AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR
AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO
EXECUTE AN AGREEMENT WITH THE CORPUS CHRISTI
TENNIS ASSOCIATION AMENDING THE AGREEMENT BETWEEN
THE AFORESAID PARTIES DATED APRIL 6, 1962, AND
THE CLARIFICATION AGREEMENT DATED JANUARY 22, 1963,
WHEREBY THE CITY AND TENNIS ASSOCIATION AGREE TO
PERMIT EXCEPTIONS TO THE CALCULATION OF GROSS
RECEIPTS IN ORDER TO STAGE MORE POPULAR TENNIS
EXHIBITIONS AT THE H. E. BUTT TENNIS AREA IN THE
CITY OF CORPUS CHRISTI, ALL AS MORE FULLY SET OUT
IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY OF CORPUS CHRISTI AND THE CORPUS CHRISTI
TENNIS ASSOCIATION, ON APRIL 6, 1962, ENTERED INTO A CONTRACT FOR THE
CONSTRUCTION OF A STADIUM AND THE LEASING THEREOF TO THE TENNIS ASSOCI-
ATION; AND
WHEREAS, ON JANUARY 22, 1963) THE CITY AND TENNIS ASSOCIATION
ENTERED INTO A CLARIFICATION AGREEMENT WHICH PROVIDED THAT THE CITY
WOULD RECEIVE 56 PERCENT OF THE 75 PERCENT OF GROSS RECEIPTS FOR THE
PURPOSE OF REPAYING THE CITY'S INVESTMENT IN THE CENTER COURT AND THAT
44 PERCENT OF SAID 75 PERCENT OF GROSS RECEIPTS BE DEVOTED TO REPAYMENT
OF COST OF IMPROVEMENTS MADE BY THE CITY; AND
WHEREAS, THE CITY AND THE TENNIS ASSOCIATION WISH TO ENCOURAGE
TENNIS BY BRINGING AMATEUR AND PROFESSIONAL EXHIBITIONS TO THE TENNIS
CENTER AND OCCASIONALLY THE COST OF TRANSPORTATION AND OTHER COSTS OF
BRINGING PLAYERS WILL EXCEED THE 25 PERCENT OF GROSS RECEIPTS; AND IT
IS IN THE BEST INTEREST OF ALL PARTIES TO PERMIT EXCEPTIONS TO THE CAL-
CULATIONS OF GROSS RECEIPTS IN ORDER TO STAGE MORE POPULAR EXHIBITIONS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY,
AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
TO EXECUTE AN AGREEMENT WITH THE CORPUS CHRISTI TENNIS ASSOCIATION
AMENDING THE AGREEMENT BETWEEN THE PARTIES MADE ON APRIL 6, 1962, AND

THE CLARIFICATION AGREEMENT DATED JANUARY 22, 1963, WHEREBY THE CITY
AND TENNIS ASSOCIATION AGREE TO PERMIT EXCEPTIONS TO THE CALCULATION
OF GROSS RECEIPTS IN ORDER TO STAGE MORE POPULAR TENNIS EXIHIBITIONS
AT THE H. E. BUTT TENNIS AREA IN THE CITY OF CORPUS CHRISTI, ALL AS
MORE FULLY SET OUT IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY TO EXECUTE THE AFORESAID AGREEMENT
IMMEDIATELY SO THAT THE NECESSARY ARRANGEMENTS FOR BRINGING AMATEUR
AND PROFESSIONAL EXHIBITIONS TO THE TENNIS CENTER MAY BE MADE WITHOUT
DELAY, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMER-
GENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE
CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE
AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED
