PROCEEDINGS; DIRECTING THE CITY SECRETARY TO GIVE NOTICE
OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE OF
TEXAS AND THE CHARTER OF THE CITY OF CORPUS CHRISTI,
TEXAS, AND FURTHER, DIRECTING SAID CITY SECRETARY IN
ADDITION TO THE CONTENTS OF THIS NOTICE OF SAID HEARING
AS REQUIRED BY LAW, WHICH SHALL BE VALID AND SUFFICIENT
IN ITSELF, TO KEEP ON FILE A LIST OF THE APPARENT OWNERS
AND DESCRIPTION OF SAID ABUTTING PROPERTY AS SET OUT IN
SAID REPORT OF THE DIRECTOR OF PUBLIC WORKS AND PROVIDING
THAT SAID LIST OF APPARENT OWNERS SHALL NOT BE CONCLUSIVE
OF SAID OWNERSHIP AND SHALL NOT LIMIT SAID NOTICE TO SUCH
OWNERS' NAMES OR THE PROPERTIES DESCRIBED, AND THE SAID
NOTICE SHALL NEVERTHELESS BE DIRECTED TO THE REAL AND
TRUE OWNERS OF SAID ABUTTING PROPERTY, WHETHER NAMED OR
CORRECTLY NAMED OR NOT; AND DECLARING AN EMERGENCY.

HERETOFORE ON THE 18TH - DAY OF AUGUST, 1965, BY DULY ENACTED ORDINANCE
DETERMINED THE NECESSITY FOR AND ORDERED THE IMPROVEMENT OF THE PORTIONS OF
COMANCHE STREET, FROM PORT AVENUE TO PALM DRIVE; BLUNTZER STREET, FROM PORT

AVENUE TO COMANCHE STREET; PALM DRIVE, FROM COMANCHE STREET TO LIPAN STREET;
BEACH AVENUE, FROM U. S. HIGHWAY 181 TO TIMON BLVD.; PUEBLO STREET, FROM
BALDWIN BLVD. TO PINE STREET; AND FIFTEENTH STREET, FROM BALDWIN BLVD. TO
CRAIG STREET, A DULY EXECUTED NOTICE OF SAID ORDINANCE HAVING THEREAFTER BEEN
FILED IN THE NAME OF THE CITY WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS;

WHEREAS, PURSUANT TO THE ORDINANCE OF AUGUST 18 , 1965,
ABOVE MENTIONED, AND AFTER HAVING ADVERTISED FOR AND RECEIVED BIDS ON THE
CONSTRUCTION OF SAID IMPROVEMENTS FOR THE LENGTH OF TIME AND IN THE MANNER
AND FORM AS REQUIRED BY THE CHARTER OF SAID CITY AND THE LAWS OF THE STATE
OF TEXAS, HAVING AWARDED A CONTRACT FOR THE CONSTRUCTION OF SAID IMPROVE-
MENTS TO WOMACK AND MANNING ON THEIR LOWEST AND MOST ADVANTAGEOUS BID, AND
HAVING DULY AND REGULARLY MADE APPROPRIATION OF FUNDS AVAILABLE FOR SAID
PURPOSE TO COVER THE ESTIMATED COST TO SAID CITY.OF CORPUS CHRISTI OF SAID
IMPROVEMENTS, ALL AS PROVIDED BY THE CORPUS CHRISTI CITY CHARTER AND BY-
LAWS AND THE LAWS OF THE STATE OF TEXAS, DID EXECUTE HERETOFORE ON THE
22ND DAY OF JULY, 1965, A CONTRACT WITH WOMACK AND MANNING, AND THE PER-
FORMANCE BOND REQUIRED BY SAID CONTRACT HAVING BEEN PROPERLY FURNISHED AND
POSTED BY SAID WOMACK AND MANNING AND ACCEPTED BY SAID CITY COUNCIL AS TO
FORM AND AMOUNT AS REQUIRED BY THE CHARTER OF THE CITY AND THE LAWS OF THE
STATE OF TEXAS; AND
WHEREAS, THE SAID CITY COUNCIL HAS CAUSED THE DIRECTOR OF PUBLIC
WORKS TO PREPARE AND FILE ESTIMATES OF THE COSTS OF SUCH IMPROVEMENTS AND
ESTIMATES OF THE AMOUNT: PER FRONT FOOT PORPOSED TO BE ASSESSED AGAINST THE
PROPERTY ABUTTING SAID STREET TO BE IMPROVED, AND THE REAL AND TRUE OWNERS
THEREOF, AND SAID4DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTI-
MATES AND A STATEMENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY
COUNCIL, AND THE SAME HAVING BEEN RECEIVED AND EXAMINED BY SAID CITY COUNCIL;

