AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A
CONTRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF
TJ NAVIGATION BOULEVARD IMPROVEMENTS, PROJECT NO.
220- 64 -63; APPROPRIATING OUT OF NO. 220 STREET BOND FUND
THE SUM OF $135,000, OF WHICH AMOUNT $122,750.35 IS FOR
THE CONSTRUCTION CONTRACT AND $12,249.65 IS FOR CONTIN-
GENCIES, INCLUDING ENGINEERING, LABORATORY TESTING,
LEGAL ADVERTISING COSTS AND EXPERT WITNESS FEE; AND DE-
CLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1 THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED

AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A CONTRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF STREET IMPROVEMENTS
ON NAVIGATION BOULEVARD FROM HIGHWAY NO. 9 TO UPRIVER ROAD, DESIGNATED AS
PROJECT,NO. 22o- 64 -63, SAID IMPROVEMENTS TO CONSIST OF STREET WIDENING TO

44 FEET, EXCAVATIONS, LIME STABILIZED BASE, HOT -MIX ASPHALT SURFACE, DRIVE-
WAYS, STORM SEWERS AND APPURTENANCES, ALL AS MORE FULLY SET OUT IN THE
PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF
THE CITY SECRETARY, ALL 'OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND
ACCORDING TO THE BID, OF HELDENFELS BROTHERS OPENED ON THE 20TH DAY OF JULY,
1966, THE SAID BID OF HELDENFELS BROTHERS BEING THE LOWEST AND MOST ADVAN-
TAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 220 STREET
BOND FUND THE SUM OF $135,000, OF WHICH AMOUNT $122,750.35 IS FOR THE
CONSTRUCTION CONTRACT AND $12,249.65 IS FOR CONTINGENCIES, INCLUDING

ENGINEERING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE
AFOREMENTIONED CONTRACT AND THE APPROPRIATION OF THE NECESSARY FUNDS TO
CONSTRUCT THE ABOVE DESCRIBED STREET IMPROVEMENTS IN ORDER TO PROVIDE A
MORE MODERN TRAFFIC FACILITY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE

PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
• ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO-
• RUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE

SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH
EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF
THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER IT PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE T DAY

THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
