AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACCEPT THAT
PORTION OF PORT AVENUE FROM THE SOUTH RIGHT OF WAY LINE
OF INTERSTATE 37 TO THE WEST RIGHT OF WAY LINE OF THE
CROSSTOWN EXPRESSWAY AS A CITY STREET AND TO ASSUME
MAINTENANCE THEREOF IN THAT THIS PORTION OF PORT AVENUE
IS NO LONGER STATE HIGHWAY 286 AND STATE HIGHWAY 286
HAS BEEN REROUTED ALONG THE CROSSTOWN EXPRESSWAY FROM
THE INTERSTATE HIGHWAY 37 TO PORT AVENUE; FURTHER AUTHORIZING
THE CITY MANAGER TO EXPRESS THE CITY'S APPRECIATION TO THE
STATE HIGHWAY DEPARTMENT FOR THE FINE FACILITY CONSTRUCTED
BY THE HIGHWAY DEPARTMENT; AND DECLARING AN EMERGENCY.
WHEREAS, TEXAS STATE HIGHWAY 286, FROM INTERSTATE HIGHWAY 37 TO
ITS INTERSECTION WITH THE CROSSTOWN EXPRESSWAY, HAS BEEN REROUTED AND THEREBY
ABANDONED BY THE STATE OF TEXAS; AND
WHEREAS, HIGHWAY 286 HAS BEEN REROUTED FROM ITS PORT AVENUE LOCA-
TION AS ABOVE DESCRIBED TO THE FACILITY KNOWN AS THE CROSSTOWN EXPRESSWAY
FROM THE INTERSTATE HIGHWAY 37 ALONG THE CROSSTOWN EXPRESSWAY; AND
WHEREAS, STATE MAINTENANCE HAS CEASED ALONG PORT AVENUE FROM THE
INTERSTATE HIGHWAY• 37 TO THE CROSSTOWN AND CONSEQUENTLY PORT AVENUE FROM THE
INTERSTATE HIGHWAY 37 TO THE CROSSTOWN EXPRESSWAY IS NOW A CITY STREET AND
HAS BEEN RETURNED TO THE CONTROL, JURISDICTION AND MAINTENANCE OF THE CITY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY
OF CORPUS CHRISTI, BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO ACCEPT
CONTROL, JURISDICTION AND MAINTENANCE OF PORT AVENUE FROM THE INTERSTATE
HIGHWAY 37 TO THE CROSSTOWN EXPRESSWAY, AND THE CITY MANAGER IS FURTHER
AUTHORIZED AND DIRECTED TO EXPRESS THE APPRECIATION OF THE CITY OF CORPUS
CHRISTI TO THE STATE HIGHWAY DEPARTMENT FOR THE EXCELLENT FACILITY KNOWN
AS THE CROSSTOWN EXPRESSWAY.
SECTION 2. THE FACT THAT A PORTION OF PORT AVENUE HEREINABOVE
DESCRIBED IS NOT NOW NEEDED AND WILL NOT IN THE FUTURE BE NEEDED BY THE
j STATE HIGHWAY DEPARTMENT AND THE SAID HIGHWAY DEPARTMENT DESIRES THAT THE

CITY ASSUME CONTROL, JURISDICTION AND MAINTENANCE OF SAID PORTION OF PORT

AVENUE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF
THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTERRULE
AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION,
AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY SO ORDAINED, THIS THE_jU,DAY OF JANUARY, 1966.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
