BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: % SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A LICENSE AGREEMENT WITH THE FEDERAL AVIATION AGENCY FOR A TERM OF FIVE (5) YEARS, FOR THE LOCATION OF AN APPROACH LIGHT, THE INSTRU- MENT LANDING SYSTEM, MIDDLE MARKER AND REMOTE TRANSMITTER AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT, A COPY OF SAID LICENSE AGREEMENT, WITHOUT EXHIBITS, BEING ATTACHED HERETO. 7603 t FEDERAL AVIATION AGENCY FA66SW- 10 9 gj APPROACH LIGHT LANE SITE and EFAL INSTRUMENT LANDING SYSTEM SITES .., .. ❑ RADAR SITES . For and inconsideration of (hiiiAljVaVi tt.bb4ldEi• %a�lrl&A/a'dd lYkieVkt the benefit to the Municipal Airport and to the general public utilizing same, the undersigned, herein- after referred to as the licensor, hereby grants to the United States of America the license, right and privilege to install, operate and maintain an approach light lane; an instrument landing system; radar facilities; and necessary control facilities, upon the following described lands in the County of Nueces in the State of Texas more particularly -- described as follows: See ATTACHMENT "N' i j 2. Together with the right of ingress and egress over the said lands and adjoining lands of the licensor, necessary or convenient for the installation, operation and maintenance of the approach light lane; an instrument landing system; radar facilities; and necessary control facilities; and a right -of -way for a power line and control line, overhead and underground, or other facilities, over and across the said lands and adjoining lands of the licensor, said right of ingress and egress and said .' right -of -way, unless hereinbefore described by metes and bounds, to be by the most convenient routes; and the right to utilize any existing power lines, control lines, conduits, or other facilities of the licensor which are adaptable to use in connection with the purpose of this license. 3. The right of ingress and egress and the right -of -way herein granted shall inure to the benefits of the licensee and its duly authorized agents, representatives, contractors and employees. 4. This license maybe canceled by either party upon six months notice in writing, or at any date which may be mutually agreed upon.,, 7. All structures, improvements, or other property placed upon the said premises by the United States shall remain its property and may be removed by it upon the expiration or termination of this license or within 90 days thereafter. S. No Member of or Delegate to Congress or Resident Commissioner shall be admitted to any share or part of this license or to any benefit to arise therefrom. Lathing, however, herein con- tained shall be construed to extend to any incorporated company, if the license be for the general benefit of such corporation or company. 9. NON - DISCRIMINATION: The licensor shall not discriminate against any employee or applicant for employment because of race, creed, color, or national origin. The licensor shall include a similar provision in any subcontract he may enter into in connection with the performance of'this license. (Executive Order 9346 dated May 27, 1943). RAY KRING CITY SECRETARY [CORPORATE SEAL] . —_ rA66SW. 10 9 ATTACHMENT "A" APPROACH LIGHTING SYSTEM AND ELECTRONIC FLASHING APPROACH LIGHT SITE A tract of land on and adjoining the Corpus Christi Municipal Airport, Nueces County, Texas, and more particularly described as follows: r Starting at a point on the center of the northwest end of the NW /SE Runway, said point to be the Point of Beginning, proceed S 45° 47' 380 - W 150 feet; thence N 44° 12' 22" W 210 feet; thence N 45° 47' 38" E 75 feet; thence N 44° 12' 22" W 2900 feet; thence N 45° 47' 38" E 150 feet; thence S 441 12' 22" E 1530 feet; thence N 45° 47' 38" E 225 feet; thence S 440 12' 2211 E 100 feet;thence S 45° 47' 38" W 225 s feet; thence S 44° 12' 22" E 1270 feet; thence N 450 47' 38" E 75 { feet; thence S 44° 12' 22" E 210 feet; thence S 45° 47' 38" W 150 i feet to the Point of Beginning. Said tract contains 11.9 acres, more j or less. INSTRUMENT LANDING SYSTEM LOCALIZER: A tract of land on the Corpus Christi Municipal Airport, Nueces County, Texas, and more particularly described as follows: Starting at a point on the centerline of the pavement at the South- east end of the NW /SE Runway, proceed S 44° 12' 22" E 1770 feet to ? the Point of Beginning; thence N 45° 47' 38" E 210 feet to an iron y pipe; thence S 440 12' 22" E 400 feet to an iron pipe; thence S 45° 47' 38" W 540 feet to a point; thence N 44° 12' 22" W 400 feet to an iron pipe; thence N 45° 47' 38" E 330 feet to the Point of Beginning, said tract containing 4.97 acres, more or less. This license is to include the right to install a ten -foot surfaced access road from a point near the Southwest corner of the above described plot to State Farm Market Road No. 763, a distance of approximately 990 feet. This license is to include the right to construct the driveway from the site of the runway to this plot. MIDDLE MARKER SITE: A tract of land on the Corpus Christi Municipal Airport, Nueces County,,Texas, and more particularly described as follows: From a point on the centerline of the Northwest end of the NW /SE Run- way proceed N 44° 12' 22" W along the centerline of the Runway extended 3429 feet to the Point of Beginning; thence S 45° 47' 38" W 70 feet to a point; thence N 44° 12' 22" W 80 feet to a point; thence N 45° 47' 38" E 140 feet to a point; thence S 44° 12' 22" E 80 feet to a point; thence S 45° 47' 38" W 70 feet to the Point of 1 Beginning, said tract containing 0.25 acre, more or less. This license is to include the right to install a service entrance road to the existing old Shell Pump Road and includes the right to use and maintain this Shell Pump Road from this point to U. S. Highway 44.- A copy of Drawing FW -D- 4488 -4 is attached hereto and made a part hereof. a This license for the Instrument Landing System facilities is to include the right to install and maintain power and control cables from the Terminal Building to the various facilities. REMOTE TRANSMITTER FACILITY A tract of land on the Corpus Christi Municipal Airport, Nueces County, Texas, and more particularly described as follows: From the centerline point of the Southeast end of the NW /SE Runway pavement West Southwest approximately 3000 feet to an airport prop- erty corner along the North right -of -way line of Koser Road, thence East along said right -of -way six feet to the Point of Beginning; thence North 300 feet to a point; thence continue North 240 feet; 1 j FA66SW- 1 09 3 i thence East 240 feet; thence South 240 feet; thence West 190 feet; thence South 300 feet to said right -of -way line; thence West along said right -of -way 50 feet to the Point of Beginning and containing 1.48 acres, more or leas. Bearings are true. The Federal Aviation Agency, or its authorized representatives, shall be per- mitted to install overhead power service from Koser Road to the facility and underground power and control cable as necessary from the facility to equip- meat room, Federal Aviation Agency control quarters. This license shall become effective July 1, 1965, and shall remain in force until June 30, 19662 and may, at the option of the Government, be renewed from year to year upon the terms and conditions herein specified. The Government's option shall be deemed exercised and the license renewed each year for one year unless the Government gives thirty (30) days' notice that it will not exercise its option before this license or any renewal thereof expires; provided, That no renewal thereof shall extend the period of occupancy of the premises beyond the 30th day of June, 1970. 11.
