HomeMy WebLinkAbout07303 ORD - 07/29/1964IMS:JKH AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, SO AS TO ESTABLISH A NEW SCHEDULE OF GAS RATES FOR CUSTOMERS OR CONSUMERS OF THE CITY -OWNED GAS DISTRIBUTION SYSTEM BY AMENDING SECTION 38-46 AND SECTION 38 -47 OF THE CORPUS CHRISTI CITY CODE, 1958; PROVIDING AN EFFECTIVE DATE OF JULY 31, 1964; AND DECLARING AN EMERGENCY. WHEREAS, PRESENT GAS RATES ARE INADEQUATE TO DEFRAY THE OPERATING EXPENSES AND PROVIDE A PROPER RETURN OF INVESTMENT OF THE CITY IN ITS GAS DISTRIBUTION SYSTEM AND IT HAS BEEN DETERMINED THAT IT IS NECESSARY TO INCREASE GAS RATES FOR CUSTOMERS AND CONSUMERS OF THE CITY GAS DISTRI- BUTION SYSTEM AFTER A STUDY AND CONSIDERATION BY THE CITY COUNCIL OF THE PROBLEM: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OORPUS CHRISTI, TEXAS: SECTION 1. THAT NEW RATES APPLICABLE TO CUSTOMERS AND CONSUMERS OF THE CITY -OWNED GAS DISTRIBUTION SYSTEM AND ALL OTHER GAS DISTRIBUTION SYSTEMS IN THE CITY ARE HEREBY ESTABLISHED, AND SECTION 38 -46 OF THE CORPUS CHRISTI CITY CODE, 19518, AS AMENDED, IS HEREBY AMENDED TO READ AS FOLLOWS: "SECTION 38 -46. CLASSIFICATION OF CUSTOMERS AND SCHEDULE OF RATES. ALL CUSTOMERS OTHER THAN ONE OR TWO- FAMILY RESIDENTIAL CUSTOMERS, SEASONAL 'CUSTOMERS, CHURCH CUSTOMERS, SCHOOL CUSTOMERS AND HOSPITAL CUSTOMERS, SHALL BE CLASSIFIED AS GENERAL RATE CUSTOMERS. "ONE AND TWO FAMILY CUSTOMERS. ALL GENERAL RATE CUSTOMERS SHALL BE CHARGED AND THERE SHALL BE COLLECTED THE FOLLOWING CHARGES FOR GAS FURNISHED AND DELIVERED TO THEIR METERS BY THE DEPARTMENT OF PUBLIC UTILITIES OF THE CITY; UNLESS OTHERWISE REQUESTED BY THE CUSTOMER, WHO USES GAS OPERATED AIR COOLING AND AIR CONDITIONING EQUIPMENT UNDER RULES AND RESTRICTIONS HEREINAFTER PROVIDED: GENERAL RATE CUSTOMER GAS RATE FOR BUSINESS. COMMERCIAL. MINIMUM MONTHLY BILL PRICE PER MCF INSIDE OUTSIDE CITY LIMITS CITY LIMITS @ $1.75 $2.75 @ •77 •77 @ .71 .71 @ .45 .445 @ •35 •35 @ .31 .31 .29 .29 @ 2 2 @ $1.75 $2.75 INCENTIVE AIR COOLING AND CONDITIONING GENERAL RATE ALL BUSINESS, COMMERCIAL, INDUSTRIAL AND OTHER GENERAL RATE CUSTOMERS THAT HAVE INSTALLED GAS OPERATED AIR COOLING AND AIR CONDITIONING EQUIPMENT WHEN INSPECTED AND APPROVED BY THE DEPARTMENT OF PUBLIC UTILITIES AND HAVING A RATED INPUT OFF NOT LESS THAN 66,000 BTU PER HOUR, WHO REQUEST, IN WRITING, AN AIR CONDITIONING SUPPLEMENT TO THEIR GAS SUPPLY CONTRACT SHALL BE BILLED FOR THE BILLING MONTHS OF MAY THROUGH OCTOBER INCLUSIVE, AT THE FOLLOWING RATE SCHEDULE: FIRST 1 MCF PER MONTH NEXT 2 MCF PER MONTH NEXT 7 MCF PER MONTH NEXT 40 MCF PER MONTH NEXT 150 MCF PER MONTH NEXT 100 MCF PER MONTH NEXT 700 MCF PER MONTH ALL OVER 1,000 MCF PER MO. ALL CUSTOMERS ANOCON- SUMERS WHO DESIRE TO BE CLASSIFIED AS CHURCH CUSTOMERS OR SCHOOL CUSTOMERS OR HOSPITAL CUSTOMERS SHALL PRESENT EVIDENCE SATISFACTORY TO THE DIRECTOR OF PUBLIC UTILITIES OF THE FACT THAT THE GAS SERVICE I$ FOR USE ON PREMISES USED EXCLUSIVELY FOR CHURCH PURPOSES BY A DULY RECOGNIZED CHURCH IF THE CUSTOMER DESIRES TO BE CLASSIFIED AS A CHURCH CUSTOMER, OR USED EXCLUSIVELY FOR SCHOOL PURPOSES, BEING PUBLIC OR PRIVATE NONPROFIT SCHOOL IF IT IS TO BE CLASSIFIED AS A SCHOOL CUSTOMER, AND USED EXCLUSIVELY FOR HOSPITAL PURPOSES BY A PUBLIC, PAROCHIAL OR NONPROFIT HOSPITAL IF DESIRED TO BE CLASSIFIED AS A HOSPITAL CUSTOMER. THE RATES SET FORTH IN SECTION 1 SHALL BE EFFECTIVE AT ALL TIMES FROM AND AFTER JULY 31, 1964. SECTION 3- IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, (LAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 4. SECTIONS 38 -46 AND 38 -47 OF THE CORPUS CHRISTI.CITY CODE, 1958, AS AMENDED, ARE BY THE ADOPTION OF THIS AMENDED SECTION 38 -46, HEREBY REPEALED BUT NO CHARGES ACCRUING UNDER SAID PREVIOUS EXISTING SEC- TIONS SHALL BE ALTERED, RELEASED, RELINQUISHED OR REVOKED. ALL OTHER PRO- VISIONS RELATING TO RATES AND CHARGES FOR GAS OR SERVICES FURNISHED BY THE GAS DIVISION OF THE DEPARTMENT OF PUBLIC UTILITIES OF THE CITY OF CORPUS CHRISTI SHALLtOT BE AFFECTED OTHER THAN IS HEREIN PROVIDED, SECTION 5. THE NECESSITY FOR IMMEDIATELY REVISING THE GAS RATES OF THE CITY -OWNED GAS DISTRIBUTION SYSTEM OF THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT- NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS 7iEDAY OF JULY, 1964.
