AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CON-
TRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF THE
SCHANEN AREA DRAINAGE SYSTEM, UNIT II, DESIGNATED AS
PROJECT NO. 295- 64 -37; APPROPRIATING OUT OF NO. 295
STORM SEWER BOND FUND THE SUM OF $159,000, OF WHICH
AMOUNT $157,484.80 IS FOR THE CONSTRUCTION CONTRACT AND
$1,515.20 IS FOR CONTINGENCIES, INCLUDING ENGINEERING,
LABORATORY TESTING AND LEGAL ADVERTISING COSTS; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A
CONTRACT WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF THE SCHANEN AREA DRAINAGE
SYSTEM, DESIGNATED AS PROJECT No. 295- 64 -37, SAID CONSTRUCTION TO CONSIST OF
APPROXIMATELY 123,000 C.Y. OF CHANNEL EXCAVATIONS AND MULTIPLE BOX CULVERT
OF 4, 81 X 8.5' X 681 LONG, HEADWALLS, AND INSTALLATION OF 452' OF 21" AND
42" R.C. PIPE AND 585` OF C.G.M. PIPE BETWEEN FLYNN PARKWAY AND A POINT SOUTH
OF SARATOGA FOR A DISTANCE OF 5400 MIDWAY BETWEEN WEBER AND EVERHART ROADS,
ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCU-
MENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A
PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF HELDENFELS BROTHERS
OPENED ON THE 31ST DAY OF AUGUST, 1966, THE SAID BID OF HELDENFELS BROTHERS
BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 295 STORM
SEWER BOND FUND THE SUM OF $159,000, OF WHICH AMOUNT $157,484.80 IS FOR THE
CONSTRUCTION CONTRACT AND $1,515.20 IS FOR CONTINGENCIES, INCLUDING ENGINEER-
ING, LABORATORY TESTING AND LEGAL ADVERTISING COSTS.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE AFORE-
MENTIONED CONTRACT AND THE APPROPRIATION OF THE NECESSARY FUNDS TO PROVIDE
DRAINAGE IN AN AREA PRESENTLY WITHOUT ADEQUATE FACILITIES CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON

THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE
READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH
CHARTER BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE T" DAY OF
