SPECIAL COUNCIL MEETING
OCTOBER 27, 1982

Mayor Luther Jones called the meeting to order in the
Council Chamber of City Hall and stated that the purpose of the
meeting was to conduct public hearings on four zoning
applications.
City Secretary Bill G. Read verified that the necessary
quorum of the Council and the required Charter Officers were
present to conduct a legally constituted meeting.
Assistant City Manager Tom Utter announced the public
hearing on Application No. 982-9T, Amendment to the Zoning
Ordinance: Amend Article 31, Newly Annexed Territory, by
amending Section 31-5 by adding thereto one new subsection to be
numbered 31-5.41 setting forth zoning classifications of "AB"
Professional Office District and "A-2" Apartment House District
on a tract of land when anneed to the City of Corpus Christi,
Texas, located on the west side of Everhart Road, approximately
500 feet south of Delwood Street, being 27.04± acres out of Lots
1, 2, 15 and 16, Section 6, Flour Bluff and Encinal Farm and
Garden Tracts.
Mr. Utter stated that this is outside the City limits at
this time and the applicants are J. R. Builders, Inc. and E. H.
Moore Homes, Inc. and the request is to prezone the tract prior
to annexation. He stated that the Planning Commission recommends
approval and the Planning Staff recommends denial.

Mr. Gary Dumas located the area on the zoning and land use
map, described the land use in the surrounding area, noting that
it is mostly vacant land with a number of townhouses under
construction, and showed slides of the area. Mr. Dumas explained
that the Planning Staff feels that since this area is 1,000 feet
from the intersection of Yorktown and Everhart, it is too far
away for this type of zoning.
* Mayor Pro Tem Betty Turner arrived at the meeting at 3:16
p.m.
Mr. Dumas continued his explanation by stating that the
tract consists of 27 acres and the Staff was of the opinion that
uses other than "R -1B" could be recommended, but they feel that
"A-2" is inappropriate because of the distance from the major
intersection.
Council Member Dumphy expressed the opinion that the traffic
would not be a problem, particularly if Cedar Pass Road is
improved and extended. He pointed out that there are going to be
a lot of residential use and apartments constructed in this area.
Mr. Utter agreed that if Yorktown Boulevard were improved,
it would provide a solution to the traffic problem but pointed
out that there are no plans for this extension at this time.
Council Member Dumphy pointed out that there is already a
problem with traffic in that area but opening and extending Cedar
Pass would help the problem. He urged expediency on the part of
the Staff to devise some method of doing this.
Mr. Utter stated that the Master Transportation Plan could
be changed but the entire area is not developed yet and there is
no need to do so at this time.
Mayor Pro Tem Turner agreed with Mr. Dumphy and suggested
that the Staff be directed to resolve the problem of excessive
traffic as soon as possible.
Mr. Utter stated that if the Council desires, the Staff
could provide an analysis of that entire area within the next few
weeks. He informed the Council that the Staff is examining the

area because of the fast growth and this will probably increase
with the lower interest rates in effect at this time.
Council Member Dumphy moved that the Staff be directed to
provide an analysis of the situation in that area and the motion
was seconded by Mayor Pro Tem Turner.
Mr. Utter further explained that this area is included in
the Cabaniss Field study area, which is being prepared in the
same fashion as the Flour Bluff Development Plan.
Speaking in regard to this application was Mr. Gene Urban,
Urban Engineers, representing the applicants. He addressed the
traffic question and noted that before the 1979 amendment to the
Master Transportation Plan, Cedar Pass was scheduled to be a
straight road from Everhart Road to Weber but the amendment
envisions turning all of that traffic back to Everhart Road and
this matter has been discussed with the Staff. He stated that
one -mile grid traffic patterns are ideal. Mr. Urban continued by
stating that Mr. Moore and Mr. Ewing have applied for "AB" zoning
on a portion of the land; there will only be approximately 18
acres of ultimate land for actual use; there are 27 acres in the
request; a 120' ditch dedication would be required; Everhart Road
dedication; and a park dedication must be made and all of these
reduce the useable acreage a great deal. He expressed the
opinion that this is good transitional zoning because they go
from "R -1B" to "R-2" to "AB" and then to "A-2". He expressed the
opinion that the Yorktown -Everhart intersection is destined to be
a major shopping location. Mr. Urban also noted that they do not
plan the construction of the apartment units for several years
but they will start with the professional office complex. He
noted that the number of units planned is about 25 units per acre
on 18 acres or a maximum of 500 units. He expressed the opinion
that it will be three years before the units are completed.
Mayor Pro Tem Turner asked Mr. Urban for his opinion of the
traffic problem, and Mr. Urban replied that it would be more
realistic to move the traffic to Weber or Staples rather than
Everhart. He stated that he is the representative for the next

