HomeMy WebLinkAbout07187 ORD - 04/01/1964s AN ORDINANCE CLOSING THAT PORTION OF NUECES BAY BOULEVARD LYING BETWEEN THE TURNING BASIN SHORELINE AND A LINE ACROSS NUECES BAY BOULEVARD INTERSECTING THE EAST AND WEST BOUNDARY LINES OF NUECES BAY BOULEVARD AT A DISTANCE OF 627. FEET FROM THE POINTS OF INTERSECTION OF THE EAST AND WEST BOUNDARY LINES OF NUECES BAY BOULEVARD AND THE NORTH BOUNDARY LINE OF THE MISSOURI PACIFIC RAIL- ROAD RIGHT OF WAY, SUBJECT TO THE RETENTION OF A FIRE LANE EASEMENT; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE INTENTION OF HOLDING A HEARING CONCERNING THE CLOSING OF A PORTION OF NUECES BAY BOULEVARD BETWEEN THE MISSOURI PACIFIC RAILROAD RIGHT OF WAY AND THE TURNING BASIN SHORELINE HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS OF PROPERTY ABUTTING SAID STREET AND WITHIN 450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON MARCH 18, 1964, BY THE CITY COUNCIL IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DETERMINED BY THEWCITY COUNCIL AFTER SUCH HEARING THAT THE SAID A,REA_IS NOT NEEDED AS A PUBLIC STREET AND THAT SAID AREA WILL NOT BE NEEDED AS A PUBLIC STREET WITHIN THE FORESEEABLE FUTURE; AND WHEREAS, IT HAS. BEEN!DETYERMINED THAT IT WILL BE PTO THE`A,D— VANTAGE OF THE CITY TO ABANDON SAID PORTION OF SAID STREET AS -A PUBLIC STREET SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES; SUBJECT, HOWEVER, TO THE RETENTION BY THE CITY OF SAID FIRE LANE EASEMENT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL,OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY CLOSED FOR PUBLIC USE THAT PORTION OF NUECES BAY BOULEVARD LYING BETWEEN THE TURNING BASIN SHORELINE AND A LINE ACROSS NUECES BAY BOULEVARD INTERSECTING THE EAST AND WEST BOUNDARY LINES OF NUECES BAY BOULEVARD AT A DISTANCE OF 627 FEET FROM THE POINTS OF INTERSECTION OF THE WEST AND EAST BOUNDARY LINES OF NUECES BAY BOULEVARD AND THE NORTH BOUNDARY LINE OF THE MISSOURI PACIFIC RAILROAD RIGHT OF WAY, SUBJECT TO THE RETENTION BY THE CITY OF A FIRE LANE EASEMENT. �s ti sr . 71.87 SECTION 2.
