HomeMy WebLinkAbout07395 ORD - 10/21/1964IMS:EE:10/21/64 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS- AMENDED BY ORDINANCE NO. 61o6, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING THE ZONING MAP BY ADDING TO THE SAID PERMANENT ZONING MAP THOSE AREAS ANNEXED BY ORDINANCE NO. 6242 ON AUGUST 5, 1961, AND ORDINANCE NO. 6636 ON SEPTEMBER 19, 1962, AND OTHER AREAS PUBLICLY AND GOVERNMENTALLY OWNED, INCLUDING THE U. S. NAVAL AIR STATION AREA; AND PERMANENTLY ZONING SAID AREAS SO ANNEXED, ALL AS SHOWN ON A MAP IN FOUR,(4) PARTS HERETO ATTACHED AND MADE A PART HEREOF, AND FOR PURPOSES OF IDENTIFICATION, REFERRED TO AS MAP NO. 1, CARROL AREA; MAP NO. 2, CLARKWOOD AREA; MAP NO. 3, CALALLEN AREA; AND MAP NO. 4, FLOUR BLUFF AREA; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, SEVERAL AREAS OF LAND AND SUBMERGED LAND HAVE BEEN ANNEXED TO THE CITY OF CORPUS CHRISTI, INCLUDING THE FLOUR BLUFF AREA ANNEXED BY ORDINANCE ND. 6242, AND OTHER AREAS ANNEXED BY ORDINANCE N0. 6636, AND OTHER PUBLIC AND GOVERNMENTAL AREAS INCLUDING THE U. S. NAVAL AIR STATION, CORPUS CHRISTI, TEXAS; AND WHEREAS, A PUBLIC HEARING WAS HELD JOINTLY BY THE CITY COUNCIL AND THE ZONING AND PLANNING COMMISSION OF THE CITY OF CORPUS CHRISTI, AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE PERMANENT ZONING OF THE AREAS SHOWN ON THE MAP IN FOUR (4) PARTS, HEREINAFTER DESCRIBED AND IDENTIFIED, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD BEFORE SAID CITY COUNCIL AND SAID ZONING AND PLANNING COMMISSION OF THE CITY OF CORPUS CHRISTI ON SEPTEMBER 23, 1964 AT A SPECIAL MEETING OF THE CITY COUNCIL, WHICH WAS RECESSED AND RECONVENED OCTOBER 7, 1964, IN THE CITY COUNCIL CHAMBER OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, THE ZONING AND PLANNING COMMISSION HAS, SINCE SAID HEARING, FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING SAID AMENDMENT TO THE ZONING MAP; AND 7395 WHEREAS, BY MOTION DULY MADE AND SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS: NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 19375 APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 29TH DAY OF MARCH, 1961, BE AND THE SAME IS HEREBY AMENDED BY AMENDING THE ZONING MAP BY ADDING TO THE SAID PERMANENT ZONING MAP THOSE AREAS ANNEXED BY ORDINANCE N0. 6242 ON AUGUST 5, 1961, AND ORDINANCE No. 6636 ON SEPTEM- BER 19, 19625 AND OTHER AREAS PUBLICLY AND GOVERNMENTALLY OWNED, INCLUDING THE U. S. NAVAL AIR STATION AREA, AND PERMANENTLY ZONING SAID AREAS SO ANNEXED, ALL AS SHOWN ON A MAP IN FOUR (4) PARTS HERETO ATTACHED AND MADE A PART HEREOF. SECTION 2. THAT THERE IS HEREBY ADOPTED AS A PERMANENT ZONING OF SAID ABOVE MENTIONED ANNEXED AREAS TO BE AND BECOME A PART OF THE PERMANENT ZONING MAP OF THE CITY OF CORPUS CHRISTI, A MAP IN FOUR (4) PARTS FOR PURPOSES OF IDENTIFICATION, DESIGNATED AS FOLLOWS: MAP NO. 1 - CARROLL AREA; MAP NO. 2 - CLARKWOOD AREA; MAP NO. 3 - CALALLEN AREA; AND MAP N0. 4 - FLOUR BLUFF AREA. SECTION 3. THAT EACH OF THE DISTRICTS SHOWN ON SAID MAP AS TO THE RESPECTIVE PORTIONS OF THE AREA COVERED BY SAID MAP BE AND THE SAME IS HEREBY PERMANENTLY ZONED AND REZONED IN ACCORDANCE WITH THE SAID MAP. THAT SAID MAP IN SAID FOUR (4) PARTS, AS HEREIN IDENTIFIED, BE AND THE SAME IS HEREBY ADOPTED AS A PART OF THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, AND BE AND REMAIN IN THE CUSTODY OF THE CITY SECRETARY -2- WITH A TRIPLICATE COPY THEREOF IN THE OFFICE OF THE DIRECTOR OF THE ZONING AND PLANNING DEPARTMENT OF THE CITY OF CORPUS CHRISTI AND ONE TRIPLICATE COPY SHALL BE MAINTAINED IN THE DEPARTMENT OF PUBLIC WORKS OF THE CITY OF CORPUS CHRISTI, AS PROVIDED IN SECTION 4 -2 OF SAID ORDINANCE No. 6106. SECTION 4. THAT ALL NOTATIONS, REFERENCES, LEGENDS, SCALES AND EVERY DETAIL SHOWN ON SAID MAP IN FOUR (4) PARTS, AS HEREINAFTER IDENTIFIED, SHALL BE CONSIDERED AS PART OF THIS ORDINANCE AS FULLY AND TO THE SAME EFFECT AS IF SAID ZONING DISTRICT MAP NOTATIONS, REFERENCES, LEGENDS, SCALES AND EVERY DETAIL SHOWN ON THEM WERE FULLY SET FORTH AND DESCRIBED ON SAME. EACH OF SAID TRIPLICATE ZONING DISTRICT MAP SHALL BEAR, FOR IDENTIFICATION AND AUTHENTICATION, THE SIGNATURE OF THE MAYOR OF THE CITY OF CORPUS CHRISTI AND THE ATTESTATION OF THE CITY SECRETARY AND THE DATE OF,THE SIGNATURES AND THE NOTATION "THIS ZONING DISTRICT MAP OF THE AREAS ANNEXED SINCE AUGUST 5, 1961 OFFICIALLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, BY ORDINANCE NO. 3 / jS, PASSED AND APPROVED ON THE 21ST DAY OF OCTOBER, 1964 SECTION 5. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED ON THE 29TH DAY OF MARCH, 1961, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 6. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 7. THE NECESSITY OF IMMEDIATELY MAKING OFFICIAL THE PERMANENT ZONING OF THE ANNEXED AREAS SHOWN ON THE MAP IN FOUR (4) PARTS HEREINABOVE REFERRED TO, FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI, TEXAS, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE,THAT THIS ORDINANCE -3- TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE__g LDAY OF OCTOBER, 1964. ATT v i - THE CITY OF CORPUS CHRISTI, TEXAS CITY SECRETA Y APPROVED AS TO LEGAL FORM THIS THE .2 / DAY OF OCTOBER, 1964: CITY ATTORNEY CORPUS CHRISTI, TEXAS DAY OF , 19_�v TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS 'INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
