HomeMy WebLinkAbout07448 ORD - 12/30/196412/28/64:EE AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR CON- STRUCTION OF THE HILLCREST'ADDITION STORM SEWERS'y' ALONG MOORE AND DEMPSEY STREETS FROM PEABODY TO STILLMAN STREETS IN THE HILLCREST ADDITION, DESIGNATED AS PRO- JECT NO. 295 -64 -44.2; APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND THE SUM OF $8,500, OF WHICH AMOUNT $7,610 IS FOR THE CONSTRUCTION CONTRACT AND $890 IS FOR-CONTIN- GENCIES, INCLUDING ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE - A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE HILLCREST ADDITION STORM SEWERS, CONSISTING OF CONSTRUCTION AND INSTALLATION OF APPROXIMATELY 810 FEET OF 1511 R. C. PIPE AND APPURTENANCES, MANHOLES AND INLETS ALONG MOORE AND DEMPSEY STREETS FROM PEABODY TO STILLMAN STREETS IN HILLCREST ADDITION IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, DESIGNATED AS PROJECT NO. 295 -64 -44.2, ALL AS MORE FULLY SET OUT IN THE PLANS, SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF FOWCO CONSTRUCTION COMPANY, OPENED ON THE 23RD DAY OF DECEMBER, 1964, THE SAID BID OF FOWCO CONSTRUCTION COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $8,500 OUT 1 OF N0. 295 STORM SEWER BOND FUND, OF WHICH AMOUNT $7,610 IS FOR THE CON- STRUCTION CONTRACT AND $890 IS FOR CONTINGENCIES, INCLUDING ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS. SECTION 3. THE NECESSITY TO PROVIDE DRAINAGE IN THE ABOVE OUT- LINED AREA, PRESENTLY WITHOUT ADEQUATE FACILITIES, CREATES A PUBLIC EMER- GENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, 6 7448 a HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF DECEMBER, 1964.
