HomeMy WebLinkAbout07235 RES - 05/13/1964BJw:5/13/64 , A RESOLUTION ` WHEREAS, MISSOURI PACIFIC RAILROAD COMPANY HAS HERETOFORE CONSTRUCTED A LEAD TRACK ACROSS UP RIVER ROAD 'ALSO KNOWN AS AND SOMETIMES REFERRED TO AS "SHELL ROAD ") TO PROVIDE RAIL SERVICE TO VARIOUS INDUSTRIES SITUATED WITHIN AND WITHOUT THE WESTERLY CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, IN THE AREA LYING BETWEEN UP RIVER ROAD AND STATE HIGHWAY NO. 9, AND THE MISSOURI PACIFIC RAILROAD COMPANY HAS AND IS PRO- _ VIDING RAIL SERVICE TO SUCH INDUSTRIES; AND WHEREAS, THE PROPOSED ROUTE OF INTERSTATE No. 37, WILL CROSS THE AFOREMENTIONED LEAD TRACK OF MISSOURI PACIFIC RAILROAD COMPANY AT A POINT IN THE SOUTHWESTERLY PORTION OF A TRACT OF LAND OWNED BY ATLEE MCCAMPBELL AND MRS. VIOLET MCCAMPBELLj AND WHEREAS, IT HAS BEEN BROUGHT TO THE ATTENTION OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT THE PROPOSED PLANS FORMULATED BY THE STATE HIGHWAY DEPARTMENT OF TEXAS AND THE BUREAU OF PUBLIC ROADS OF THE UNITED STATES OF AMERICA FOR THE CONSTRUCTION OF INTERSTATE NO. 37 AT THE POINT WHERE INTERSTATE No. 37 WILL CROSS THE MISSOURI PACIFIC RAILROAD COMPANY LEAD TRACK PROVIDE THAT THE THROUGH TRAFFIC LANES WILL PASS UNDER THE MISSOURI PACIFIC RAILROAD COMPANY LEAD TRACK AND THE FRONT- AGE ROADS TO BE CONSTRUCTED ALONG AND ON EACH SIDE OF THE THROUGH TRAFFIC LANES OF INTERSTATE NO. 37 WILL "DEAD END" ON EACH SIDE OF SAID MISSOURI PACIFIC RAILROAD COMPANY LEAD TRACK AND WILL NOT PROVIDE FOR A CONTINUOUS FLOW OF TRAFFIC ALONG SUCH FRONTAGE ROADS SERVING THE WESTERLY PORTION OF THE CITY OF CORPUS CHRISTI, TEXAS, AND THE COUNTY OF NUECES; AND WHEREAS, THE CITY OF CORPUS CHRISTI, TEXAS, RECENTLY ANNEXED CERTAIN LANDS AND EXTENDED ITS WESTERLY CORPORATE LIMITS TO THE FORMER w TOWNSHIP OF CALALLEN AND THIS NEWLY ANNEXED AREA AND THE ADJOINING LAND LYING OUTSIDE OF THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, HAVE AND ARE EXPERIENCING A VERY SUBSTANTIAL RESIDENTIAL AND INDUSTRIAL DEVELOPMENT, GROWTH AND EXPANSION, AND FURTHER, THIS AREA LIES WITHIN THE TREND OF FUTURE RESIDENTIAL AND INDUSTRIAL DEVELOPMENT, GROWTH AND EXPANSION; AND 7235 WHEREAS, THE MOVEMENT AND FLOW OF LOCAL TRAFFIC IN THIS AREA IS BECOMING INCREASINGLY MORE CONGESTED AND THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, HAD ANTICIPATED THAT THE FRONTAGE ROADS TO BE CONSTRUCTED ALONG AND ON EACH SIDE OF THE THROUGH LANES OF INTERSTATE N0. 37 WOULD ALLEVIATE, TO A LARGE EXTENT, THESE PROBLEMS; AND WHEREAS, IT IS THE CONSIDERED OPINION OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT THE PRESENT PLANS OF THE STATE HIGHWAY DEPARTMENT OF TEXAS AND THE BUREAU OF PUBLIC ROADS OF THE UNITED STATES OF AMERICA TO "DEAD END" THE FRONTAGE ROADS ON EACH SIDE OF THE AFOREMENTIONED MISSOURI PACIFIC RAILROAD COMPANY. LEAD TRACK WILL FURTHER AGGRAVATE AND COMPLICATE THE FLOW AND MOVEMENT OF LOCAL TRAFFIC IN THIS AREA RATHER THAN ALLEVIATE SAME; N041 THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, URGE THE STATE HIGHWAY DEPARTMENT OF TEXAS AND THE BUREAU OF PUBLIC'ROADS OF THE UNITED STATES OF AMERICA TO RECON- SIDER ITS PLANS AND TO REVISE SAME IN ORDER TO ELIMINATE THE "DEAD ENDS" ON THE AFOREMENTIONED FRONTAGE ROADS AND TO PROVIDE CONTINUOUS FRONTAGE ROADS ALONG INTERSTATE N0. 37 IN THIS AREA BY WIDENING THE UNDERPASS TO INCLUDE SAID FRONTAGE ROADS, OR BY THE CONSTRUCTION OF AN OVERPASS FOR SUCH FRONTAGE ROADS, OR BY PROVIDING FOR THE CROSSING AT GRADE OF SUCH FRONTAGE ROADS WITH THE NECESSARY SAFETY DEVICES; AND FURTHER, THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI, TEXAS, IS AUTHORIZED AND EMPOWERED FOR AND ON BEHALF AND IN THE NAME OF THE CITY OF CORPUS CHRISTI, TEXAS, TO COMMUNICATE W1�TH THE DISTRICT ENGINEER OF THE STATE HIGHWAY DEPARTMENT, AND WITH THE OTHER OFFICIALS OF THE STATE HIGHWAY DEPARTMENT AND THE STATE HIGHWAY COMMISSION AND WITH THE VARIOUS OFFICIALS OF THE BUREAU OF PUBLIC ROADS OF THE UNITED STATES OF AMERICA TO URGE RECONSIDERATION OF THE PRE- SENT PLANS FOR THE CONSTRUCTION OF THE FRONTAGE ROADS ALONG AND ON EACH SIDE OF INTERSTATE N0. 37 AT THE POINT WHERE SUCH FRONTAGE ROADS "DEAD END" ON EACH SIDE OF THE MISSOURI PACIFIC RAILROAD COMPANY LEAD TRACK AND A REVISION OF SAME TO PROVIDE CONTINUOUS AND CONNECTED FRONTAGE ROADS IN -2- +.M t' THE AREA AS HEREINBEFORE SET OUT. TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS fi FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
