HomeMy WebLinkAbout08066 ORD - 06/22/1966BJw:6/21/66 AN ORDINANCE / APPROPRIATING OUT OF NO. 220 STREET BOND IMPROVEMENT FUND THE SUM OF $291,500.00 FOR THE ACQUISITION OF 9 PARCELS OF PROPERTY FOR RIGHT OF WAY REQUIRED BY THE STATE OF TEXAS AND APPLICABLE TO PROJECT NO. 220-5b-24.3, CROSSTOWN EXPRESSWAY, HIGHWAY 1286 RELOCATED, A COPY OF WHICH PARCEL LIST IS ATTACHED HERETO AND MADE A PART HEREOF; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, FOR THE ACQUISITION OF SAID PARCELS, WHEN AND ONLY WHEN THE PURCHASE PRICE IS WITHIN THE "APPROVED VALUE" AS DETERMINED BY THE STATE; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL HAS PREVIOUSLY AUTHORIZED THE CITY MANAGER TO ENTER INTO A CONTRACT WITH THE HIGHWAY DEPARTMENT OF THE STATE OF TEXAS WHEREBY THE CITY AGREED TO PURCHASE THE NECESSARY RIGHT OF WAY FOR STATE HIGHWAY N0. 286, RELOCATED COMMONLY KNOWN AS THE CROSSTOWN EXPRESSWAY, AND THE STATE OF TEXAS, ACTING BY AND THROUGH ITS HIGHWAY DEPARTMENT, AGREED TO DETERMINE EACH PARTICULAR PARCEL OR TRACT OF LAND TO BE ACQUIRED AND TO APPRAISE SAID LAND, TO SET AN "APPROVED VALUE" UPON EACH OF SAID TRACTS AND TO REIMBURSE THE CITY FOR ONE -HALF OF THE COST THEREOF; AND WHEREAS, IT IS NECESSARY TO AUTHORIZE THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS FOR THE PURCHASE OF THE NECESSARY TRACTS OR PARCELS OF LAND, AS DESIGNATED BY THE STATE OF TEXAS, BY AND THROUGH ITS HIGHWAY DEPARTMENT, AND TO APPROPRIATE THE NECESSARY FUNDS FOR THE ACQUISI- TION THEREOF: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY APPROPRIATED THE SUM OF $291,500.00 FROM STREET BOND IMPROVEMENT FUND No. 220 FOR THE ACQUISITION OF NINE (9) PARCELS OF PROPERTY FOR RIGHT OF WAY REQUIRED BY THE STATE OF TEXAS FOR THE CROSSTOWN EXPRESSWAY, HIGHWAY 286 RELOCATED, PROJECT No. 220 -56 -24.3, A COPY OF WHICH PROPERTY LIST IS ATTACHED HERETO AND MADE A PART HEREOF. IT BEING THE INTENTION OF THE COUNCIL TO APPROPRIATE FUNDS TO COVER THE AFOREMENTIONED PURCHASES, BUT IT I'S THE INTENTION OF THE COUNCIL TO SEEK SOS REIMBURSEMENT OF THE STATE OF 'TEXAS, FOR ONE -HALF OF THE PURCHASE PRICE OF EACH TRACT OR PARCEL PURCHASED, FROM THE HIGHWAY DEPARTMENT OF THE STATE OF TEXAS. SECTION Z. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, REAL ESTATE SALES CONTRACTS WITH THE OWNERS OF THOSE PARCELS OR TRACTS OF LAND DESIGNATED BY THE TEXAS HIGHWAY DEPARTMENT AS NEEDED FOR STATE HIGHWAY N0. 286 RELOCATED, THE CROSSTOWN EXPRESSWAY, WHEN AND ONLY WHEN THE PARCEL OR TRACT HAS BEEN DESIGNATED BY THE STATE HIGHWAY DEPARTMENT AS NEEDED FOR SAID PROJECT, AND WHEN THE SALES CONTRACT IS FOR AN AMOUNT OF MONEY WITHIN THE "APPROVED VALUE" AS SET AND DETERMINED BY THE STATE HIGHWAY DEPARTMENT. SECTION 3. THE PUBLIC IMPORTANCE OF MAKING FUNDS AVAILABLE AND IN PURCHASING OF THE NECESSARY RIGHT OF WAY $O THAT THE STATE HIGHWAY DEPARTMENT N0. 286 RELOCATED, CROSSTOWN EXPRESSWAY PROJECT MAY CONTINUE WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE A 4 DAY OF JUNE, 1966.
