HomeMy WebLinkAbout08037 ORD - 06/01/1966• THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the day o , the Ci Council of the City of Corpus Christi, Texas, convened in meeting, with the following members of said Council present, o -wit: McIver Furman Mayor Jack R. Blackmon W. H. Wallace, Jr. Patrick J. Dunne Dr. P. Jimenez, Jr. Commissioners Ken McDaniel Ronnie Sizemore T. Ray Kring City Secretary with the following absent: constituting a quorum, at which time the following among other business was transacted: Mr. McI .Ver Furman, Mayor, presented for the considera- tion of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council a communica- tion in writing pertaining to said proposed ordinance, as follows: " pus Christi, Texas, 1966. TO THE CITY COUNCIL Corpus Christi, Texas Gentlemen: The public importance and the pressing need for acquisition, purchase, construction, improvement and extension forahire within nthe rCity oofs Corpus fChristi cb +r he gCitypacreatess a public emergency and an imperative public necessity requiring C M I • the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council. 1, therefore, request that the City Council pass the proposed ordinance calling an election for the issuance of said bonds as an emergency measure. You will please consider this request in connection with the ordinance which has been introduced in the City Council on this subject. The Mayor announced that the ordinance had been passed. he ordinance is as follows: ORDINANCE NO. 8®i '7 - BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF BONDS FOR THE ACQUISITION, PURCHASE, CONSTRUCTION, IMPROVE- MENT AND EXTENSION OF A STREET TRANSPORTATION SYSTEM FOR THE CARRYING OF PASSENGERS FOR HIRE WITHIN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, ITS SUBURBS AND ADJACENT AREAS, IN THE AGGREGATE AMOUNT OF $500,000,; PROVIDING DETAILS FOR THE HOLDING OF SUCH ELECTION; AND DECLARING AN EMERGENCY. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1. That an election be held in said City of Corpus Christi, Texas, on the 25th day of June, 1966, at which elec- tion the following proposition shall be submitted to the resident, qualified electors of the City of Corpus Christi, Texas, who own taxable property in said City and who have duly rendered the same for taxation: PROPOSITION Shall the City Council of the City of Corpus Christi be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $500,000, with the bonds of each such series or issues, respectively, to mature serially within not to exceed 25 years from their date, and to bear interest at rates not to exceed 5% per annum, for the purpose of buying and constructing a public bus transporta- tion system and shall said City Council be author- ized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the interest on said bonds and to provide a sinking fund to pay said bonds at maturity? 2. That voting machines shall be employed at the election herein ordered in accordance with the provisions of V. A. T. S. Election Code, Article 7.14, and said election shall be held at the polling places in the regularly prescribed voting precincts of the City of Corpus Christi, such voting precincts, polling places, and the officers hereby appointed to conduct the election thereat being as follows: I IT1_ Mau. J',•i,�'• That Edna Meador is hereby appointed Presiding Judge and MARGIE- LAWRENCE is hereby appointed Alternate Presiding Judge of a special canvassing board which shall count and canvass the absentee votes. The City Secretary shall conduct the absentee voting, and the office of the City Secretary in the City Hall is hereby designated as the place at which absentee voting shall be conducted during regular office hours of the City Secretary. That the Presiding Judge at each polling place shall appoint not less than two nor more than three qualified election clerks to serve at the election, but one of such clerks shall be the Alternate Presiding Judge. If the Pre- siding Judge is unable to serve at the election, the Alternate Judge shall serve as the Presiding Judge. 3. That said election shall be held in accordance with the provisions of Chapter 1, Title 22 of the Revised Civil Statutes of Texas, 1925, as amended, including the provisions of Article 704, as amended by Chapter 382, passed at the first called session of the 44th Legislature, and the City Charter of the City of Corpus Christi, Texas, and only legally quali- fied electors who own taxable property in the City and who have duly rendered the same for taxation shall be qualified to vote. 4. The ballots for said election shall have written or printed thereon the following: "FOR THE ISSUANCE OF BUS SYSTEM BONDS" "AGAINST THE ISSUANCE OF BUS SYSTEM BONDS" 5. A substantial copy of this ordinance shall serve as proper notice of said election. Notice shall be given in accordance with Article 704, Revised Civil Statutes of 1925, as amended. The Mayor is authorized and directed to have a copy of said notice posted at the City Hall in said City and at each of the voting places in said City, not less than fifteen days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. 6. That the public importance and the pressing need for the acquisition, purchase, construction, improvement and extension of a street transportation system for the carrying of passengers for hire within the City of Corpus Christi by the City, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council,and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and that such ordinance take effect and be in full force and effect from after its passage, it is accordingly so ordained this the -.L day of JUNr, 1966.
