HomeMy WebLinkAbout07177 ORD - 03/18/19640 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING SECTION 4 -1 OF ARTICLE 4, SO AS TO INCREASE THE ZONING DISTRICTS TO BE EIGHTEEN (18) IN NUMBER, BY THE ADDITION OF A NEW DISTRICT TO BE DESIGNATED "'F —R' FARM —RURAL DISTRICT "; AND ADDING A NEW ARTICLE TO BE DESIGNATED AS ARTICLE 4AFR, ESTABLISHING SAID DISTRICT AND SETTING FORTH THE REGULATIONS PERTAIN- ING TO SAME; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING CERTAIN AMEND- MENT TO THE TEXT OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS; AND t WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON FEBRUARY 4, 1964, AT SPECIAL COUNCIL MEETING OF THE CITY COUNCIL IN THE CITY COUNCIL CHAMBER OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DE- CIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY �o OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDI- NANCE No. 6105, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 29TH DAY OF MARCH, 1961, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGES HEREIN- AFTER SET OUT. 7177 SECTION 2. THAT ARTICLE Y OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE AND THE SAME IS HEREBY AMENDED BY AMENDING SECTION 4 -1 TO HEREAFTER READ 1U, AS REFERS TO THE NUMBER OF ZONING DISTRICTS AND ADDING TO THE LIST A1S� THE FIRST ITEM IN SAID LIST "'F -R' Y FARM -RURAL DISTRICT ", SAID SECTION -1 TO HEREAFTER READ AS FOLLOWS: "SECTION 4 -1 IN ORDER TO REGULATE AND RESTRICT THE LOCATION OF TRADES, INDUSTRIES AND THE LOCATION OF BUILDINGS ERECTED OR ALTERED FOR SPECIFIC USES, TO REGULATE AND LIMIT THE HEIGHT AND BULK OF BUILD- INGS HEREAFTER ERECTED OR STRUCTURALLY ALTERED, TO REGULATE AND LIMIT POPULATION DENSITY AND THE INTENSITY OF THE USE OF LOT AREAS AND TO REGULATE AND DETERMINE THE AREAS OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN AND SURROUNDING SUCH BUILDINGS THE CITY OF CORPUS CHRISTI IS HEREBY DIVIDED INTO DISTRICTS, OF WHICH 'QHERE SHALL BE tS IN NUMBERS KNOWN AS: 'F"-R FARM -RURAL DISTRICT "R " -1A" ONE - FAMILY DWELLING DISTRICT "R" -16" ONE- FAMILY DWELLING DISTRICT "R -2" TWO- FAMILY DWELLING DISTRICT nA -1" APARTMENT HOUSE DISTRICT "A -2" APARTMENT HOUSE DISTRICT "AT" APARTMENT - TOURIST DISTRICT nABn PROFESSIONAL OFFICE DISTRICT "B -lA" TOURIST COURT DISTRICT "B -'I" NEIGHBORHOOD BUSINESS DISTRICT "13-2" BAYFRONT BUSINESS DISTRICT nB -3" SHOPPING CENTER DISTRICT "B- " GENERAL BUSINESS DISTRICT "B -5" PRIMARY BUSINESS DISTRICT nB -6" PRIMARY BUSINESS CORE DISTRICT "l -,n LIMITED INDUSTRIAL DISTRICT n' -2" LIGHT INDUSTRIAL DISTRICT nl -3" HEAVY INDUSTRIAL DISTRICT." -2- SECTION 3. SAID ZONING ORDINANCE 6106 15 HEREBY FURTHER AMENDED BY ADDING A NEW ARTICLE DESIGNATED AS ARTICLE 4AFR AND READING AS FOLLOWS: ARTICLE 4AFR. "F -R" FARM -RURAL DISTRICT SECTION 4AFR -1 THE REGULATIONS SET FORTH IN THIS ARTICLES OR SET FORTH ELSEWHERE IN THIS ORDINANCE WHEN REFERRED TO IN THIS ARTICLE, ARE THE REGULATIONS IN THE "F -R" FARM -RURAL DISTRICT. THE PURPOSE OF THIS DISTRICT IS: A. TO ASSIST IN THE CONTROL OF THE USES OF THE LANDS AND TO PROHIBIT USES WHICH INTERFERE WITH AN INTEGRATED AND EFFICIENT DEVELOPMENT OF THE LAND FOR MORE INTENSIVE USES AS URBAN DEVELOPMENT EXPANDS; B. TO REGULATE ANY USE, WHICH BECAUSE OF ITS CHARACTER OR SIZE, WOULD CREATE UNUSUAL REQUIREMENTS AND COSTS FOR PUBLIC SERVICES, SUCH AS POLICE AND FIRE PROTECTION WATER SUPPLY