HomeMy WebLinkAbout07239 ORD - 05/20/1964AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE WITH THE DEL STARR REALTY CO., INC., A CON- TRACT PROVIDING THAT THE CITY OF CORPUS CHRISTI WILL BE RESPONSIBLE FOR STREET LIGHT BILLINGS TO THE EXTENT OF ONE THOUSAND SIX HUNDRED THIRTY -EIGHT DOLLARS ($1,638.00) ON SEVEN MERCURY VAPOR STREET LIGHTS AND TEN RESIDENTIAL STREET LIGHTS TO BE IN- STALLED IN SCHANEN ESTATES NUMBER Vi, UPON THE PAY- MENT TO THE CITY OF ONE THOUSAND SIX HUNDRED THIRTY - EIGHT DOLLARSI($1,638.00) BY DEL STARR REALTY CO., INC., A COPY OF-WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, THE DEL STARR REALTY CO., INC. IS THE DEVELOPER OF SCHANEN ESTATES NUMBER VI, A SUBDIVISION WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, AND DESIRES THAT THE SAID SUBDIVI- SION HAVE SEVEN MERCURY VAPOR STREET LIGHTS (20,000) LUMEN AND TEN 6,000 LUMEN, WOOD POLE, BRACKET TYPE STREET LIGHTS INSTALLED, MAINTAINED AND SUPPLIED WITH ELECTRICITY BY THE CENTRAL POWER AND LIGHT COMPANY FOR THE BENEFIT OF THE RESIDENTS OF THE SAID SUBDIVISION; AND WHEREAS, THE DEVELOPER IS WILLING AND DESIROUS TO PAY TO THE CITY OF CORPUS CHRISTI THE SUM OF THREE YEARS NORMAL CHARGES FOR THE AFORE- SAID STREET LIGHTS, AMOUNTING TO ONE THOUSAND SIX HUNDRED THIRTY -EIGHT DOLLARS ($1,638.00), IF THE CITY OF CORPUS CHRISTI WILL REQUEST THAT THE SEVEN MERCURY VAPOR STREET LIGHTS AND TEN RESIDENTIAL STREET LIGHTS BE INSTALLED, AND THE SAID CITY OF CORPUS CHRISTI, TEXAS, WILL MAKE PAYMENT OF STREET LIGHT BILLINGS ON THE SAID LIGHTS UP TO THE SAID SUM OF ONE THOUSAND SIX HUNDRED THIRTY -EIGHT DOLLARS ($1,638.00); AND WHEREAS, IT IS BENEFICIAL TO THE RESIDENTS OF THE SAID SUB- DIVISION OF SCHANEN ESTATES NUMBER VI, AND IN THE PUBLIC INTEREST TO DO SO: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE, WITH THE DEL STARR REALTY CO., INC., A CONTRACT PROVIDING THAT THE DEL STARR REALTY CO., INC. WILL PAY TO THE CITY OF CORPUS CHRISTI, TEXAS, THE SUM OF ONE THOUSAND SIX HUNDRED THIRTY -EIGHT DOLLARS ($1,638.00), UPON RECEIPT OF WHICH THE CITY OF CORPUS CHRISTI, TEXAS, WILL ASSUME RESPONSIBILITY FOR PAYMENT OF STREET LIGHT 7239 Y u BILLINGS TO THE CENTRAL POWER AND LIGHT COMPANY ON SEVEN MERCURY VAPOR STREET LIGHTS AND TEN RESIDENTIAL STREET LIGHTS, TO BE INSTALLED IN THE SUBDIVISION OF SCHANEN ESTATES NUMBER VI, UP TO THE SUM OF ONE THOUSAND SIX HUNDRED THIRTY -EIGHT DOLLARS ($1,638.00). SECTION 'L. THE NECESSITY FOR ADEQUATE STREET LIGHTING FOR THE RESIDENTS OF THE SUBDIVISION OF SCHANEN ESTATES NUMBER VI AND THE CITIZENS OF CORPUS CHRISTI USING THE STREETS IN THAT SUBDIVISION TO HAVE ADEQUATE LIGHTING CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _20 0 DAY OF MAY, 1964.
