ABANDONING THE 10 -FOOT UTILITY EASEMENT HAVING
ITS CENTERLINE ON AND ALONG THE BOUNDARY LINE
BETWEEN LOTS 9, 10, 11 AND 14, 15, 16, BLOCK 5,
BROADMOOR PARK, CORPUS CHRISTI, NUECES COUNTY,
TEXAS, PROVIDING THAT ALL OF THE PORTIONS OF
SAID LOTS ABUTTING SAID EASEMENT SHALL BE CON-
SIDERED ONE TRACT IN THE FUTURE AS TO.SEWER
SERVICE: AND DECLARING AN EMERGENCY.
WHEREAS, the 10 -foot utility easement having its centerline coincidental
with the boundary line between Lots 9, 10 and 11 and Lots 14, 15 and 16, Block
5, Broadmoor Park, Nueces County, Texas, as shown by Map or Plat of said addi-
tion of record in Vol. 5, Page 20, Map Records of Nueces County, Texas, is
unnecessary for the installation of sewer service to the lots abutting said
easement since said lots have been combined into one tract for utility service
purposes and the said tract has two sewer lines available to serve said tract;
and,
WHEREAS, it would be advantageous to the public to abandon said easement
so that the portions of said Lots contained in the hereinafter described area
may be used jointly without the'necessity of leaving the area occupied by
said easement unobstructed by building construction; and,
WHEREAS, it would be advantageous to the public and the City of Corpus
Christi, Texas, for the hereinafter described tract, composed of parts of the
above described lots abutting said easements, shall be considered one tract
in so far as sewer service in the future is concerned:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
Section 1. There is hereby declared abandoned the 10 -foot utility
easement having its centerline on and along the boundary line between Lots 9,
10 and 11 and Lots 14, 15 and 16, Block 5, Broadmoor Park, Corpus Christi,
Nueces County, Texas, as shown by map or plat of said addition of record in
Vol. 5, Page 20, Map Records of Nueces County, Texas, and the City Manager is
hereby authorized and directed to execute such instrument as is necessary to

evidence the abandonment of said easements.
Section 2. The following described tract, composed of parts of the
above described lots abutting said easement, is hereby declared to be one
tract in so far as sewer service for the said tract in the future is concerned,
said tract being described as follows, to -wit:
A 0.7152 -acre tract comprising a portion of Lots Sixteen (16),
Fifteen (15), Fourteen (14), Twelve (12) and Eleven (11), and all
of Lots Ten-(10) and Nine (9); Block-Five (5); BROADM004 PARK
ADDITION to the-City of Corpus Christi, Nueces County, Texas, as
shown on the map of same in Volume 5, page 20, Nueces County Map
Records, and more particularly described, as follows:
Commencing at a 1 -inch iron pipe at the southeast corner, and
most southerly corner, of Lot 8, Block 5, BROADMOOR PARK ADDITION,
said corner being in the West line of David Street, and the West
line of the future Cross -town Expressway,
Thence on the West line of David Street, South 28 degrees 02
minutes 03 seconds West, 150 feet,.to a 1/2 -inch iron rod at the
most Southerly or Southeast corner of Lot 11, Block 5, BROADMOOR
PARK ADDITION.
Thence South 65 degrees 31 minutes 59 seconds West, 35.53 feet
to a 1/2 -inch Iron rod, on the West line of the future Cross -town
Expressway,
Thence North 61 degrees 57 minutes 57 seconds West, 105.00 feet
parallel to the North line of Lot 12, Block 5, BROADMOOR PARK ADDITION,
on the North right -of -way line of the future Cross -town Expressway to
a 1/2 -inch iron rod in the East line of Port Avenue,
Thence on the East line of Port Avenue, North 1 degree 13 minutes
39 seconds West, 204.25 feet to a 5/8 -inch iron rod in the East line of
Port Avenue and in the North line of Lot 16, Block 5, BROADMOOR PARK
ADDITION,
Thence on the North line of said Lot 16, North 61 degrees 57 minutes
57 seconds East, at 82.46 feet the common southerly corner of Lots 8 and
17, Block 5, BROADMOOR PARK ADDITION, and in all 226.46 feet to the
place of commencement. .
Section 3. The necessity for immediate abandonment of said easement
to permit immediate commencement of construction on the said above described
tract creates a public emergency and an imperative public necessity requiring
the suspension of the Charter Rule that no ordinance or resolution shall be
passed finally on the date of its introduction and that such ordinance or
resolution shall be read at three several meetings of the City Council, and

the Mayor having declared such emergency and necessity to exist, having
requested the suspension of said Charter Rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,
this the day of August, 1964.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE,FORE_-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCEDI AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
