AN ORDINANCE
CLOSING A PORTION OF BICKHAM ROAD AND NORTH BICKHAM
ROAD EXCEPT THAT PORTION LYING BETWEEN LOTS 1 AND 2
OF BLOCK 1, LOT 4 OF BLOCK 2, AND LOT ' OF BLOCK ,
HEARN ADDITION, NUECES COUNTY, TEXAS; AND DECLARING
AN EMERGENCY.
WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING
CONCERNING THE CLOSING OF A PORTION OF BICKHAM ROAD AND NORTH BICKHAM
ROAD, MORE FULLY DESCRIBED HEREINAFTER, WAS GIVEN BY PUBLICATION AND
REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY
ABUTTING SAID PORTION OF BICKHAM ROAD AND NORTH BICKHAM ROAD AND WITHIN
450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE,
PUBLIC HEARING WAS HELD AT REGULAR COUNCIL MEETING BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS, ON SEPTEMBER 28, 1966, IN ACCORDANCE
WITH THE PROVISIONS OF THE CITY CHARTER; AND
WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING
THAT THE PORTION OF BICKHAM ROAD AND NORTH BICKHAM ROAD WITHIN THE HEARN
ADDITION PROPOSED TO BE ABANDONED ARE NOT NEEDED NOW, NOR WILL THEY BE '
WITHIN THE FORESEEABLE FUTURE NEEDED AS PUBLIC STREET; AND
WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF
THE CITY TO ABANDON THE PORTION OF BICKHAM ROAD AND NORTH BICKHAM ROAD
HEREINAFTER OUTLINED AS PUBLIC STREETS SO THAT THE SAME MAY BE USED FOR
OTHER PURPOSES BY THE ABUTTING PROPERTY OWNERS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THAT PORTION OF BICKHAM ROAD AND NORTH BICKHAM
ROAD, DESCRIBED AS FOLLOWS, BE AND THE SAME ARE HEREBY CLOSED FOR PUBLIC
USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY:
ALL OF BICKHAM ROAD AND NORTH BICKHAM ROAD AS SAME APPEAR
IN MAP OR PLAT DATED MARCH 7, 1955, AND RECORDED IN VOLUME
17, AT PAGE 45, OF THE MAP RECORDS OF NUECES COUNTY, TEXAS,
TO WHICH RECORDS REFERENCE IS HERE MADE FOR ALL PURPOSES,
SAVE AND EXCEPT THE FOLLOWING DESCRIBED PORTIONS OF SUCH
ROADS, TO -WIT: THAT PORTION OF BICKHAM ROAD LYING BETWEEN
LOTS 1 AND 2 OF BLOCK 1, LOT 4 OF BLOCK 2, AND LOT 5 OF
BLOCK Y, HEARN ADDITION, NUECES COUNTY, TEXAS.

SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY
WOULD BE BETTER SERVED BY THE CLOSING OF THE SAID PORTION OF SAID STREETS
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR,
HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED
THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SOCRDAINED, THIS THE
DAY OF OCTOBER, 1966.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
