AN ORDINANCE GRANTING AUTHORITY TO SOUTHERN
COMMUNITY GAS COMPANY TO ASSIGN TO NUECES
INDUSTRIAL GAS COMPANY ALL RIGHTS, PRIVILEGES
AND FRANCHISES GRANTED TO SOUTHERN OtORMUNITY
GAS COMPANY BY ORDINANCE NO. 6856 FINALLY
PASSED AND APPROVED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI ON APRIL 3, 1963;
PRESCRIBING CONDITIONS; AND DECLARING AN EMER
GENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF
CORPUS CHRISTI, TEXAS: ,
Section 1. The City Council of the City of Corpus
Christi hereby authorizes Southern.Community Gas Company to
assign to Nueces Industrial Gas Company all rights, privileges
and franchise granted to Southern Community Gas Company by Ordi-
nance No. 6856 finally y passed by the City of Corpus Christi on

April 3, 1963, and hereby consents to and approves such Assign-
ment; provided, however, that such consent is given upon the
condition that said Nueces Industrial Gas Company assumes all
of the terms, - ,conditions, provisions, requirements and agree-
ments in the aforesaid Ordinance No. 6856 devolved upon Southern
Community Gas Company, and that Coastal States Gas Producing
Company, the owner of all of the outstanding shares of stock
of the said Nueces Industrial Gas Company, shall guarantee the
performance of all obligations under such franchise so to be
assumed by Nueces Industrial Gas Company.' k
Section 2. Within thirty (30) days from June 30, 1965,
Southern Community Gas Company shall file.a copy of sald'ass£gn-
ment'to Nueces Industrial Gas Company with the City.Secretary
of the City of Corpus Christi.
Section 3. Section 21` of the aforesaid Ordinance No.
6856 provides that no assignment of the franchise shall be bind -
upon upon the City without its consent and approval thereof having

been obtained by action of the City Council. The grantee therein,
Southern Community Gas Company, has agreed to sell the gas system,
exercising the rights under said franchise, to Nueces Industrial
Gas Company on July 1, 1965, and desires to assign all rights
and privileges under said Ordinance to Nueces Industrial Gas Company.
For such reasons, there exists a public emergency requiring this
Ordinance to be passed finally on the date of its introduction,
and the Mayor having in writing declared the existence of such
emergency and requested such passage,othis Ordinance shall be fin -

ally passed on the date of its introduction, this 7th' day of July,
1965, and shall take effect immediately upon its passage and approval
by the Mayor.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
