AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CON-
TRACT WITH FISHER AND WINFIELD FOR CONSTRUCTION OF THE
LAWNDALE AREA STORM SEWERS, PROJECT NO. 295- 64 -43;
APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND THE
SUM OF $39,000.00, OF WHICH AMOUNT $36,177.16 IS FOR THE
CONSTRUCTION CONTRACT AND $2,822.84 IS FOR CONTINGENCIES,
INCLUDING ENGINEERING, LABORATORY TESTING AND LEGAL ADVER-
TISING COSTS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A
CONTRACT WITH FISHER AND WINFIELD FOR CONSTRUCTION OF THE LAWNDALE AREA
STORM SEWERS, DESIGNATED AS PROJECT N0. 295- 64 -43, SAID CONSTRUCTION TO CON-
SIST OF INSTALLATION OF APPROXIMATELY 2100 FEET OF 15" TO 27" R. C. PIPE AND
1590 FEET OF C.G.M. PIPE AND APPURTENANCES IN BLEVINS, DAYTONA, MIAMI,

MARYLAND AND DEVON STREETS NEAR SOUTH STAPLES STREET, ALL AS MORE FULLY SET
OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE
OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY
REFERENCE, AND ACCORDING TO THE BID OF FISHER AND WINFIELD OPENED ON THE 27TH
DAY OF JULY, 1966, THE SAID BID OF FISHER AND WINFIELD BEING THE LOWEST AND
MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 295 STORM
SEWER BOND FUND THE SUM OF $39,000.00, OF WHICH AMOUNT $36,177.16 IS FOR THE
CONSTRUCTION CONTRACT AND $2,822.84 IS FOR CONTINGENCIES, INCLUDING ENGINEER-
ING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE
AFOREMENTIONED CONTRACT AND THE APPROPRIATION OF THE NECESSARY FUNDS TO
PROVIDE DRAINAGE IN AN AREA PRESENTLY WITHOUT ADEQUATE FACILITIES CREATES
A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION-SHALL

BE READ AT THREE SEVERAL MEETINGS OF,THE CITY COUNCIL, AND THE MAYOR, HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH
CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT
FROM AND AFTER ITS PASSAGE, IT,IS,ACCORDINGLY SO ORDAINED, THIS THE
DAY OF AUGUST, 1966.

CORPUS CHRISTI TO THE CREDIT OF N0. 295 Storm Sewer Bond Fund,
$39,000, Project No. 295- 64 -43.
FUND FROM WHICH IT IS PROPOSED TO BE DRAWN, AND SUCH MONEY IS NOT
APPROPRIATED FOR ANY OTHER PURPOSE.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT 15 INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
