SAN ORDINANCE
TEMPORARILY CLOSING THAT PORTION OF ROSCHER ROAD WHICH
FORMS THE EAST BOUNDARY OF LOT 2, SECTION 37, FLOUR
BLUFF AND ENCINAL FARM AND GARDEN TRACTS, IN THE CITY
OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE
SANE BEING REOPENED AT ANY TINE BY THE CITY COUNCIL; AND
DECLARING AN EMERGENCY.
WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CON-
CERNING THE CLOSING OF A PORTION OF ROSCHER ROAD WAS GIVEN BY PUBLICATION
AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES O1FI THE OWNERS OF PROPERTY
ABUTTING SAID PORTION OF ROSCHER ROAD AND WITHIN 450 FEET OF THE AREA TO BE
CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT
REGULAR COUNCIL MEETING BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, ON JUNE 22, 1966, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY
CHARTER; AND
WHEREAS, IT HAS BEEN DETERMINED THAT IT WILL BE TO THE ADVANTAGE
OF THE CITY TO TEMPORARILY CLOSE AS A PUBLIC STREET THE PORTION OF ROSCHER
ROAD WHICH FORMS THE EAST BOUNDARY OF LOT 2, SECTION 37, FLOUR BLUFF AND
ENCINAL FARM AND GARDEN TRACTS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY,
TEXAS, SO THAT THE SAME MAY BE TEMPORARILY USED BY THE ABUTTING PROPERTY
OWNERS FOR OTHER PURPOSES; CONDITIONED, HOWEVER, ON THE PROVISION THAT THE
SAME MAY BE REOPENED AT ANY TIME BY THE CITY COUNCIL:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THERE IS HEREBY TEMPORARILY CLOSED FOR PUBLIC
USE THAT PORTION OF ROSCHER ROAD WHICH FORMS THE EAST BOUNDARY OF LOT 2,
SECTION 37, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, IN THE CITY OF
CORPUS CHRISTI, NUECES COUNTY, TEXAS, PROVIDED, HOWEVER, THAT THE SAME MAY
BE REOPENED AT ANY TIME BY THE CITY COUNCIL.
SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY
WOULD BE BETTER SERVED BY THE CLOSING TEMPORARILY OF THE SAID PORTION OF
ROSCHER ROAD CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION BE

PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST,
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO
ORDAINED, THIS THE 1 3 DAY OF JULY, 1966.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT 15 INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
