AN ORDINANCE
APPROVING AND ADOPTING THE WRITTEN STATEMENT AND
REPORT OF THE DIRECTOR OF PUBLIC WORKS, SHOWING
THE ESTIMATES OF THE TOTAL COSTS OF ALL THE IM-
MOVEMENTS, THE ESTIMATES OF THE COST PER FRONT
FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING
r PROPERTY, AMID THE REAL AND TRUE OWNERS THEREOF,
FOR THE CONSTRUCTION OF SIDEWALKS ON THE HEREIN -
AFTER NAMED STREETS IN THE CITY OF CORPUS CHRISTI,
TEXAS, TO WIT:
1. SOUTHWEST SIDE OF MC ARDLE ROAD FROM AYERS
STREET TO CARROLL LANE;
2. NORTHEAST SIDE OF MC ARDLE ROAD FROM CARROLL
LANE TO WEBER ROAD; AND FROM ERASER SCHOOL TO
VANCE DRIVE;
3. SOUTH SIDE OF CAMPANA STREET FROM CARVER STREET
TO GREENWOOD DRIVE;
4. NORTHEAST SIDE OF GOLLIHAR ROAD FROM AYERS STREET
TO KOSTORYZ ROAD; AND
5. SOUTH SIDE OF BLOOMINGTON STREET FROM THE WEST
BOUNDARY LINE OF MOLINA JUNIOR HIGH SCHOOL TO THE
WEST BOUNDARY LINE OF MOLINA ADDITION, NO. 2;

DETERMINING AND FIXING THE PORTION OF SAID COST AND
THE RATE THEREOF PROPOSED TO BE ASSESSED AGAINST AND
PAID BY THE ABUTTING PROPERTY, AND THE REAL AND TRUE
OWNERS THEREOF; DETERMINING THE NECESSITY OF LEVYING
< AN ASSESSMENT AGAINST SAID ABUTTING PROPERTY, AND THE
REAL AND TRUE OWNERS THEREOF, FOR THE PORTION OF SAID

AND IMPROVEMENTS; DIRECTING THE CITY SECRETARY OF THE
CITY OF CORPUS ?CHRISTI, TEXAS, TO GIVE NOTICE OF SAID
HEARING AS REQUIRED BY LAW; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
• SECTION 1. THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, HEREBY FINDS AND DETERMINES:
(A) THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,

HAS HERETOFORE BY ORDINANCE NO. 7�.5'.i_DULY ENACTED ON THE 13TH DAY OF
JANUARY, 1965, DETERMINED THE NECESSITY FOR AND ORDERED THE CONSTRUCTION

1. SOUTHWEST SIDE OF MCARDLE ROAD FROM AYERS STREET TO CARROLL
LANE;
2. NORTHEAST SIDE OF MCARDLE ROAD FROM CARROLL LANE TO WEBER RD.;
AND FROM FRASER SCHOOL TO VANCE DRIVE;
3. SOUTH SIDE OF CAMPANA STREET FROM CARVER STREET TO GREENWOOD
DRIVE;
4. NORTHEAST SIDE OF GOLLIHAR ROAD FROM AYERS STREET TO KOSTORYZ
ROAD; AND
5. SOUTH SIDE OF BLOOMINGTON STREET FROM THE WEST BOUNDARY LINE
OF MOLINA JUNIOR HIGH SCHOOL TO THE WEST BOUNDARY LINE OF
MOLINA ADDITION, NO. 2,
AND IN THE MANNER AND ACCORDING TO THE PLANS AND SPECIFICATIONS THEREFOR
WHICH SAID PLANS AND SPECIFICATIONS HAVE HERETOFORE BEEN APPROVED AND
ADOPTED BY THE CITY COUNCIL.
(B) THAT A NOTICE DULY ENACTED IN THE,NAME OF THE CITY OF CORPUS
CHRISTI, TEXAS, OF THE ENACTMENT OF SAID ABOVE DESCRIBED ORDINANCES HAS
HERETOFORE BEEN FILED WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS, THE
COUNTY IN WHICH THE CITY OF CORPUS CHRISTI IS SITUATED AND SUCH NOTICE
HAS BEEN DULY RECORDED IN THE DEED OF TRUST RECORDS OF NUECES COUNTY, TEXAS.
(C) THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHR9'STI, TEXAS,
HAS CAUSED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE ESTIMATES OF
THE COSTS OF SUCH IMPROVEMENTS AND ESTIMATES OF THE AMOUNT PER FRONT FOOT
TO BE ASSESSED AGAINST THE PROPERTY ABUTTING SAID SIDEWALKS; AND THE

DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATE-
MENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCILS AND THE SAME
HAVING BEEN RECEIVED, EXAMINED AND APPROVED BY SAID CITY COUNCIL; AND THAT
IN ACCORDANCE WITH SAID STATEMENT OF 'THE ESTIMATE SO FILED BY THE DIRECTOR
OF PUBLIC WORKS AND HEREIN APPROVED, THE AMOUNT OF SAID ESTIMATED COSTS ARE
HEREIN APPROVED, THE AMOUNT OF SAID ESTIMATED COSTS ARE HEREINAFTER STATED
AND SET OUT AND A SCHEDULE CONTAINED IN SECTION 2 HEREOF.
SECTION 2. THE WRITTEN STATEMENT AND REPORT OF THE DIRECTOR
OF PUBLIC WORKS HERETOFORE FILED WITH THE CITY COUNCIL, SHOWING THE
ESTIMATED TOTAL COSTS OF THE CONSTRUCTION OF SAID SIDEWALKS SHOWING
THE AMOUNTS PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING
PROPERTY AND AGAINST THE REAL AND TRUE OWNERS THEREOF FOR SAID IMPROVE-

SECTION 3. THE COST OF SAID IMPROVEMENTS SHALL BE PAID AS
FOLLOWS, TO WIT:
(A) THE CITY SHALL REIMBURSE ITSELF FOR NOT MORE THAN 80% OF
THE COST OF THE IMPROVEMENTS BY ASSESSMENT AGAINST THE RESPECTIVE ABUTTING
PROPERTIES AND THE REAL AND TRUE OWNERS THEREOF IN ACCORDANCE WITH THE
PROVISIONS OF SAID ARTICLE 11056, VERNON'S TEXAS CIVIL STATUTES. NO
ASSESSMENTS SHALL BE MADE AGAINST ANY ABUTTING PROPERTY OR THE REAL AND
TRUE OWNERS THEREOF FOR COSTS IN EXCESS OF THE BENEFITS TO SUCH PROPERTY
IN ENHANCED VALUE THEREOF BY MEANS OF SUCH IMPROVEMENTS. THE AMOUNTS OF

SUCH ASSESSMENTS SHALL CONSTITUTE A FIRST AND PRIOR LIEN UPON ALL SUCH
PROPERTIES AND A PERSONAL LIABILITY OF THE REAL AND TRUE OWNERS THEREOF,
WHETHER NAMED OR CORRECTLY NAMED OR NOT. ASSIGNABLE CERTIFICATES IN EVIDENCE
OF THE ASSESSMENTS SO LEVIED SHALL BE ISSUED IN FAVOR OF THE CITY OF CORPUS
CHRISTI FOR THE AMOUNT OF THE ASSESSMENT. SAID PAYMENTS SHALL BE PAYABLE
IN MONTHLY INSTALLMENTS OF NOT EXCEEDING TWENTY —FOUR (24) IN NUMBERS SAID
PAYMENTS TO BE MADE AT THE CITY HALL IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, THE FIRST OF WHICH SHALL BE PAYABLE WITHIN THIRTY (30) DAYS
FROM THE DATE OF THE COMPLETION OF SAID IMPROVEMENTS AND THEIR ACCEPTANCE
BY THE CITY OF CORPUS CHRISTI, AND ONE INSTALLMENT EACH MONTH THEREAFTER
UNTIL PAID, WITH INTEREST THEREON AT THE RATE OF FIVE PERCENT (5 %) PER
ANNUM, PAST DUE PRINCIPAL AND INTEREST TO BEAR INTEREST AT THE SAME RATE. ,
PROVIDED HOWEVER THAT THE OWNERS OF ANY OF SAID PROPERTIES SHALL HAVE
THE PRIVILEGE OF PAYING ALL OR ANY OF SAID INSTALLMENTS AT ANY TIME BEFORE

