AN ORDINANCE
CLOSING THAT PORTION OF AVENUE B BETWEEN BLOCKS
14 AND 19, FROM 3RD STREET THROUGH LOT 10 IN BLOCK
14 AND LOT 4 IN BLOCK 19; CLOSING THE ALLEY IN
BLOCK 14, THE ALLEY IN BLOCK 13 AND THE ALLEY IN
BLOCK 19, ALL IN CALALLEN TOWNSITE, NOW A PART OF
THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS;
RETAINING THE EASEMENT IN THAT PORTION OF AVENUE B
TO BE CLOSED; AND DECLARING AN EMERGENCY.
WHEREAS, NOTICE OF THE INTENTION OF HOLDING A HEARING CONCERNING
THE CLOSING OF A PORTION OF AVENUE B, BETWEEN BLOCKS 14 AND 19, FROM 3RD
' STREET THROUGH LOT 10 IN BLOCK 14 AND LOT 4 IN BLOCK 19, AND THE CLOSING OF
THE ALLEY IN BLOCK 14, BLOCK 13 AND BLOCK 19, ALL IN THE CALALLEN TOWNSITE,
NOW A PART OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, HAS BEEN
GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESS OF ALL
OWNERS OF PROPERTY ABUTTING SAID STREET, AND ALLEY AND WITHIN 450 FEET
THEREOF, AND THEREAFTER PURSUANT TO SAID NOTICE, A PUBLIC HEARING WAS HELD
ON SEPTEMBER 91 1964) BY THE CITY COUNCIL IN ACCORDANCE WITH THE PROVISIONS
OF THE CITY CHARTER; AND
WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL AFTER SUCH
HEARING THAT THE SAID AREA IS NOT NEEDED AS A PUBLIC STREET OR AS A PUBLIC
ALLEY BUT IS NEEDED AS A UTILITY EASEMENT RIGHT OF WAY AND THAT SAID AREA
WILL NOT BE NEEDED AS A PUBLIC STREET OR PUBLIC ALLEY WITHIN THE FORESEEABLE
FUTURE; AND
WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE ADVANTAGE
OF THE CITY TO ABANDON SAID PORTION OF SAID STREET AND SAID ALLEY SO THAT THE
SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES; SUBJECT,
HOWEVER, TO THE RETENTION BY THE CITY OF THE EASEMENT IN THAT PORTION OF
AVENUE B TO BE CLOSED AS A PUBLIC UTILITY RIGHT OF WAY:
NI)W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY CLOSED FOR PUBLIC USE THAT PORTION
OF AVENUE B BETWEEN BLOCKS 14 AND 19, FROM 3RD STREET THROUGH LOT 10 IN BLOCK
14 AND LOT 4 IN BLOCK 19, AND THERE IS HEREBY CLOSED FOR PUBLIC USE THE ALLEY
IN BLOCK 14, THE ALLEY IN BLOCK 13 AND THE ALLEY IN BLOCK 19, ALL IN CALALLEN

TOWNSITE, NOW A PART OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
SUBJECT TO THE RETENTION BY THE CITY OF THE EASEMENT IN THE PORTION OF
AVENUE B TO BE CLOSED.
SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY
WOULD BE BETTER SERVED BY THE CLOSING OF THE SAID STREET AND THE SAID ALLEY
HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO
EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED, THIS THE / 6 DAY OF SEPTEMBER, 1964.

COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
