HomeMy WebLinkAbout07323 ORD - 08/19/1964I AN ORDINANCE ' AMENDING ORDINANCE NO'. 2204, PASSED AND APPROVED ON THE 30TH DAY OF DECEMBER, 1947, ALSO KNOWN AS THE "ELECTRICAL' CODE OF THE CITY OF CORPUS CHRISTI, TEXAS" t AS AMENDEDr BY AMENDING SECTION 3 -1(H) , SECTIONS 4 -1, 4 -2, 4 -3, 4 -4, AND 4 -5 BY STRIKING OUT ALL OF THE SAID SECTIONS AS THEY NOW APPEAR AND ADOPTING NEW LANGUAGE FOR EACH OF SAID SECTIONS; PROVIDING AN EFFECTIVE DATE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE NO. 2204, PASSED AND APPROVED ON THE 30TH'DAY OF DECEMBER, 1947, ALSO KNOWN AS THE "ELECTRICAL CODE OF THE CITY OF CORPUS CHRISTI, TEXAS ", ENTITLED, 'AN ORDINANCE REGULATING ELECTRIC WIR- ING WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, FOR SAFEGUARDING PERSONS AND PROPERTY AND PROMOTING THE WELFARE OF THE PUBLIC; CREATING THE OFFICE OF CHIEF ELECTRICAL INSPECTOR AND PRESCRIBING HIS DUTIES, RIGHTS.AND AUTHORITY; ESTABLISHING STANDARDS FOR ELECTRICAL EQUIPMENT AND FOR ITS INSTALLATION AND REQUIRING CONFORMITY THEREWITH; MAKING IT UNLAWFUL t TO UNDERTAKE THE INSTALLATION OF ELECTRICAL EQUIPMENT WITHOUT A PERMIT THERE- FOR, EXCEPT AS OTHERWISE PROVIDED; PROVIDING FOR THE REGISTRATION OF ELECTRI- CAL WORKERS AND CONTRACTORS; ESTABLISHING INSPECTION FEES; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ORDINANCES IN CONFLICT WITH THIS ORDINANCE ", AS AMENDED, BE AMENDED AS FOLLOWS: SECTION 3 -1(H) SHALL HEREAFTER READ AS FOLLOWS: "SECTION 3 -1(H). IN LIEU OF SUCH EXPERIENCE, HE SHALL BE A REGISTERED ELECTRICAL ENGINEER LICENSED BY THE STATE OF TEXAS." SECTION 4 SHALL HEREAFTER READ AS FOLLOWS: "SECTION 4 -1. EXAMINING AND SUPERVISORY BOARD OF ELECTRICIANS CREATED: THERE 15 HEREBY CREATED THE EXAMINING AND SUPERVISORY BOARD OF ELECTRICIANS, CONSISTING OF FIVE (5) PERSONS WHO SHALL BE APPOINTED BY THE MAYOR AND COUNCIL. THIS BOARD SHALL HAVE THE GUIDANCE AND ASSISTANCE OF THE DIRECTOR OF PUBLIC WORKS AND THE CHIEF ELECTRICAL INSPECTOR." 7323 "SECTION 4 -2. QUALIFICATIONS: PERSONS WHO SERVE ON THE EXAMINING AND SUPERVISORY BOARD OF ELECTRICIANS AS MEMBERS SHALL BE QUALIFIED AS FOLLOWS: (A) Two PERSONS EACH OF WHOM SHALL HAVE HAD AT LEAST FIVE YEARS ACTIVE EXPERIENCE AS A MASTER ELECTRICIAN. (B) ONE PERSON SHALL HAVE HAD AT LEAST FIVE YEARS ACTIVE EXPERIENCE AS A JOURNEYMAN ELECTRICIAN. (C) ONE PERSON SHALL BE AN ELECTRICAL ENGINEER, REGISTERED TO PRACTICE IN THE STATE OF TEXAS. (D) ONE PERSON SHALL HAVE HAD BUSINESS EXPERIENCE, SUPERVISORY OR PROPRIETARY IN THE FIELD OF BUILDING CONSTRUCTION, OR EXPERIENCE CLOSELY RELATED THERETO OTHER THAN IN THE ELECTRICAL INDUSTRY." "SECTION 4 -3. TENURE OF OFFICE: THE MEMBERS OF THE EXAMINING AND SUPERVISORY BOARD OF ELECTRICIANS SHALL HOLD OFFICE FROM THE DATE OF THEIR APPOINTMENT AND QUALIFICATION UNTIL THE DATE