HomeMy WebLinkAbout07351 ORD - 09/16/1964�« vMP:9 -11 -64 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CON- TRACT WITH SOUTH TEXAS CONSTRUCTION COMPANY FOR CON- STRUCTION OF THE CULLEN DITCH DAM AND PUMP STATION, APPLICABLE TO MINOR STORM SEWER PROJECT NO. 295- 64 -44; APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUNDS THE SUM OF $15,000, OF WHICH AMOUNT $13,375 IS FOR THE CONSTRUCTION CONTRACT AND $1,625 IS FOR CONTINGENCIES INCLUDING ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS; AUTHORIZING REIMBURSEMENT TO NO. 109 SEWER FUND THE SUM OF $55 FROM FUNDS HEREBY APPROPRIATED, REPRESENTING REHABILITATION COSTS OF MOTOR AND PUMP TO BE INSTALLED IN CONNECTION WITH THIS PROJECT; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH SOUTH TEXAS CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE CULLEN DITCH DAM AND PUMP STATION, APPLICABLE TO MINOR STORM SEWER PROJECT N0. 295- 64 -44, AS MORE FULLY SET OUT IN THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF SOUTH TEXAS CONSTRUCTION COMPANY OPENED ON THE 9TH DAY OF SEPTEMBER, 1964, THE SAID BID OF SOUTH TEXAS CONSTRUCTION COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 295 STORM SEWER BOND FUNDS THE SUM OF $15,000, OF WHICH AMOUNT $135375 IS FOR THE CONSTRUCTION CONTRACT AND $1,625 IS FOR CONTINGENCIES, INCLUDING ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS. SECTION 3. AUTHORIZATION IS HEREBY GIVEN FOR REIMBURSEMENT TO NO. 109 SEWER FUND IN THE AMOUNT OF $55.00 FROM FUNDS HEREBY APPROPRIATED, REPRESENTING REHABILITATION COSTS OF MOTOR AND PUMP TO BE INSTALLED IN CONNECTION WITH THE AFORESAID PROJECT. SECTION 4. THE NECESSITY FOR PROMPT EXECUTION OF THE CONTRACT AND APPROPRIATION OF THE NECESSARY FUNDS FOR THE CONSTRUCTION OF THE CULLEN DITCH DAM AND PUMP STATION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE 7351 PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI- NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEET- INGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH .EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF SEPTEMBER, 1964.