WHEREAS, IN ACCORDANCE WITH SAID STATEMENT OF ESTIMATES AND OTHER
MATTERS PREPARED AND FILED BY SAID DIRECTOR OF PUBLIC WORKS HEREIN APPROVED
BY SAID CITY COUNCIL, THE TOTAL ESTIMATED COST OF THE WHOLE IMPROVEMENT OF
COMANCHE STREET, BLUNTZER STREET, PALM DRIVE, BEACH AVENUE, PUEBLO'.1.STREET
AND FIFTEENTH STREET, WI =THIN THE LIMITS ABOVE DEFINED, IS- $91,298.88; THE
ESTIMATED AMOUNT PER SQUARE FOOT TO BE ASSESSED AGAINST EACH ABUTTING PRO-
PERTY, AND THE REAL AND TRUE OWNERS THEREOF, FOR SIDEWALKS ON SAID STREETS,
WITHIN THE LIMITS ABOVE DEFINED, IS $0.34 PER SQUARE FOOT; THE ESTIMATED
AMOUNT PER SQUARE FOOT TO BE ASSESSED AGAINST EACH ABUTTING PROPERTY, AND

GUTTERS AND - PAVING ON SAID STREETS WITHIN THE LIMITS ABOVE DEFINED, FOR

Summary of Street Improvements
and
Assessment Rates
1. Comanche Street, from Port Avenue intersection to intersection of
Palm Drive; and will be 44' wide, face to face of curb.
2. Bluntzer Street, from Port Avenue intersection to intersection of
Comanche Street; and will be 30' wide, face to face of curb.
3. Palm Drive, from Comanche Street intersection to Lipan Street in-
tersection; and will be 44' wide; face to face of curb.
4. Beach Avenue, from U. S: Highway Frontage Road to Timon Blvd. in-
tersection; and will be 40' wide, face to face of curb.
5. Pueblo Street, from Baldwin Blvd. intersection to Pine St. inter-
section; and will be 30' wide, face to face of curb:
6. 15th St., from Baldwin Blvd. intersection to intersection of Craig
St.; and "will be 30` ,ride, face to face of curb.
The improvement of these streets will consist generally of excavation
to a width and depth to permit the construction of concrete curbs and
gutters, 4' wide, 4" thick reinforced concrete sidewalks, 6" thick re-
inforced concrete driveways, and a triple- course asphalt surface on a
compacted subgrade and 8" compacted caliche base. The adjustment of
existing storm sewers and /or the installation of additional storm
sewers and appurtenances necessary for proper drainage of improved
streets.
The assessment rates for streets over 30' wide, face to face of curb,
will be:

THEREOF, FOR SIDEWALKS ON THE AFOREMENTIONED STREETS, WITHIN THE LIMITS
ABOVE DEFINED, IS $0.34 PER SQUARE FOOTS THE ESTIMATED AMOUNT PER SQUARE
FOOT TO BE ASSESSED AGAINST EACH ABUTTING PROPERTY, AN� THE REAL AND TRUE

SHALL PAY NOT LESS THAN ONE -TENTH (110) OF THE TOTAL REMAINING COST OF
SAID IMPROVEMENTS ON SAID STREET, EXCLUSIVE OF THE COST OF THE CURBS,
GUTTERS AND SIDEWALKS, ADJACENT TO THE RESPECTIVE PROPERTIES ABUTTING UPON
SAID STREET, SAID COSTS BEING IN THE AMOUNT AS HEREINABOVE SET OUT IN
SECTION 2 HEREOF.
B. THE PROPERTY ABUTTING UPON SAID STREETS WITHIN THE LIMITS
ABOVE DEFINED AND THE REAL AND TRUE OWNERS THEREOF SHALL BE ASSESSED AND
PAY THE ENTIRE COST AS DETERMINED BY FULL CONTRACT COST OF CURBS AND GUTTERS
AND NEW DRIVEWAYS AND SIDEWALKS, EXCLUSIVE OF ENGINEERING COSTS AND EXCLU-
SIVE OF COST FOR EXCAVATION FOR BASES AND EXCLUSIVE OF STORM SEWER COST.
SAID AMOUNTS PAYABLE BY THE ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS
THEREOF SHALL NOT IN ANY CASE EXCEED ALL OF THE COST OF CONSTRUCTING, RE-
CONSTRUCTING, REPAIRING AND REALIGNING CURBS GUTTERS AND SIDEWALKS AND