OF THEIR REAPPOINTMENT) OR THEIR SUCCESSORS HAVE BEEN APPOINTED AND QUALIFIED. AS SOON AS THIS CODE BECOMES EFFECTIVE A BOARD SHALL BE APPOINTED FOR A TERM OF TWO YEARS. ANY MEMBER OF THE BOARD MAY BE REMOVED BY MAJORITY VOTE OF THE MAYOR AND CITY COUNCIL FOR GOOD CAUSE FOLLOWING A PUBLIC HEARING AND AT LEAST TEN DAYS NOTICE THEREOF. VACANCIES WITHIN THE BOARD SHALL BE FILLED BY APPOINTMENT FOR THE UNEXPIRED TERM." "SECTION 4 -4. REGULAR AND CALLED MEETINGS: THE EXAMINING AND SUPERVISORY BOARD OF ELECTRICIANS SHALL HOLD ONE REGULAR MEETING PER MONTH AND SUCH SPECIAL OR CALLED MEETINGS AS ARE NECESSARY FOR ITS PROPER PER- FORMANCE OF DUTY." "SECTION 4 -5. POWERS AND DUTIES: THE BOARD SHALL SELECT A CHAIRMAN AND SHALL PRESCRIBE A PROCEDURE AND ORDER OF BUSINESS FOR HEARING APPLICATIONS FOR CERTIFICATES OF REGISTRATION AND FOR HEARING APPEALS FROM THE DECISIONS OF THE CHIEF ELECTRICAL INSPECTOR AND AGGRIEVEMENT APPEALS AS PROVIDED HEREIN. THE CHIEF ELECTRICAL INSPECTOR OF THE CITY -2- OF CORPUS CHRISTI SHALL ACT AS SECRETARY TO SAID BOARD, BUT SHALL BE EXCUSED FROM ACTING AS SECRETARY TO THE BOARD IN THE EVENT OF HEARING OF APPEALS FROM DECISIONS OF THE ELECTRICAL INSPECTORS SECTION AND IN HIS STEAD ANOTHER PERSON DESIGNATED BY THE BOARD SHALL ACT IN HIS CAPACITY. "(A) IT SHALL BE THE DUTY OF SAID BOARD TO PASS UPON THE QUALI- FICATIONS OF ALL APPLICANTS FOR CERTIFICATES OF ELECTRICAL REGISTRATION. ANY PERSON WHO SHALL MAKE APPLICATION FOR ELECTRICAL REGISTRATION MAY OBTAIN PRO- PER FORMS FROM THE OFFICE OF CHIEF ELECTRICAL INSPECTOR. UPON RECEIPT BY THE DIRECTOR OF PUBLIC WORKS OR HIS AUTHORIZED REPRESENTATIVE OF AN APPLICATION ACCOMPANIED BY PROPER FEE, AN EXAMINATION SHALL BE SCHEDULED FOR THE FIRST MONDAY NEXT FOLLOWING THE RECEIPT OF THE APPLICATION.- "AFTER COMPLETION OF THE EXAMINATION, THE PAPERS WILL BE GRADED ON THE SAME DAY AND THE RESULT ANNOUNCED TO THE APPLICANT IMMEDIATELY. IT SHALL REQUIRE A GRADE OF 70% TO CONSTITUTE A PASSING GRADE. IF THE APPLICANT HAS MADE A PASSING GRADE OF 70% OR MORE, HE WILL BE ISSUED A TEMPORARY CERTI- FICATE OF REGISTRATION UPON PAYMENT OF THE REQUIRED FEES AND THE POSTING OF THE SURETY BOND REQUIRED UNDER SECTION 5 -6. SAID TEMPORARY CERTIFICATE OF REGISTRATION SHALL PERMIT THE HOLDER TO BEGIN PRACTICE IMMEDIATELY. THE REFERENCES SUBMITTED BY THE APPLICANT WILL BE CHECKED AND THE RESULTS OF SUCH INVESTIGATION ACCOMPANIED BY THE APPLICATION FORM AND EXAMINATION PAPERS WILL BE PRESENTED TO THE ENTIRE ELECTRICAL BOARD AT ITS NEXT REGULAR MEETING FOR REVIEW AND CONFIRMATION OF THE REGISTRATION. UPON CONFIRMATION OF THE FACT THAT THE APPLICANT MADE 70% OR MORE ON THE EXAMINATION AND THAT HE HAS GIVEN SATISFACTORY REFERENCES, POSTED SATISFACTORY BOND AND PAID THE REQUIRED FEES, THE BOARD SHALL AUTHORIZE THE ISSUANCE