AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY ,OF CORPUS CHRISTI, TO EXECUTE
STRUCTION OF THE BALDWIN STORM SEWER LATERALS
PROJECT NO. 295-64-40; APPROPRIATING OUT OF NO. 295
STORM SEWER BOND FUNDS THE SUM OF 78.611.00, OF WHICH
AMOUNT $75,806.90 IS FOR THE CONSTRUCTION CONTRACT AND
$2,804.10'IS FOR CONTINGENCIES, INCLUDING ENGINEERING,
.LABORATORY TESTING AND LEGAL ADVERTISING COSTS; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, 0
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A CONTRACT WITH FOWCO CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE BALDWIN
STORM SEWER LATERALS, PROJECT No. 295- 64 -40, SAID CONSTRUCTION TO CONSIST
OF THE INSTALLATION OF APPROXIMATELY 8864 FEET OF 15" TO 36" PIPE AND
APPURTENANCES IN MOHAWK, VIR INIA, HIAWATHA, SHAWNEE, CORTEZ, VERA CRUZ,
NAVAJO�:CHIPPEWA, PINE AND LOU STREETS AND AIRPORT ROAD, ALL NEAR AND
n NORTH OF BALDWIN BETWEEN MOHAWK STREET AND AIRPORT ROAD, ALL AS MORE
t FULLY,,SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON
FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF
BY REFERENCE, AND ACCORDING TO THE BID OF FOWCO CONSTRUCTION COMPANY, OPENED
FON THE 9TH DAY OF MARCH, 1966, THE SAID BID OF FOWCO CONSTRUCTION COMPANY
BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 295 STORM
SEWER BOND FUND THE SUM OF $78,611.00, OF WHICH AMOUNT $75,806.90 IS FOR
THE CONSTRUCTION CONTRACT AND $2,80.10 IS FOR CONTINGENCIES, INCLUDING
ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS.
SECTION 3. THE NECESSITY TO PROVIDE THE FUNDS HEREBY APPROPRIATED
" AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE AFORESAID CONTRACT IN
ORDER TO CONSTRUCT FACILITIES AND PROVIDE SEWER SERVICE IN AN AREA PRESENTLY

WITHOUT ADEQUATE DRAINAGE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE

PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT
SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER
RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE_Z� DAY
