PRESENT: Mayor Luther Jones Mayor Pro Tem Betty N. Turner Council Members Jack K. Dumphy Bob Gulley Herbert L. Hawkins Dr. Charles W. Read Mayor Luther Jones called the meeting to order in the Council Chamber of City Hall and stated that the purpose of the meeting was to conduct public hear- ings on four zoning applications. Mayor Jones commended Mr. Larry Wenger, Director of Planning, for his selection by the West German Government to participate in a study in that country on planning. Mr. Wenger explained that he would be studying with a group of seven City planners from the United States for several weeks. Assistant City Manager Tom Utter announced the public hearing on Application No. 782-2, San D. Ventures, Inc., for a change of zoning from "B-2" Bayfront Business District to "A-2" Apartment House District on Lot 15, Block 191, Padre Island -Corpus Christi, Section 4, located on the south side of Cruiser Street, at the intersection of Padre Island Drive and Cruiser Street on Padre Island. Mr. Utter informed the Council that the Planning Commission recommends denial but in lieu thereof that a special permit be granted for a condominium project with landscaping along Padre Island Drive and between Cruiser Street and the parking area. He stated that the Planning Staff recommends denial since the Planning Commission and City Council have agreed that this area should be identified as "B-2" Bayfront Business District with certain requirements per- taining to parking and setbacks. Mr. Utter continued by stating that 25 notices of the public hearing were mailed, and 3 in favor and 0 in opposition were returned. Mr. Utter also stated that since an approved site plan has been submitted, MICROFILMED up 1 a. No one spoke in regard to this zoning application. A motion was made by Mayor Pro Tem Turner that the hearing be closed, seconded by Council Member Zarsky and passed unanimously. A motion was made by Mayor Pro Tem Turner that the Council concur with the recommendation of the Planning Commission and deny the requested zoning of "A-2" but in lieu thereof grant a Special Permit according to the site plan submitted for a condominium project; seconded by Council Member Gulley; and passed unanimously. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Assistant City Manager Utter announced the public hearing on Application No. 782-8, Turner Landscape, Inc., for a change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on the south 3/4 of Lot 16 and the north 1/4 of Lot 17, Block 7, Woodlawn Estates, located on the east side of Woodlawn Drive approximately 225' south of South Padre Island Drive. Mr. Utter stated that the Planning Commission and the Planning Staff recommend denial but in lieu thereof that a special permit be granted with the provision of no access for commercial use to Woodlawn Drive, screening the surrounding residential area from the commercial use and prohibiting the com- mercial use to retail sales and storage of plant material, plus the continued use of the one -family house on the remaining lot area. He also informed the Council that 18 notices of the public hearing had been mailed; 4 in favor and 4 in opposition had been returned, which was sufficient to invoke the 20% rule. Mr. Wenger provided a complete description of the 20% rule and how it is determined, noting that when it is in effect, 6 affirmative votes of the Council are required to approve a zoning change. Mr. Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the applicant plans to convert the tract for a container display area. He stated that there is a parking problem at Turner Landscape Company; they plan to lease • Minutes Special Council Meeting August 18, 1982 Page 3 the property and allow the existing house to remain occupied; they would have to construct a screening fence; and the only access would be through the Turner property from South Padre Island Drive rather than from Woodlawn Street. Mr. Wenger completed his presentation by stating that the applicant concurs with the terms of the Special Permit. No one spoke in regard to this zoning case. A motion was made by Mayor Pro Tem Turner that the hearing be closed, seconded by Council Member Kennedy and passed unanimously. A motion was made by Mayor Pro Tem Turner that the requested zoning of "B-4" be denied but in lieu thereof that a Special Permit be approved according to the approved site plan; seconded by Council Member Gulley; and passed unani- mously. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Assistant City Manager Utter announced the public hearing on Application No. 782-9, Mr. Vernon E. Crawford, for a change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on Lot 1, Block 1506, Port Aransas Cliffs, located on the southwest corner of 17th and Naples Street. Mr. Utter informed the Council that both the Planning Commission and the Planning Staff recommend approval; 12 notices of the public hearing were mailed; and 1 in favor, 2 in opposition, and 1 in opposition from outside the area of notification were returned. No one spoke in regard to this zoning application. A motion was made by Mayor Pro Tem Turner that the hearing be closed, seconded by Council Member Gulley and passed unanimously. A motion was made by Council Member Dumphy that the Council concur with the recommendation of the Planning Commission and grant the zoning of "B-1" on Application No. 782-9; seconded by Mayor Pro Tem Turner; and passed unanimously. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Assistant City Manager Utter announced the public hearing on Application No. 782-10, Nueces Development Company, for a change of zoning from "R -IB" One - family Dwelling District to "R-2" Multiple Dwelling District being 5.657t acres out of Farrell J. Smith's 225-20 acre tract located along the south bank of the Nueces River east of Hazel Bazemore County Park. Minutes Special Council Meeting August 18, 1982 Page 4 Mr. Utter explained that the Planning Commission recommends approval and the Planning Staff recommends denial but in lieu thereof, that a special permit be granted to allow townhouses but restricted to a density of 9.68 units per acre. He also stated that 2 notices of the public hearing had been mailed; 1 in favor, 0 in opposition, noting that the one in favor was outside the 200' area of notifi- cation, had been returned. Mr. Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the owner plans a townhouse project on this site. Council Member Kennedy inquired about the difference in density in that requested and that which the staff recommends. Mr. Wenger replied that the density in the zoning requested is 14 units per acre, and the staff recommends that the units per acre be limited to 9.68. He explained that the reason for recommending the lower density is because it is adjacent to a large area of single-family dwellings. Mayor Jones invited the applicant or his representative to speak. Mr. Dana Bennett, 505 DeForrest, appeared on behalf of the applicant and stated that the subdivision in question is River Canyon; they have already developed lots in the subdivision; this is the back portion of the subdivision; and they would like to construct townhouses along the river. He explained that in the new phase of the second unit of their subdivision, they have collector streets included in the plans which will provide access. Mr. Bennett also informed the Council that there is a Central Power E Light Company line extend- ing at the back of this property and they will be unable to utilize all of the property for the planned use; therefore, the density will not be as great as the 14 units per acre allowed by the ordinance. He urged the Council to grant the requested zoning of "R-2". Council Member Zarsky asked Mr. Bennett what assurance the City has that the collector streets will actually be constructed, and Mr. Bennett replied that the preliminary plat shows the collector streets. Mr. Wenger pointed out that the zoning requested would require a 60' street. Council Member Zarsky inquired if an agreement could be required that the street will actually be constructed. Minutes Special Council Meeting August 18, 1982 Page 5 Mr. Bennett suggested that approval of the zoning change could be contin- gent upon the approval of the plat for the second phase of this subdivision. A motion was made by Mayor Pro Tem Turner that the hearing be closed, seconded by Council Member Zarsky and passed unanimously. A motion was made by Council Member Dumphy that the Council concur with the recommendation of the Planning Commission and grant the zoning of "R-2" on Application No. 782-10; seconded by Council Member Gulley; and passed unanimously. Acting Assistant City Secretary Dorothy Zahn polled the Council for their votes on the ordinances effecting the foregoing zoning changes, and the following ordinances were approved. ORDINANCE NO. 17212: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF SAN D VENTURES, INC. BY GRANTING A SPECIAL COUNCIL PERMIT FOR A CONDOMIUM PROJECT ON LOT 15, BLOCK 191, PADRE ISLAND - CORPUS CHRISTI, SECTION 4, AS MORE PARTICULARLY DESCRIBED ON THE SITE PLAN; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye."_ ORDINANCE NO. 17213: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF TURNER LANDSCAPE, INC., BY GRANTING A SPECIAL COUNCIL PERMIT TO SET FORTH PROVISIONS FOR CONSTRUCING A DISPLAY AREA ON PORTIONS OF LOT 16 AND LOT 17, BLOCK 7, WOODLAWN ESTATES, AS MG1hE PARTI- CULARLY DESCRIBED ON THE SITE PLAN; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye." ORDINANCE N0. 17214: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF VERNON E. CRAWFORD BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 1, BLOCK 1506, PORT ARANSAS CLIFFS FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye." ORDINANCE NO. 17215: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NUECES INVESTMENT COMPANY BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF FARRELL J. SMITH 225,20 ACRE TRACT FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following voted Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye." There being no further business to come before the Council, on motion by Mayor Pro Tem Turner, seconded by Council Member Kennedy and passed unanimously, The Special Council Meeting was adjourned at 4:16 p.m.,August 18, 1982.
