WHEREAS, A CERTAIN UTILITY EASEMENT EXISTS IN LOT A, BAYMOOR ANNEX TO THE CITY OF CORPUS' - CHRISTI, AS SHOWN BY MAP OR PLAT OF BAYMOOR ANNEX, FILED IN VOLUME 22, PAGE 19 OF THE MAP RECORDS OF NUECES COUNTY, TEXAS, ON THE 10TH DAY OF FEBRUARY, 1959; AND WHEREAS, SAID UTILITY EASEMENT IS NOT NOW USED OR NEEDED BY THE CITY OF CORPUS CHRISTI: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1• THAT ALL OF THAT =CERTAIN UTILITY EASEMENT HERETOFORE EXISTING IN LOT A, BAYMOOR ANNEX TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BE AND THE SAME 15 HEREBY DECLARED ABANDONED AND RELEASED AND RELINQUISHED BY THE CITY,OF CORPUS CHRISTI UNTO THE PRESENT OWNERS. SECTION 2. JOHN R.PAOIL ROBERT E UY I E June 18, 1965 Mr. Herbert Whitney, City Manager City of Corpus Christi Corpus Christi, Texas ` Dear Mr. Whitney: X represent Pontiac Refining Corp. of this city; On the 8th day of October, 1958, Emil King made a plat for Buena Vista Corporation creating a one -lot subdivision known as "Lot A, Baymoor Annex to the City of Corpus Christi„ Nueces County, Texas. " This plat was approved by the Zoning and Planning Com- mission on the 5th day of February, 1959 and was filed for record in Vol. 22, page 19 of the Map Records of Nueces County, Texas on the 10th day of February, 1959. As will be noted from the attached copy of such plat, a five foot utility easement was dedicated along the east line adjacent to Bay - moor Addition, and thereafter Buena. Vista Corporation sold this property to Pontiac Refining Corp. Thereafter, in 1962, the State of Texas acquired a substantial portion of this lot, through the center thereof, running in an easterly- westerly direction, and left a small triangular- shaped piece of land at the south end thereof, adjacent to Lots 1 and an.unnumber,ed lot of Baymoor Addition, as shown on the attached plat. "•Pontiac. Refining Corp. has now agreed to sell this property to Gulf Oil Corporation, who has acquired a portion oPthe lots of Baymoor Addition adjoining it. This five foot utility easement, therefore, creates a severance in the proper- ties which Gulf would purchase and they have requested an abandon- ment of it. This easement has never been used and there can be no use for it, in view of the highway department's acquisition. It is understood that the City Engineering Department concurs in this statement. { s -a- It is therefore requested that the City of Corpus Christi abandon this easement at the earliest possible time, so that the transaction can be closed with Gulf. As shown on the attached plat, the approximate area taken by Highway No. 37, the portion being re- tained by Pontiac, and the portion proposed for sale to Gulf, to- gether with Gulf's other contemplated purchase in Baymoor Addi- tion. Due to the urgency and the fact that this can be a non- controversial question, it is hoped that this matter can receive action at the Council meeting on June 23, 1965. You very truly, David M.