OF A PERMANENT CERTIFICATE OF REGIS- TRATION. IN THE EVENT INQUIRIES OF THE APPLICANTS REFERENCES AND INVESTI- GATION OF PAST EXPERIENCE RECORD DOES NOT RESULT IN SATISFYING THE BOARD AS TO THE QUALIFICATIONS OF THE APPLICANT, A SATISFACTORY EXPLANATION AND FURTHER REFERENCES MAY BE REQUIRED OF THE APPLICANT. UPON FAILURE TO OBTAIN THE APPROVAL OF THE BOARD BY THE FURNISHING OF SATISFACTORY REFERENCES AND SATIS- FACTORY EXPLANATION OF ANY ITEMS IN PAST EXPERIENCE RECORD, OR UPON FAILURE -3- TO MAKE A GRADE OF 70% OR MORE ON THE EXAMINATION AS GRADED BY THE BOARD, THE BOARD SHALL DENY THE PERMANENT REGISTRATION AND NOTIFY THE APPLICANT THAT THE TEMPORARY CERTIFICATE HAS BEEN CANCELLED." "(B). THREE (3) MEMBERS OF THE BOARD PRESENT AT ANY MEETING SHALL CONSTITUTE A QUORUM FOR THE TRANSACTION OF BUSINESS." °(C). FOR EXAMINATIONS, THE BOARD SHALL PREPARE 10 OR MORE SETS OF EXAMINATIONS FOR EACH CLASS OF REGISTRATION OF ELECTRICIANS REQUIRED TO BE EXAMINED UNDER THIS ORDINANCE. WHEN AN APPLICATION FOR EXAMINATION HAS BEEN FILED, A SET OF EXAMINATION QUESTIONS FOR THE PROPER CLASS OF REGISTRANT SHALL BE SELECTED AT RANDOM FROM THE SEVERAL SETS OF EXAMINATION QUESTIONS AND SUBMITTED TO THE APPLICANT FOR THE EXAMINATION. ALL EXAMINATION QUES- TIONS SHALL BE OBJECTIVE IN THEIR NATURE. EACH SET OF QUESTIONS SHALL HAVE A CORRESPONDING PREVIOUSLY PREPARED ANSWER SHEET WHICH SHALL BE USED IN GRADING THE EXAMINATION. PROPER SECURITY SHALL BE USED TO PREVENT ADVANCE INFORMA- TION AS TO QUESTIONS AND COMPLETE SECRECY AS TO THE ANSWERS. ALL PAPERS SHALL BE GRADED IMMEDIATELY IN THE APPLICANT'S PRESENCE. ANY APPLICANT FOR ANY LICENSE REQUIRING AN EXAMINATION UNDER THIS CODE MUST MAKE A PASSING GRADE OF 70% OF HIS EXAMINATION FOR SUCH LICENSE. ANY APPLICANT WHO FAILS TO MAKE SUCH PASSING GRADE MAY REAPPLY FOR EXAMINATION AT ANY TIME AFTER 90 DAYS FROM THE DATE OF THE EXAMINATION LAST TAKEN BY HIM. EACH APPLICATION SHALL BE ACCOMPANIED BY PROPER REFERENCES AND ACCOMPANIED BY THE REQUIRED FEE AS PROVIDED IN THE FIRST INSTANCE.„ "(D). THE EXAMINATION FOR A MASTER ELECTRICIAN'S LICENSE WILL BE GIVEN IN TWO PARTS -- PART 1 - QUESTIONS, AND PART 11 - PLANS. EACH OF THESE TWO PARTS WILL BE GRADED ON A BASIS OF 100% EACH. THE APPLICANT MUST MAKE A GRADE OF AT LEAST 70% ON EACH PART IN ORDER TO QUALIFY FOR A MASTER'S LICENSE. THE APPLICANT WILL BE GIVEN HIS QUESTIONS AND THE EXAMINATION WILL BE GRADED IMMEDIATELY UPON COMPLETION. ONLY IF THE APPLICANT MAKES 70% OR MORE ON PART 1, WILL HE BE ALLOWED TO TAKE PART 11. PART 11 MAY BE TAKEN ON THE SAME DAY OR ON THE FOLLOWING DAY, AT HIS OPTION. IF THE -4- a r APPLICANT MAKES A GRADE OF AT LEAST 70% ON PART I AND IF HE FAILS TO MAKE AT LEAST 70% ON PART 11 HE MAY, AT HIS REQUEST, TAKE AN ALTERNATE PART 11. THIS ALTERNATE PART 