AN ORDINANCE
ABANDONING THE EASEMENT BEING THAT CERTAIN 5 -FOOT WIDE
DRAINAGE EASEMENT ON THE SOUTHERN EDGE OF LOT 13, JACKSON
TERRACE, AND THAT CERTAIN 10 -FOOT WIDE DRAINAGE EASEMENT
ON AND ALONG THE EASTERN EDGE OF LOTS 14, 13, 12 AND 11,
EXCEPT THE NORTH 5 FEET OF LOT 11, JACKSON TERRACE, A
SUBDIVISION IN THE CITY OF CORPUS CHRISTI, TEXAS, AND
RECORDED IN VOL. 24, PAGE 75 OF THE MAP RECORDS OF
NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY.
WHEREAS, THE CERTAIN 5 —FOOT WIDE DRAINAGE EASEMENT ON THE SOUTHERN
EDGE OF LOT 13, JACKSON TERRACE, AND THAT CERTAIN 10 —FOOT WIDE DRAINAGE
6 EASEMENT ON AND ALONG THE EASTERN EDGE OF LOTS 14, 13, 12 AND 11, EXCEPT
THE NORTH 5 FEET OF LOT 11, JACKSON TERRACE, A SUBDIVISION IN THE CITY OF
CORPUS CHRISTI, TEXAS, AND OF RECORD IN VOL. 24, PAGE 75 OF THE MAP RECORDS 9
OF NUECES COUNTY, TEXAS, IS NOT NECESSARY FOR THE INSTALLATION OF DRAINAGE
FACILITIES TO THE LOTS ABUTTING SAID DRAINAGE EASEMENT) AND
WHEREAS, THE CITY IS AGREEABLE TO THE ABANDONMENT OF THE HEREINABOVE
DESCRIBED EASEMENTS AND THE INTEREST OF THE PUBLIC WILL NOT BE AFFECTED BY
THE ABANDONMENT THEREOF:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION I. THAT ALL THAT CERTAIN 5 —FOOT WIDE DRAINAGE EASEMENT ON
THE SOUTHERN EDGE OF LOT 13, JACKSON TERRACE, AND THAT CERTAIN 10 —FOOT WIDE
DRAINAGE EASEMENT ON AND ALONG THE EASTERN EDGE OF LOTS 14, 13, 12 AND 11,
EXCEPT THE NORTH 5 FEET OF LOT 11, JACKSON TERRACE, A SUBDIVISION IN THE

CITY OF CORPUS CHRISTI, TEXAS, AND RECORDED IN VOL. 24, PAGE 75 OF THE MAP e

RECORDS OF NUECES COUNTY, TEXAS, BE AND THE SAME ARE HEREBY DECLARED ABANDONED '
t AND RELEASED AND RELINQUISHED BY THE CITY OF CORPUS CHRISTI UNTO THE RESPECTIVE
PRESENT OWNERS OF THE RESPECTIVE LOTS.
SECTION 2. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE
EASEMENTS HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI—
ANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS

OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECES-
SITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND
THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
THAT SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED THIS THE DAY OF
AUGUST, 1964.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
