AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING CHAPTER 23 BY ADDING A NEW SECTION THERETO TO BE NUMBERED SECTION 23 -38, FOR- BIDDING ANY PERSON FROM LOITERING ON OR FISHING FROM ANY BRIDGE ON OCEAN DRIVE BETWEEN THE INTER- SECTION OF ALAMEDA WITH OCEAN DRIVE AND THE NORTH GATE OF THE CORPUS CHRISTI NAVAL AIR STATION; PRO- VIDING A SAVINGS CLAUSE; PROVIDING FOR PENALTY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY AMENDING CHAPTER 23 BY ADDING A NEW SECTION THERETO TO BE NUMBERED SECTION 23 -38, READING AS FOLLOWS: "SECTION 23 -38. LOITERING ON OR FISHING FROM BRIDGES ON OCEAN DRIVE PROHIBITED. NO PERSON SHALL LOITER ON OR CAST ANY LINE OR NET OR ANY EQUIP- MENT OF ANY KIND USED FOR FISHING OR THE CATCHING OF ANY MARINE LIFE FROM OR WHILE STANDING, SITTING OR HANGING FROM ANY PART OF ANY BRIDGE ON OCEAN DRIVE BETWEEN THE INTERSECTION OF ALAMEDA STREET WITH OCEAN DRIVE AND NORTH GATE OF THE CORPUS CHRISTI NAVAL AIR STATION." SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDI- VISION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD IN- VALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGU- LATIONS RELATE. SECTION 3. ANY PERSON, FIRM OR CORPORATION, VIOLATING THE TERMS AND PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00). SECTION 4. PUBLICATION SHALL BE MADE IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, ONE TIME, WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE AND RECITING THE PENALTY FOR VIOLATION OF THE ORDINANCE. 7320 SECTION 5. THE NECESSITY TO AMEND THE CITY CODE AS HEREINABOVE SET FORTH CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE 9, DAY OF AUGUST, 1964. 0 THE CITY OF CORPUS CHRISTI, TEXAS ATTEST: l CITY SECRETARY APPROVED AS TO EGAL FORM THIS Ti _ /-,Z- DAY OF AUGUST, 1964: CITY ATiORNE CORPUS CHRISTI, TEXAS / � 9� �DAV OF o, TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