MENTS, AND THE FURTHER FACT THAT THE PRESENT CONDITION OF SAID PORTIONS
OF SAID STREETS IS DANGEROUS TO THE HEALTH AND PUBLIC WELFARE OF THE IN-
HABITANTS OF THE CITY OF CORPUS CHRISTI, DUE TO THE CONDITIONS ALONG SAID
PORTIONS OF SAID STREETS CREATES A PUBLIC EMERGENCY AND PUBLIC IMPERATIVE
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE
OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF
THE CITY COUNCI L; AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY
AND IMPERATIVE NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE
BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER

WITHIN THE LIMITS ABOVE DESCRIBED, TO BE IMPROVED BY RAISING, GRADING,
FILLING, WIDENING, PAVING, REPAVING OR REPAIRING SAME AND BY THE CONSTRUC-
TION, RECONSTRUCTION, REPAIRING OR REALIGNING CONCRETE SIDEWALKS, CURBS,
GUTTERS AND DRIVEWAYS WHERE THE DIRECTOR OF PUBLIC WORKS DETERMINES
ADEQUATE SIDEWALKS, CURBS, GUTTERS AND DRIVEWAYS ARE NOT NOW INSTALLED
ON PROPER GRADE AND LINE, AND BY CONSTRUCTING SUCH STORM SEWERS AND DRAINS,
TOGETHER WITH ALL OTHER NECESSARY INCIDENTALS AND APPURTENANCES, ALL AS
DEEMED ADEQUATE BY THE DIRECTOR OF PUBLIC WORKS AND AS PROVIDED FOR IN
THE PLANS AND SPECIFICATIONS FOR SUCH IMPROVEMENTS THEREOF AS PREPARED
BY SAID DIRECTOR OF PUBLIC WORKS.
THAT ORDINANCE NO. 7683 PASSED BY THE CITY COUNCIL ON THE
18TH DAY OF AUGUST, 1965, PROVIDED THAT THE AMOUNTS PAYABLE BY THE
REAL AND TRUE OWNERS OF SAID ABUTTING PROPERTY SHALL BE PAID AND BECOME
PAYABLE IN ONE OF THE FOLLOWING METHODS AT THE OPTION OF THE PROPERTY

1. ALL IN CASH WITHIN 20 DAYS AFTER THE.COMPLETION OR +ACCEPT-

3. PAYMENTS TO BE MADE IN MAXIMUM OF SIXTY (60) EQUAL INSTALL-
MENTS THE FIRST OF WHICH SHALL BE PAID WITHIN TWENTY (20) DAYS AFTER
THE COMPLETION OF SAID IMPROVEMENT, AND THE ACCEPTANCE THEREOF BY THE CITY,
AND THE BALANCE TO BE PAID IN FIFTY —NINE (59) EQUAL CONSECUTIVE MONTHLY
INSTALLMENTS COMMENCING ON THE 1ST DAY OF THE NEXT SUCCEEDING MONTH AND
CONTINUING THEREAFTER ON THE 'IST DAY OF EACH SUCCEEDING MONTH UNTIL THE
ENTIRE SUM IS PAID IN FULL, TOGETHER WITH INTEREST FROM THE DATE OF SAID
COMPLETION AND ACCEPTANCE BY THE CITY, UNTIL PAID, AT THE RATE OF FIVE (5)
PERCENT PER ANNUM; PROVIDED, HOWEVER, THAT THE OWNERS OF SAID PROPERTY
AVAILING THEMSELVES OF OPTION "2a OR "3" ABOVE SHALL HAVE THE PRIVILEGE OF
PAYING ONE, OR ALL, OF SUCH INSTALLMENTS AT ANY TIME BEFORE MATURITY
THEREOF BY PAYING THE TOTAL AMOUNT OF PRINCIPAL DUE, TOGETHER WITH INTEREST
ACCRUED, TO THE DATE OF PAYMENT. AND SAID ORDINANCE FURTHER PROVIDED THAT
THE AMOUNTS PAYABLE BY THE ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS
