AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
A CONTRACT WITH HUMBLE OIL & REFINING CO. FOR THE
EXTENSION Oj- A SEWER LINE FROM EXISTING 42 -INCH LINE
TO LOTS A AND B OF WILKEY ADDITION UNIT 11, FOR THE
SUM OF $4,318.50 WITH THE CITY TO BEAR THE BALANCE OF
THE COST OF AN 8 -INCH LINE AS ITS SHARE FOR THIS EX-+
TENSION, ALL AS MORE FULLY SET FORTH IN THE CONTRACT,
A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF; PROVIDING FOR THE RIGHT OF REIMBURSEMENT IN
SAID CONTRACT; AUTHORIZING THE CONSTRUCTION OF SAID
LINE WITH CITY FORCES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AN AGREEMENT WITH THE HUMBLE OIL & REFINING CO. FOR THE EXTENSION OF A SEWER
LINE TO SERVE LOTS A AND B, WILKEY ADDITION, UNIT II, STARTING FROM EXIST-
/
ING 42 -INCH LINE TO SAID LOTS A AND B, FOR THE SUM OF $4,318.50, WITH THE
CITY TO BEAR THE BALANCE OF THE COST OF X48-INCH LINE AS ITS SHARE FOR'
SUCH EXTENSION, ALL IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE CON-
TRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. AUTHORIZATION IS HEREBY GIVEN TO MAKE REIMBURSEMENT
TO THE HUMBLE OIL & REFINING CO. IF, AS, AND WHEN A FRONT FOOT CHARGE IS
MADE FOR CONNECTION TO THE AFORESAID SEWER LINE FOR SERVICE OF LAND ABUTTING
ON WILLIAMS DRIVE.
SECTION 3. THAT INSTALLATION OF THE SEWER LINE TO SERVE LOTS A
AND B, WILKEY ADDITION, UNIT II FROM EXISTING 42 -INCH TO SAID LOT, BE DONE
BY CITY FORCES.
SECTION 4. THE NECESSITY TO ENTER INTO THE AFORESAID AGREEMENT
SO THAT CONSTRUCTION MAY BE BEGUN ON THE SEWER LINE WITHOUT DELAY CREATES
A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUS-
PENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLU-
TION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING

REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO

IN ACCORDANCE WITH THE TERMS OF THE PLATTING ORDINANCE OF THE
CITY OF CORPUS CHRISTI, THE CITY AGREES TO COMMENCE CONSTRUCTION AND UPON
PAYMENT OF THE SUM OF $4,318.50, TO COMPLETE CONSTRUCTION OF AN $-INCH
SEWER LINE EXTENDING FROM THE EXISTING k2 ..INCN LINE TO LOTS A AND B OF
WILKEY ADDITION UNIT 11, AS SHOWN ON EXHIBIT "A" ATTACHED HERETO, IN ORDER
TO FURNISH SEWER SERVICE TO LOTS A AND B, WILKEY ADDITION UNIT 11.

THE CITY WILL REIMBURSE THE HUMBLE OIL & REFINING COMPANY IF,
AS, AND WHEN A FRONT FOOT CHARGE IS MADE FOR CONNECTION TO SAID LINE FOR '
THE SERVICE OF LAND ABUTTING ON SAID SEWER LINE WITHIN SAID AREA.WITH SAID -
CHARGE FROM WHICH REIMBURSEMENT WILL BE MADE BEING AT THE RATE OF $2.00 PER
FRONT FOOT OM LAND ABUTTING AND FRONTING ON WILLIAMS DRIVE.
III.,
THE PERIOD OF REIMBURSEMENT SHALL BE 10 YEARS FROM THE DATE OF
THE EXECUTION HEREOF AND SUCH SUMS AS NAVE NOT BEEN REIMBURSED SY THAT DATE
WILL BE CONSIDERED AS PART OF THE COST TO HUMBLE OIL & REFINING COMPANY
FOR THE INSTALLATION OF SAID LINE AND SHALL NOT BE SUBJECT TO FURTHER
REIMBURSEMENT.
IV.
THE INSTALLATION OF SAID PIPELINE SHALL NOT RELIEVE HUMBLE OIL &
REFINING COMPANY NOR ANY OTHER PARTY FROM BEING SUBJECT TO TAP'CHARGES AS
13 PROVIDED BY THE CITY ORDINANCE FOR TAP CHARGES FOR SEWER SERVICE.
IT 1S AGREED BY ALL PARTIES THAT SAID LINES SHALL BE THE PROPERTY
OF THE CITY AND PART OF THE CITY SEWER SYSTEM.` �' ' '

Dear Sir:
On January 31, 1964 a plat prepared by McClendon & Associates was filed for
approval with the City of Corpus Christi on subject property. The plat was
approved by the City and filed for record March 30, 1964 in Volume 27, 'Page
94, Map Records, Nueces County, Texas.
It is our understanding that the City of Corpus Christi usually requires all
utilities, including sewer lines, be made available to serve the property
when the plat is approved. Our survey, which was prepared by McClendon &
Associates on March 24, 1964, shows a sewer line along the east side of Airline
extending all the way to Lexington. However, the survey carries the notation:
"Utility information from City Engineering Department. Exact location of
water, gas and sewer lines to be determined in the field."
We are unable to locate a sewer line and apparently none is there. A check by
our Engineer, Mr. J. M. Jongeward, with Mr. Allison of the Sewer Department,
indicates there is none. There is a small line serving Sundeen Junior High
School which is too shallow for us to tie onto. It does not extend to Lexington
but rather from the 42" trunk main beyond Thompson Road.
Mr. Allison indicated it would probably be necessary to extend the line from
the 42" trunk main, which is approximately 780' south of the center line of
Thompson Road or approximately 1780' from the southeast property corner of
Lot A.
It is our understanding that where property is already platted that the City
of Corpus Christi will extend sewer line service to the property based on a
charge of $2.00 per front foot of property. Lots A and B have a total frontage
on Airline of 768.17 feet. We need sewer line service to Lot A as we now have
a service station under construction at this location.

Septic tank and drain field systems have proved unsatisfactory in this area
according to Mr. Wilcox, owner of Wilcox Furniture, whose property abuts
Lot A on Lexington Boulevard. In this connection, Mr. Wilcox indicated that
he also would like to secure City sewer service to his place of business
and would be willing to participate in the cost. -
Please let us know the approximate cost to Humble for extending the sewer
line to this property.