11 MUST BE TAKEN AND PASSED WITHIN 90 DAYS FROM THE DATE HE FAILED THE FIRST PART 11. IF THE APPLICANT DOES NOT MAKE AT LEAST 70% ON THE ALTERNATE PART II, HE WILL BE REQUIRED TO WAIT 90 DAYS FROM THE TIME HE FAILED THE ALTERNATE PART 11 BEFORE HE CAN TAKE THE EXAMINATION FOR MASTER ELECTRICIAN AGAIN. AT THAT TIME HE WILL BE REQUIRED TO BEGIN AGAIN AND TAKE PART 1, AND HE WILL BE REQUIRED. TO AGAIN FOLLOW.THE PRO- CEDURE OUTLINED ABOVE." "(E). ANY APPLICANT WHO HAS FAILED THREE EXAMINATIONS MAY AP- PEAL THE BOARDS FAILURE TO LICENSE HIM TO THE CITY MANAGER, WHO WILL APPOINT A SPECIAL BOARD FOR THE PURPOSE OF CONSIDERING WHETHER SUCH APPLICANT SHOULD BE LICENSED. THIS SPECIAL BOARD SHALL CONSIST OF A LICENSED MASTER ELECTRICIAN, AN ELECTRICAL ENGINEER, REGISTERED TO PRAC- TICE IN THE STATE OF TEXAS, AND A MECHANICAL ENGINEER, REGISTERED TO PRACTICE IN THE STATE OF TEXAS. THE SPECIAL BOARD MAYS IN CONSIDERING AN APPEAL, REVIEW THE EXAMINATIONS PREVIOUSLY ADMINISTERED BY THE REGULAR BOARD ORS AT ITS OPTIONS PREPARE, ADMINISTER AND GRADE A SPECIAL EXAMINA- TION. THE ACTION OF THIS SPECIAL BOARD SHALL BE REPORTED TO THE CITY COUNCIL WITH A RECOMMENDATION BASED ON THEIR INVESTIGATIONS, AND THE ACTION OF THE COUNCIL WILL CONSTITUTE FINAL ACTION ON THE APPEAL. IN THE EVENT THE REFERENCES OR THE PAST EXPERIENCE RECORD OF THE APPLICANT IS UNSATISFACTORY TO THE BOARD, AND THE BOARD FAILS TO LICENSE HIM ON THAT ACCOUNT, THE APPLICANT SHALL HAVE THE RIGHT TO APPEAL TO THE CITY MANAGER FOR THE APPOINTMENT OF A SPECIAL BOARD HAVING THE SAME QUALI- FICATIONS AS THE SPECIAL BOARD USED IN CASE OF FAILURE OF THE EXAMINATION AND SAID SPECIAL BOARD SHALL MAKE AN INDEPENDENT INQUIRY OF REFERENCES AND AN INDEPENDENT INVESTIGATION OF PAST EXPERIENCE RECORD AND MAKE ITS REPORT AND RECOMMENDATION TO THE CITY COUNCIL, AND THE ACTION OF THE CITY COUNCIL WILL CONSTITUTE FINAL ACTION ON THE APPEAL." -5- °(F) IT SHALL BE THE DUTY OF THE BOARD TO CONDUCT REVIEWS OF GRIEVANCES, MAKE INVESTIGATIONS AND RENDER DECISIONS IN KEEPING WITH THEIR FINDINGS.„ SECTION 2. SECTION 3. THIS ORDINANCE $HALL TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, EXCEPT THAT THE MEMBERS OF THE PRESENT ELECTRICAL BOARD SHALL CONTINUE IN OFFICE FOR THE BALANCE OF THE TERM FOR WHICH THEY HAVE BEEN APPOINTED. UPON THE OCCASION OF ANY VACANCIES IN OFFICE, AND UPON THE OCCASION OF THE APPOINTMENT TO THE BOARD AT THE TIME OF EXPIRATION OF THE TERM OF ANY OF THE PRESENT MEMBERS OF THE BOARD, APPOINTEES SHALL HAVE QUALIFICATIONS NECESSARY TO MEET THE REQUIRE- MENTS OF SECTION -2 AS AMENDED BY THIS ORDINANCE REGARDING THE COMPOSITION OF THE BOARD. SECTION 4. PUBLICATION SHALL BE MADE IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, ONE TIME, WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE.
