HomeMy WebLinkAbout07207 ORD - 04/22/1964JKH:4-17-64 AN ORDINANCE CLOSING OF A PORTION OF RAILROAD AVENUE, DESCRIBED AS THAT 80.71+ -FOOT PORTION OF RAILROAD AVENUE ABUTTING LOTS 1 AND 2, BLOCK 6, AND THE WEST 30 FEET OF TWENTIETH STREET BETWEEN BLOCKS 5 AND 6, PATRICK WEBB ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE RETENTION BY THE CITY OF A 10 -FOOT WIDE UTILITY EASEMENT IN TWENTIETH STREET FROM LAREDO STREET TO THE NORTH RIGHT OF WAY LINE OF RAILROAD AVENUE AND EXCEPTING ANY AREA TRANSVERSED BY A RAILROAD SPUR TRACK, AND THAT SUCH STRIP BE DECLARED A FIRE LANE WITH NO PARKING PERMITTED AT ANY TIME; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE CLOSING OF THE PORTION OF RAILROAD AVENUE DESCRIBED AS THAT 80.74 -FOOT PORTION OF RAILROAD AVENUE ABUTTING LOTS 1 AND 2, BLOCK 6, AND THE WEST 30 FEET OF TWENTIETH STREET BETWEEN BLOCKS 5 AND 6, PATRICK +/EBB ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF ALL OWNERS ABUTTING SAID STREETS AND WITHIN 450 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, WHICH PUBLIC HEARING WAS HELD BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, ON AUGUST 21, 1963, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DULY DETERMINED BY THE CITY OF CORPUS CHRISTI, AFTER SAID PUBLIC HEARING THAT THE SAID PORTIONS OF RAILROAD AVENUE AND TWENTIETH STREETS ARE NOT SUITABLE FOR STREET PURPOSES AND THAT IT WILL BE TO THE ADVANTAGE OF THE CITY OF CORPUS CHRISTI, TEXAS, TO HAVE SAID PORTIONS OF THE AFORESAID STREETS CLOSED, BUT THAT THERE BE RETAINED BY THE CITY A 10 -FOOT WIDE UTILITY EASEMENT IN TWENTIETH STREET FROM LAREDO STREET TO THE NORTH RIGHT OF WAY LINE OF RAILROAD AVENUE, AND ALSO EXCEPTING ANY AREA TRANSVERSED BY A RAILROAD SPUR TRACK, AND DECLARING SUCH STRIP A FIRE LANE, WITH NO PARKING PERMITTED AT ANY TIME: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. THAT THERE 1S HEREBY CLOSED FOR PUBLIC USE A PORTION OF RAILROAD AVENUE DESCRIBED AS THAT 80.(4 -FOOT PORTION OF RAILROAD AVENUE ABUTTING LOTS 1 AND 2; BLOCK 6, AND THE WEST 30 FEET OF TWENTIETH STREET BETWEEN BLOCKS 5 AND 6, PATRICK WEBB ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS HOWEVER, THERE IS RESERVED TO THE CITY A 10-FOOT WIDE UTILITY EASEMENT IN TWENTIETH STREET FROM LAREDO STREET TO THE NORTH RIGHT OF WAY LINE OF RAILROAD AVENUE THERE IS ALSO EXCEPTED ANY AREA TRANSVERSED BY A RAILROAD SPUR TRACK, SUCH STRIP BEING DECLARED A FIRE LANE, WITH NO PARKING PERMITTED AT ANY TIME. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID PORTIONS OF THE STREETS HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY 50 ORDAINED, THIS THE � /L DAY OF APRIL, 1964. - ATTEST: M THE CITY OF CORPUS CHRISTI, TEXAS ClTY SECRET Y APPROVED AS TO LEGAL FORM THIS DAY OF APRIL, 1964: J CITY ATTORN._Y CORPUS CHRISTI, TEXAS O�D AY OF r 9� TO THE MEMBERS OF THE CITY COUNCIL.
