WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CONCERNING THE CLOSING OF A PORTION OF NIAGARA STREET BETWEEN HEINLEY STREET AND MORGAN AVENUE WAS GIVEN BY PUBLICATION AND REGISTERED MAIL j\ 7 TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING NIAGARA-..-- - STREET WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER,,/PURSUANT - TO SAID NOTICE, PUBLIC HEARING WAS HELD ON OCTOBER 14, 1964, BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, IN ACCORDANCE WITH THE PRO- VISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEAR- ING THAT A PORTION OF NIAGARA STREET IS NOT NEEDED NOW EXCEPT AS A UTILITY EASEMENT, NOR WILL IT BE WITHIN THE FORESEEABLE FUTURE, NEEDED AS PUBLIC STREET; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO ABANDON THE PORTIONS OF NIAGARA STREET AS A PUBLIC STREET HERE- INAFTER DESCRIBED SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNER FOR OTHER PURPOSES; RESERVING, HOWEVER, THE RIGHT TO CONTINUE THE USE THEREOF FOR UTILITY PIPES AND LINES. EXCEPT FOR THE USE THEREOF FOR UTILITY PIPES AND LINES, THAT THE PORTION OF NIAGARA STREET- BETWEEN HEINLEY STREET AND MORGAN AVENUE IS HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY; MORE PARTICULARLY DESCRIBED AS FOLLOWS: A PORTION OF NIAGARA STREET DEDICATED BY PLAT OF SEGREST ADDITION RECORDED IN VOL. 6 PAGE 7 MAP RECORDS OF NUECES COUNTY, TEXAS.
