AN ORDINANCE ,
AMENDING THE ZONING ORDINANCE OF THE CITY OFD CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY
ORDINANCE N0. 6106, PASSED AND APPROVED ON THE 29TH
DAY OF MARCH, ig61, BY GRANTING A SPECIAL USE PERMIT
ON ALL OF THAT CERTAIN TRACT OF LAND WITHIN THE CITY
OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BOUNDED BY
BUFORD STREET, OCEAN DRIVE AND SHORELINE BOULEVARD,
FOR THE OPERATION OF AN OFFICE BUILDING UNDER THE CONDI-
TIONS AND PROVISIONS HEREIN CONTAINED; KEEPING IN EFFECT
ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
DECLARING AN EMERGENCY.
WHEREAS, THE ZONING AND PLANNING COMMISSION HAS DENIED THE
APPLICANTS REQUEST FOR A SPECIAL USE PERMIT; AND -
WHEREAS, THE APPLICANT HAS APPEALED SAID DECISION OF THE ZON-
ING AND PLANNING COMMISSION TO THE CITY COUNCIL; AND
WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS
WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE
THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER
NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON APRIL 22,
1964, AT SPECIAL COUNCIL MEETING OF THECITY COUNCIL IN THE CITY COUNCIL
CHAMBERS OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI; AND
WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED IT WAS
DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH
AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND
THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF
RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION
RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY
ORDINANCE No. 6106, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 29TH
DAY OF MARCH, 1961, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE
HEREINAFTER SET OUT.

SECTION 2. THAT ALL OF THAT CERTAIN TRACT OF LAND WITHIN THE
CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BOUNDED BY BUFORD STREET,

OCEAN DRIVE AND SHORELINE BOULEVARD BE GRANTED A SPECIAL USE PERMIT AS
PROVIDED IN SECTION 25 -4, SUBSECTION 12 OF THE ZONING ORDINANCE, FOR A
PROFESSIONAL OR BUSINESS OFFICE BUILDING, SUBJECT TO THE FOLLOWING
CONDITIONS: K
1. THAT AN OFFICE BUILDING BE CONSTRUCTED IN SUBSTANTIAL
COMPLIANCE WITH THE PROPOSED SITE DEVELOPMENT, INCLUDING LANDSCAPING
AND BEAUTIFICATION OF GROUNDS, SUBMITTED TO THE CITY COUNCIL ON APRIL
22, 1964, A COPY OF WHICH IS ATTACHED HERETO, LABELED EXHIBIT "A", AND
MADE A PART HEREOF; PROVIDED, HOWEVER, THAT WHERE THE BELOW NAMED CONDI-
TIONS CONFLICT OR ARE DIFFERENT FROM SAID PROPOSED SITE DEVELOPMENT, THE
SPECIFIC CONDITIONS LISTED BELOW WILL PREVAIL.
2. THAT ANY OUTDOOR SIGN ON THE ABOVE DESCRIBED PROPERTY SHALL:
(A� BE ATTACHED FLAT AGAINST THE BUILDING,
(B NOT PROJECT ABOVE THE ROOF LINE,
(C BE NON - ILLUMINATED, AND
(D BE NO LARGER THAN 12° IN HEIGHT.
3. OFF- STREET PARKING WILL BE PROVIDED FOR AT LEAST 12 SPACES;
INGRESS AND EGRESS TO THE PROPERTY BY VEHICLES SHALL BE PERMITTED ONLY ON
BUFORD STREET; ONLY PARALLEL PARKING SHALL BE PERMITTED ON OCEANA DRIVE AND
NO PARKING SHALL BE PERMITTED ON SHORELINE DRIVE.
4. SAID BUILDING SHALL HAVE NO PUBLIC ENTRANCE TO THE PROPERTY
ON SHORELINE DRIVE FOR EITHER VEHICULAR OR PEDESTRIAN TRAFFIC AND SAID
PROPERTY WILL BE PERMITTED TO HAVE TWQ PEDESTRIAN ENTRANCES FROM OCEAN
DRIVE.
5. THAT OFF - STREET PARKING SHALL BE SCREENED FROM PUBLIC VIEW
ALONG SHORELINE DRIVE.
6. THE FOLLOWING BUILDING SET -BACKS FROM THE PROPERTY LINE TO
THE BUILDING SHALL BE CONTROLLING:
(A) 25 FEET FROM SHORELINE DRIVE;
(B) 10 FEET FROM BUFORD STREET; AND
(C) 5 FEET FROM OCEAN DRIVE.
7. THAT THE FOUNTAIN SHALL BE LOCATED APPROXIMATELY AS SHOWN ON
THE ATTACHED SITE DEVELOPMENT; PROVIDED, HOWEVER, THAT THE FOUNTAIN MAY BE CON-
STRUCTED IN FRONT OF THE ABOVE BUILDING SET - BACKS.

SECTION 3. THAT A NOTATION BE MADE ON THE OFFICIAL ZONING
MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, REFLECTING THE SPECIAL USE PER-
MIT AS HEREIN ORDAINED.
SECTION 4. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS
CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM
TIME TO TIME AND PARTICULARLY AS AMENDED ON THE 29TH DAY OF MARCH, 1961,
EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT.
SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED.
SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING THE AFORE-
SAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE
ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI, TEXAS, CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING
REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY SO ORDAINED THIS THE�DAY OF APRIL, 1964.

THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCI L; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
