS OF ABUTTING LOTS TO ALL RIGHT,
TITLE, AND INTEREST TO A 20— FOOT-ALLEY EXTENDING IN A NORTHERLY AND SOUTH-
ERLY DIRECTION THROUGH WATER BLOCK 6 (REVISED), IN THE CITY OF CORPUS
CHRISTI, NUECES COUNTY, TEXAS, UPON CERTAIN CONDITIONS SET FORTH IN SAID
ORDINANCE; AND
WHEREAS, THE OWNERS OF THE LOTS IN SAID WATER BLOCK 6 (REVISED),
DESIRE TO POSTPONE THE PERFORMANCE OF ALL $ F THE CONDITIONS SET FORTH IN
SAID ORDINANCE N0. 7117 AND AGREE TO PERFORM SAID CONDITIONS WITHIN,TWO

YEARS OF THE DATE HEREOF IN ACCORDANCE WITH THE TERMS OF AN AGREEMENT
ATTACHED HERETO AND MADE A PART HEREOF:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED
TO EXECUTE, FOR AND ON BEHALF OF THE CITY, AN AGREEMENT WITH THE OWNERS OF
THE LOTS ABUTTING ON THE ALLEY OF WATER BLOCK 6 (REVISED) IN THE CITY OF
CORPUS CHRISTI BY THE TERMS OF WHICH AGREEMENT SAID PROPERTY OWNERS AGREE AS
A COVENANT RUNNING WITH THE LAND TO IMPOSE ON OTHER LOTS AND PROPERTY OWNED +
BY THE OWNERS, TO —WIT: LOT 4, WATER BLOCK 6 (REVISED) IN THE CITY OF CORPUS
CHRISTI, NUECES COUNTY, TEXAS, AND LOTS 1, 2, 3, 11 AND 12 IN BLOCK 5, BEACH

FEET OF LOT 3 OF WATER BLOCK 6 (REVISED), ALL AS SHOWN BY MAP OR PLAT OF
RECORD IN THE OFFICE OF THE COUNTY CLERK OF NUECES COUNTY TEXAS AS A
COVENANT RUNNING WITH THE LANDS SAID COVENANT OBLIGATING THE SAID JOE
BARSHOP TO REMOVE THE ENCROACHMENT ABUTTING LOT 4,,ON THE EAST SIDE OF
WATER STREET TOGETHER WITH DELIVERY OF PROPER INSTRUMENT MAKING SAID 20 FEET
THE PROPERTY OF THE CITY FOR THE WIDENING OF 'WATER STREET AT SAID POINT TO
CONFORM WITH THE RIGHT OF WAY OF WATER STREET IN THE BALANCE OF SAID WATER
BLOCK 6 (REVISED), AND FURTHER TO REMOVE FROM SAID RIGHT OF WAY OF WATER
STREET THE BRIDGE AND OTHER OBSTRUCTIONS NOW LOCATED THEREIN AND TO PLACE
STREET IMPROVEMENTS, CONSISTING OF CURBS, GUTTER, SIDEWALKS AND PAVEMENT IN
KEEPING WITH THE EXISTING STREET IMPROVEMENTS ABUTTING OTHER LOTS IN SAID
WATER BLOCK 6 (REVISED) IN THE CITY OF CORPUS CHRISTI, SAID STREET IMPROVE-
MENTS TO BE INSTALLED AT THE INSTANCE AND EXPENSE OF THE SAID JOE BARSHOP,
WITHIN THE PERIOD OF TWO YEARS OF THE DATE HEREOF A COPY OF SAID AGREEMENT
BEING ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED,
FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO DELIVER THE QUITCLAIM
DEED AUTHORIZED BY ORDINANCE NO. 7117, AS TO THE FORMER ALLEY LOCATED IN
WATER BLOCK 6 (REVISED) IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY TEXAS,
AT THE TIME OF -THE EXECUTION BY ALL PARTIES OF THE ABOVE AGREEMENT.
SECTION 3. THE FACT THAT CONSTRUCTION IS UNDERWAY ON IMPROVEMENT
OF WATER BLOCK 6 (REVISED), IN THE CITY OF CORPUS CHRISTI, AND THAT THE CITY
HAS BEEN REQUESTED TO TRANSFER THE OBLIGATION TO REMOVE OBSTRUCTIONS FROM
AND IMPROVE THE PORTION OF WATER STREET ABUTTING SAID LOT 6 TO OTHER PROP-
ERTY SO AS NOT TO DELAY CONTINUATION OF CONSTRUCTIONS CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON
THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE
READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCILS AND THE MAYOR HAVING
DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE

SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS
