HomeMy WebLinkAbout07225 ORD - 05/06/1964UKH:5 -6 -64 AN ORDINANCE s CLOSING THAT PORTION OF A CERTAIN 30 -FOOT WIDE ROAD EASEMENT LYING BETWEEN NORTH NAYLOR CIRCLE AND OLD ROBSTOWN ROAD, AND HAVING BEEN DEDICATED BY THE DIVISION OF THE SNODGRASS 30 ACRES TRACT, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AUTHORIZING THE CITY MANAGER TO EXECUTE AND DELIVER A QUITCLAIM DEED ON THAT PORTION OF THE ROAD EASEMENT HEREBY CLOSED TO THE ABUTTING PROPERTY OWNER, H. R. NAYLOR; AND DECLARING AN EMERGENCY_ WHEREAS, NOTICE OF THE INTENTION OF CLOSING A PORTION' OF A CERTAIN 30 -FOOT WIDE ROAD EASEMENT LYING BETWEEN NORTH NAYLOR YCIRCLE AND OLD ROBSTOWN ROAD, AND HAVING BEEN DEDICATED BY THE DIVISION OF THE SNODGRASS 30 ACRES TRACT, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, HAS BEEN GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS ABUTTING SAID ROAD EASEMENT AND WITHIN 1150 FEET THEREOF, AND THEREAFTER, PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD ON APRIL 29, 1964, BY THE CITY COUNCIL I,N ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL, AFTER SUCH PUBLIC HEARING, THAT THE SAID AREA IS NOT NEEDED AS A PUBLIC STREET, AND THAT THE SAME WILL NOT BE NEEDED AS A PUBLIC STREET WITHIN THE FORESEEABLE FUTURE; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE ADVAN- TAGE OF THE CITY TO ABANDON SAID AREA AS A PUBLIC STREET SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNER FOR OTHER PURPOSES: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THERE IS HEREBY CLOSED FOR PUBLIC USE THAT PORTION OF A CERTAIN 30 -FOOT WIDE ROAD EASEMENT LYING BETWEEN NORTH NAYLOR CIRCLE AND OLD ROBSTOWN ROAD, AND HAVING BEEN DEDICATED BY THE DIVISION OF THE SNODGRASS 30 ACRES TRACT, AND THE SAME BE AND THE SAME IS HEREBY ABANDONED TO THE ABUTTING PROPERTY OWNER, H. R. NAYLOR. SECTION 2. THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE AND DELIVER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A QUITCLAIM DEED TO THE AREA DESCRIBED ABOVE UNTO THE ABUTTING PROPERTY OWNER, H. R. NAYLOR. 7225 I- 4 ` SECTION 3. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AREA HEREINABOVE DESCRIBED AND THE ABANDONING OF THE PROPERTY TO THE ABUTTING PROPERTY OWNER CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF MAYS 1964- ATTEST: THE CITY OF CORPUS CHRISTI, TEXAS t t�CI Y SECRETA APPROVED AS TO LEGAL FORM THI __DAY OF MAY, 1964: CITY ATTORNEY 11 CORPUS CHRISTI, TEXAS DAY OF i9__ TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO - DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL, RESPECTFULLY, THE CITY OF CORPUS CHRISTI, TEXAS.