AND SEWERAGE BEFORE SUCH SERVICES COULD BE EXPANDED EFFICIENTLY. SECTION 4AFR -2 USE REGULATIONS. A BUILDING OR PREMISES SHALL BE USED ONLY FOR THE FOLLOWING PURPOSES: 1. RESIDENCES OF OWNERS AND TENANTS, OTHER MEMBERS OF THEIR FAMILIES, AND THEIR EMPLOYEES; 2. TEMPORARY FARM LABOR CAMPS INCIDENT AND NECESSARY TO THE GATHERING OF THE CROPS GROWING ON THE PREMISES; 3. FIELD AND TRUCK CROPS; 4. ORCHARDS AND VINEYARDS; 5. GREENHOUSES AND NURSERIES; 6. BRUSH LAND AND PASTURE LAND; 7. LIVESTOCK RANCHES EXCEPT SWINE, AND GUEST RANCHES; 8. SALE AND STORAGE OF HAY AND STRAW; 9. OIL AND GAS WELLS AND APPURTENANCES; 10. SCHOOLS, COLLEGES CHURCHES; PUBLIC PARKS, GOLF COURSES, AND OTHER SIMILAR PUBLIC AND SEMI - PUBLIC USES; -3- 11. HOME OCCUPATIONS; 12. RAILROAD RIGHTS -OF -WAY, INCLUDING A STRIP OF LAND WITH TRACKS AND AUXILIARY FACILITIES FOR TRACK OPERATIONS BUT NOT INCLUDING PASSENGER STATIONS, FREIGHT TERMINALS, SWITCH- ING AND CLASSIFICATION YARDS, REPAIR SHOPS, ROUND HOURSE, POWER HOUSES INTERLOCKING TOWERS, AND FUELING, SANDING AND WATERING STATIONS. TEMPORARY 13. OUTDOOR ADVERTISING STRUCTURES, NOT NECESSARILY PERTAINING TO USES ON THE LAND; PROVIDED, HOWEVER, SAID STRUCTURES SHALL NOT EXCEED 300 SQUARE FEET, AND PROVIDING FURTHER THAT SAID STRUCTURES SHALL BE REMOVED WITHIN 30 DAYS AFTER THE "F -R" FARM -RURAL DISTRICT ZONING IS CHANGED TO ANY ZONING CLASSIFICATION WHICH DOES NOT PERMIT SAID OUTDOOR ADVERTISING STRUCTURES. 14. ACCESSORY BUILDINGS AND USES INCLUDING BUT NOT LIMITED TO: A. TEMPORARY SALES STANDS FOR THE SALE OF FARM OR RANCH PRODUCTS PRODUCED ON THE PREMISES, PROVIDED ONLY ONE SUCH STAND MAY BE USED ON EACH FARM OR RANCH; AND SHALL BE LOCATED NOT CLOSER THAN 30 FEET FROM AN ADJOINING PROPERTY LINE, AND NOT LESS THAN 40 FEET FROM THE ROADWAY. B. ONE TEMPORARY SIGN NOT TO EXCEED 4O SQUARE FEET IN AREA AND NOT TO EXCEED 35 FEET IN HEIGHT PERTAINING TO THE PRODUCTS SOLD AT THE TEMPORARY SALES STAND OR PERTAIN- ING TO SUCH OTHER PERMITTED USES IN THIS DISTRICT. SECTION 4AFR -3 PARKING REGULATIONS. THE PARKING REGULATIONS FOR PERMITTED USES ARE CONTAINED IN ARTICLE 22 OF THIS ORDINANCE. FOR TEMPORARY SALES STANDS PERMITTED IN THIS DISTRICTS THERE SHALL BE A MINIMUM OF FIVE (5) OFF- STREET PARKING SPACES PROVIDED AND SO ARRANGED THAT INGRESS AND EGRESS TO SUCH SPACES ARE FROM DRIVEWAYS APPROVED BY THE TRAFFIC ENGINEER OF THE CITY OF CORPUS CHRISTI. -4- SECTION 4AFR -4 OFF- STREET LOADING REGULATIONS. THE OFF - STREET LOADING REGULATIONS FOR PERMITTED USES ARE CONTAINED IN ARTICLE 23. FOR ANY USE NOT CONTAINED IN ARTICLE 23 NO OFF- STREET LOADING REGU- LATIONS APPLY EXCEPT THAT LOADING AND UNLOADING SHALL TAKE PLACE OFF ANY PUBLIC RIGHT -OF -WAY. SECTION 4AFR -5 AREA REGULATIONS. THE LOTS IN THIS AREA SHALL HAVEAN AREA OF FIVE (5) ACRES OR MORE. SECTION 14AFR -6. SUPPLEMENTARY USE REGULATIONS ARE CONTAINED IN ARTICLE 25. SECTION YAFR -7. SUPPLEMENTARY HEIGHT AND AREA REGULATIONS ARE CONTAINED IN ARTICLE 27. SECTION 4. THE FACT THAT THE ZONING AND PLANNING COMMISSION IS IN THE PROCESS OF ESTABLISHING ZONING DISTRICTS IN THE AREA ANNEXED BY THE CITY IN 1961 AND 1962 AND IS AT THIS TIME DELAYING THE HOLDING OF PUBLIC HEARINGS UNTIL THE FARM -RURAL DISTRICT PROVISIONS HEREIN PROVIDED ARE ESTABLISHED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM:AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINCE THIS THE DAY OF 1964.