THE OWNERS OF ANY OF SAID PROPERTY MAY PAY THE TOTAL AMOUNT ASSESSED AGAINST

COMPLETION AND ACCEPTANCE OF SAID IMPROVEMENTS. IF DEFAULT BE MADE IN

OWNERS OF, AND ALL OWNING OR CLAIMING ANY INTEREST IN ANY PROPERTY ABUT-
TING UPON SAID SIDEWALKS, AND TO ALL OTHERS OWNING, OR CLAIMING ANY INTEREST
IN SAID PROPERTY OR ANY OF SAID MATTERS, AS TO THE ASSESSMENTS AND AS TO
THE AMOUNT TO BE ASSESSED AGAINST EACH PARCEL OF ABUTTING PROPERTY, AND THE
REAL AND TRUE OWNERS THEREOF, AND AS TO THE SPECIAL BENEFITS, IF ANY, TO
SAID PROPERTY TO BE RECEIVED BY SAID IMPROVEMENTS, AND CONCERNING ANY ERROR,
OR CONTRACT
INVALIDITY, IRREGULARITY OR DEFICIENCY IN ANY PROCEED I NGS/WI TH REFERENCE

AT WHICH TIME AND PLACE ALL PERSONS, FIRMS, CORPORATIONS OR ESTATES OWNING
OR CLAIMING ANY SUCH ABUTTING PROPERTY, OR ANY INTEREST THEREIN, AND THEIR
AGENTS OR ATTORNEYS, AND PERSONS INTERESTED IN SAID PROCEEDINGS, SHALL BE

DELAY CREATES AN EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE

BY EXCAVATING AND GRADING TO A WIDTH OF SIX (6) FEET AND CONSTRUCTING A "
FOUR (4) FOOT WIDE REINFORCED CONCRETE SIDEWALK FOUR l� INCHES THICK
EXCEPT SIX (6) INCHES THICK ACROSS COMMERCIAL DRIVEWAYS). ALL SUCH IM-
PROVEMENT SHALL BE CONSTRUCTED IN ACCORDANCE WITH THE PLANS AND SPECIFI-
CATIONS THEREFOR5 WHICH ARE NOW ON FILE IN THE DEPARTMENT OF PUBLIC WORKS
OF THE CITY OF CORPUS CHRISTI AND TO WHICH PLANS AND SPECIFICATIONS REFERENCE
IS HEREBY MADE FOR A MORE PARTICULAR. DESCRIPTION OF SUCH IMPROVEMENTS.
SAID ORDINANCE FURTHER PROVIDES THAT A PORTION OF THE COST OF
SAID IMPROVEMENTS IS TO BE SPECIALLY ASSESSED AS�A LIEN UPON THE PROPERTY
ABUTTING SAID STREETS AND AS A PERSONAL LIABILITY AGAINST THE OWNERS OF
SUCH ABUTTING PROPERTY, SUCH ASSESSMENTS TO BE PAYABLE TO THE CITY OF
CORPUS CHRISTI. h
WHEREFORES THE CITY OF CORPUS CHRISTI, TEXAS, ACTING BY AND
THROUGH ITS CITY COUNCIL HAS CAUSED THIS NOTICE TO BE SIGNED BY THE CITY
