AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE,
FOR AND ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN
THE CORPUS CHRISTI CHAMBER OF COMMERCE, ACTING BY AND
THROUGH ITS AREA DEVELOPMENT COMMITTEE, JOINED WITH THE
CITY OF CORPUS CHRISTI, JOINTLY REFERRED TO IN SAID
AGREEMENT AS "C"ITTEE ", WITH HARLAND BARTHOLOMEW AND
ASSOCIATES FOR CONSULTING SERVICES, A COPY OF WHICH
AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF;
APPROPRIATING THE SUM OF $57,000.00, OF WHICH AMOUNT
$10,000.00 IS TO BE FROM THE GENERAL FUND CONTINGENCY
RESERVE; THE SUM OF $35,000.00 IS FROM STREET BdND
FUND NO. 220 FOR PROJECT NO. 220- 61 -49; AND THE AMOUNT
OF $12,000.00 IS FROM STREET BOND FUND NO. 220 FOR
PROJECT NO. 22o- 64 -61; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE-CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THECITY, AN AGREEMENT BETWEEN
THE CORPUS CHRISTI CHAMBER OF COMMERCE, ACTING BY AND THROUGH ITS AREA
DEVELOPMENT COMMITTEE, JOINED WITH THE CITY OF CORPUS CHRISTI, JOINTLY
REFERRED TO IN SAID AGREEMENT AS "COMMITTEE ", WITH HARLAND BARTHOLOMEW AND
ASSOCIATES FOR CONSULTING SERVICES, A COPY OF WHICH AGREEMENT IS ATTACHED
HERETO AND MADE A PART HEREOF.
SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $57,000.00,
OF WHICH AMOUNT $10,000.00 IS FROM THE GENERAL FUND CONTINGENCY RESERVE;
THE SUM OF $35,000.00 IS FROM STREET BOND FUND NO. 220 FOR PROJECT NO.
220- 61 -49; AND THE AMOUNT OF $12,000.00 IS FROM STREET BOND FUND N0. 220
FOR PROJECT No. 220- 64 -61.
SECTION 3. THE NECESSITY TO AUTHORIZE THE CITY MANAGER TO
EXECUTE THE ABOVE DESCRIBED AGREEMENT AND TO APPROPRIATE THE FUNDS
HEREINABOVE SET FORTH IN ORDER THAT THE SERVICES PROPOSES TO BE RENDERED
MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
ORDINANCE OR RESOLUTION SHALL BEG'PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAI SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT

DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE
SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT I& ACCORDINGLY SO ORDAINED, THIS

AGREEMENT
THIS AGREEMENT entered into this day of September;;, -'e
' ,1965 by and between the Area Development TEmittee of the Corpus
Christi Chamber of Commerce, hereinafter referred to as the
•- "Committee" and Harland Bartholomew and Associates, Planners,
^? Engineers and Landscape Architects of St. Louis, Missouri, here-
inafter referred to as "Consultant ".
WITNESSETH:
Section 1. The Committee here ",by retains the Consultant for
the preparation of certain studies, plans and analysis constitut-
ing a Revised Comprehensive Area Plan for the Corpus Christi Area,
said studies being described in detail in Exhibit A attached hereto
and made a part of this Agreement. The Consultant hereby agrees
n to prepare the Revised Comprehensive Area Plan in the manner de—
Ivr, scribed in Exhibit A, AND TO DO ALL THINGS WHICH IN EXHIBIT A ARE RECOMMENDED
AS THINGS WHICH SHOULD BE DONE AND WILL BE DONE-
• Section 2. The Revised Comprehensive Area Plan includes
studies o s regional" nature applying to Corpus Christi and the
eleven- county area around it, and studies identified as "urban"
!� in nature, being prepared only for the City of Corpus Christi and
%�1' its more immediate environs. A breakdown by work items showing
U the estimated costs for each work item and the portion applicable
to the regional studies and to the urban studies is shown on
Exhibit B attached hereto and made a part of this Agreement, It
is agreed and understood that the amount assigned to "soil borings ",
Item F -3, is based on an estimate. If the borings cost less than
$10,000 the contract fee will be reduced by this amount; if greater,
with the approval of the Committee, the fee will be increased.
Section 3. The Committee hereby engages the Consultant to
prepare TEe urban area portions of the Revised Comprehensive Area
Plan for a fee of One Hundred One Thousand One Hundred Dollars
($101,100,00). The Committee and Consultant agree further that
they will endeavor to encourage the formation of an official
Regional Planning Commission, which Commission will prepare the
regional aspects of the Revised Comprehensive Area Plan. The Com-
mittee does not make any guarantee that said Regional Commission,
if and when organized, will engage the Consultant to prepare these
or any other regional studies. However, the Consultant agrees that
he will prepare the regional aspects of the Revised Comprehensive
Area Plan for an official Regional Planning Commission for the sum
of Sixty -eight Thousand Your Hundred Dollars ($68,400.00) if said
Commission so requests him to do so on or before April 1, 1966.
The Consultant further agrees that he will assist any such Regional
Planning Commission in making application to the Housing and Home
Finance Agency for a Federal Grant to assist in the financing of
the regional aspects of the Revised Comprehensive Area Plan.- If
an official Regional Commission is not organized by July 1, 1966,
the Committee may, by an addendum to this Agreement, engage the
Consultant to prepare said regional.aspects.,

Section 4. Consultant agrees to present to the Committee
tents ve an preliminary drafts of the urban aspects of the
Revised Comprehensive Area Plan in accordance with the schedule t
shown on Exhibit B and to present to the Committee his final re-
port on the urban aspects of the Revised Comprehensive Area Plan
not later than twenty -four (24) months from the dateof this Agree-
ment with the understanding that should the Agreement with the
Regional Planning Commission for the regional aspects of the pro-
gram be entered into on or before July 1, 1966, Consultaat ,,will',
include in his final report said regional aspects of the plan
'also and that he will present one final report dealing with both
the regional and the urban aspects of the Revised Comprehensive
Area Plan.

Section 5. Consultant shall submit to the 'Committee on the a
first o oac month a detailed written statement giving an account-
ing of Consultant's activities and of the progress of his work. t
Section 6. The fee of $101,100 shall be paid to the Consultant
in the OT ow ng manner:
(a) $2,845.52, which has been paid the•Cott ultant by
the Committee under n previous temporary Agreement,
(b) $1,154.48 on October 1, 1965,
(c) $4,000.00 to be paid on the first of each month
starting on November 1, 1965 for the following
twenty -three (23) consecutive months, and

THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; Ip THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
