AN ORDINANCE
APPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND FUND
THE SUM OF $1,403.00,t OF WHICH $1,325.00 IS FOR PUR-
CHASE OF LAND AND $715.00 IS FOR TITLE EXPENSE AND RE-
LATED COSTS THERETO, ALL APPLICABLE TO PROJECT NO.
250- 61 -45, LEXINGTON CENTER SANITARY SEWER MAIN AND
LIFT STATION SITE; AUTHORIZING AND DIRECTING THE CITY
MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI WITH THE OWNER
OF THE PARCEL OR TRACT OF LAND, PALL. F. OCKER AND WIFE,
LILLIE B. OCKER; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF NO. 250 SANITARY
SEWER BOND FUND THE SUM OF $1,403.00, OS WHICH AMOUNT $1,325.00 IS FOR
PURCHASE OF LAND AND $78.00 IS FOR TITLE EXPENSE AND RELATED COSTS THERETO,
ALL APPLICABLE TO PROJECT No. z50- 61 -45, LEXINGTON CENTER SANITARY SEWER
MAIN AND LIFT STATION SITE, SAID PARCEL BEING MORE FULLY DESCRIBED AS FOLLOWS,
TO -WIT:
AN IRREGULAR SHAPED TRACT OF LAND OUT OF LOT 3 SECTION 4
OF THE BOHEMIAN COLONY LANDS AS SHOWN BY MAP OR PLAT OF
RECORD IN VOL. A PAGE 48, MAP RECORDS OF NUECES COUNTY,
TEXAS, SAID TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED
BY METES AND BOUNDS AS FOLLOWS:
BEGINNING AT THE MOST NORTHERLY NORTHEAST CORNER OF THAT
CERTAIN TRACT OF LAND CONVEYED TO PERNITAS PARTNERS BY W. L.
BATES OF RECORD IN VOL. 1003 PAGE 444 DEED RECORDS OF NUECES
COUNTY, TEXAS, SAID POINT BEING S. 61' 30, 50" E. 737.24,
FROM THE NORTH CORNER OF SAID LOT 3, SECTION 4, BOHEMIAN
COLONY LANDS.
THENCE S. 61" 301 E. WITH THE NORTHEAST BOUNDARY LINE OF
THE PAUL OCKER TRACT A DISTANCE OF 1500 FEET TO A POINT FOR
A CORNER OF THIS TRACT;
THENCE S. 28° 30, W. A DISTANCE OF 10 FEET TO A POINT FOR
A CORNER OF THIS TRACT;
THENCE N. 61' 30, W. PARALLEL TO AND lO FEET SOUTHEAST OF
THE NORTHEAST BOUNDARY LINE OF SAID PAUL OCKER TRACT A
DISTANCE OF 783 FEET TO A POINT FOR A CORNER OF THIS TRACT;

THE NORTHWEST BOUNDARY LINE OF SAID PAUL OCKER TRACT FOR

SECTION 2. THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND
DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI, WITH THE OWNERS OF THE AFORESAID PARCEL, PAUL F. OCKER
AND WIFE, LILLIE B. OCKER.
SECTION 3. THE NECESSITY TO APPROPRIATE THE SUMS HEREINABOVE
DESCRIBED AND TO AUTHORIZE THE PURCHASE OF PARCEL FOR LEXINGTON CENTER SANITARY
SEWER MAIN AND LIFT STATION SITE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI-
NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND
NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND
THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT
IS ACCORDINGLY SO ORDAINED, THIS THE __L DAY OF JUNE, 1966.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
