HomeMy WebLinkAbout07314 ORD - 08/05/1964BJw :8/II /61+ TEXAS: AN ORDINANCE AUTHORIZING AND DIRECTINGJHE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH DEL STARR',REALTY CO., INC., AND SARATOGA LAND COMPANY, INC., WHEREBY THE CITY AGREES TO TAKE THE NECESSARY ACTION TO PAVE OR HAVE PAVED EVERHART ROAD FROM THE SOUTH LINE OF TEX -MEX RAILROAD TRACK TO THE NORTH EDGE OF THE PAVEMENT ON SARATOGA ROAD, IN CONSIDERATION OF THE AGREEMENT OF THE OWNERS OF LAND ABUTTING SAID EVERHART ROAD TO PROVIDE RIGHT OF WAY, PARTICIPATE IN THE COST AND PERFORM OTHER ACTS, ALL IN ACCORDANCE WITH THE TERMS AND PROVISIONS OF THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 3. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH DEL STARR REALTY CO., INC., AND SARATOGA LAND COMPANY, INC., WHEREBY THE CITY AGREES TO TAKE THE NECESSARY ACTION TO PAVE OR HAVE PAVED EVERHART ROAD FROM THE SOUTH LINE OF TEX -MEX RAILROAD TRACK TO THE NORTH EDGE OF THE PAVEMENT ON SARATOGA ROAD, IN CONSIDERATION OF THE AGREEMENT OF THE OWNERS OF LAND ABUTTING SAID EVERHART ROAD TO PROVIDE RIGHT OF WAY, PARTICIPATE IN THE COST AND PERFORM OTHER ACTS, ALL IN ACCORDANCE WITH THE TERMS AND PROVISIONS OF THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. THE FACT THAT IT IS NECESSARY TO ENTER INTO THE CON- TRACT DESCRIBED IN SECTION 1 HEREOF CREATES A PUBLIC EMERGENCY AND AN IM- PERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THECHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND SEIIN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE J DAY OF AUGUST, lA4.
