SPECIAL COUNCIL MEETING
JUNE 9, 1982

Mayor Luther Jones called the meeting to order in the Council Chamber of
City Hall.
City Secretary Bill G. Read called the roll of required Charter Officers
and verified that the necessary quorum was present to conduct a legally consti-
tuted meeting.
Mr. Larry Wenger, Acting Director of the Planning Department, announced the
public hearing on Application No. 582-6, Preis Investments, for change of zoning
from "R -1B" One -family Dwelling District to "A-1" Apartment House District on
Lots 39, 40 and 41, Block 1, Lexington Subdivision, located on the north side of
Johanna Street, approximately 712 feet east of Ayers Street. He informed the
Council that 22 notices of the public hearing were mailed to property owners in
the area, three in favor and five in opposition were returned; and both the
Planning Commission and Planning Staff recommend denial.
Mr. Wenger located the area on the zoning and land use map, described the
land use in the surrounding area, showed slides of the area and stated that the
owner has made the request in order to construct apartments. He noted that this
tract is located primarily in an "R -1B" residential zoned area but located an
area where apartments are now in existence.
Council Member Kennedy inquired as to how long the other "A-1" zoning has
been effect.
Mr. Wenger stated that it had been for about 10 years. He noted that this
area is in the code enforcement area and efforts are being made to improve the
entire neighborhood. He pointed out that the street is a residential type
street and is designed only for single-family dwellings and that approval of
this request for zoning would increase the traffic.

Mayor Jones called on the applicant to speak.
Mr. James Preis displayed the plans for the apartments and photographs of
the existing multiple family use in the neighborhood. Mr. Preis explained that
at the time this was considered by the Planning Commission and they recommended
denial of the request, he contacted mortgage companies and they expressed the
opinion that it would be difficult to construct new homes considering the
surrounding businesses and apartments. He stated that he also contacted the
banking institution who agreed with that evaluation and stated that they would
be glad to finance apartments for these lots. He explained that he also contacted
an appraiser to determine what the best use of the property would be and it was
his opinion that the highest and best use for this property would be for low
rent apartments.
Council Member Hawkins inquired of Mr. Preis if he had discussed his plan
with the people who lived in the area.
Mr. Preis explained that at the Planning Commission meeting, the people had
indicated that they did not want apartments built there. He stated that the
property owner next door to his property did not want as many as thirty apart-
ments; therefore, he would accept "R-2" zoning which would allow for a lesser
number of units.
Council Member Kennedy inquired as to the length of time Mr. Preis had
owned this land and Mr. Preis stated he has owned it for three months.
Council Member Dumphy pointed out to Mr. Preis that the history on this
property has been consistent in that the neighbors object strenuously to any
rezoning of this property.
Mr. Preis pointed out that there is a need for low and middle income rental
units in this City.
Mayor Pro Tem Turner reminded Mr. Preis that this Council, for the past
three years, has worked very hard to retain that street as residential.
Also speaking in favor of the application was Mr. George Preis who stated
that there are only 5% of the people in the Country who can afford to purchase a
house at this time and their plan would upgrade the property values in the
neighborhood. He reiterated that they would accept "R-2" zoning at this time.
Council Member Kennedy indicated that he would vote against this zoning
request.

A motion was made by Mayor Pro Tem Turner that the hearing be closed,
seconded by Council Member Hawkins and passed unanimously.
A motion was made by Mayor Pro Tem Turner that the application be denied,
seconded by Council Member Hawkins and passed unanimously.
*Council Member Kennedy departed the meeting at 5:38 p.m.
Mr. Preis asked Mayor Jones why the people who are opposed to the zoning of
"A-1" were not allowed to speak.
Mayor Jones stated that Mr. Preis was out of order in that the hearing had
been closed.
Mr. Wenger noted that "R-2" zoning would have allowed 19 units.

Acting Director Wenger announced the public hearing on Application No.
582-5, Mr. John T. Tucker, for change of zoning from "A-1" Apartment House
District to "B-1" Neighborhood Business District on 1.38± acres out of Lot 9,
Section 19, Flour Bluff and Encinal Farm and Garden Tracts located on the
northwest corner of Rodd Field and Wooldridge Roads.
Mayor Jones ascertained that no one in the audience wished to speak on this
zoning application.
A motion was made by Council Member Gulley that the hearing be closed,
seconded by Council Member Hawkins and passed unanimously.
A motion was made by Mayor Pro Tem Turner that Application No. 582-5 be
approved for "B-1" zoning; seconded by Council Member Gulley; and passed unani-
mously.
There being no further business to come before the Council, on motion by
Mayor Pro Tem Turner, seconded by Council Member Hawkins, and passed unanimously,
the Special Council Meeting was adjourned at 5:40 p.m., June 9, 1982.
NOTE: The ordinance granting the zoning on the John T. Tucker applicaton was
passed during the Regular Council Meeting of this date.