applicant and with the development of that person's land,
Yorktown Road will be extended. He suggested that the Master
Transportation Plan be reexamined.
Mayor Jones expressed the opinion that the traffic problem
was greatly exaggerated.
Also speaking in regard to the request was Mr. Edgar Moore,
one of the applicants. He stated that they are planning to
develop this land; he is concerned about density; but he would be
glad to limit the number of units to 510. He agreed that the
Staff should examine apartment density, but because of economics,
most of the developers have to construct more units than allowed
in "A-1". He stated that Mr. Larry Wenger, Director of Planning,
is working on the traffic problem with the possibility of
extending Cedar Pass to Weber.
Council Member Zarsky suggested the possibility of "A-1"
zoning for this land, but Mr. Moore explained that because of
finances, there is a need to construct as many units as possible.
Council Member Zarsky inquired if a special permit could be
approved for 25 units per acre, and Mr. Utter agreed that this
could be done. He informed the Council that the Staff is
attempting to arrive at a different zoning classification for
apartments because there is too much difference between the
number of units allowed in "A-1" and "A-2". He stated that the
special permit could specify either a maximum of 500 total units
or 24 units per acre.
Mr. Moore stated that he would not like to tie a special
permit to a site plan, and Mr. Utter assured him that the City
did not have to tie it to a site plan.
Mayor Jones suggested that the applicants could just sign an
agreement to limit the number of units per acre, and Mr. Moore
stated that the City had their assurance that they would be glad
to do this. Mayor Jones indicated that Mr. Moore's word was
good.

be closed, seconded by Council Member Hawkins and passed
unanimously.
A motion was made by Council Member Dumphy that the Council
concur with the recommendation of the Planning Commission and
grant the zoning of "AB" and "A-2" on this tract of land;
seconded by Mayor Pro Tem Turner; and passed unanimously.

Assistant City Manager Utter announced the public hearing on
Application No. 982-11T, Amendment to the Zoning Ordinance:
Amend Article 31, Newly Annexed Territory, by amending Section
31-5 by adding thereto one new subsection to be numbered 31-5.42
setting forth a zoning classification of "B-4" General Business
District on a tract of land when annexed to the City of Corpus
Christi, Texas, located on the west side of South Staples Street,
at the intersection of South Staples and Yorktown Boulevard,
being the southwest 60.0± feet of Lots 9, 10, 11, 12, 13 and 14
and the northeat 1/3 of Lots 19, 20, 21, 22, 23, and 24, Section
6, Flour Bluff and Encinal Farm and Garden Tracts.
Mr. Utter explained to the Council that the Planning
Commission recommends that the request be denied and in lieu
thereof that "A-1" Apartment House District be granted on the
west 2,000 feet, "AB" Professional Office District be granted on
the middle 800 feet and "B-4" General Business District be
granted on the remainder of the land. He stated that the Staff
now concurs with that same recommendation. Mr. Utter then
displayed a drawing showing the proposed zoning according to the
Planning Commission.
No one spoke in regard to this application.
A motion was made by Council Member Gulley that the hearing
be closed, seconded by Council Member Dumphy and passed
unanimously.
A motion was made by Council Member Gulley that the Council
concur with the Planning Commission recommendation as listed
above, seconded by Council Member Dumphy and passed unanimously.

Mayor Pro Tem Turner suggested that a Workshop Meeting be
scheduled regarding the Transportation Plan and the apartment
zoning in that area.
Mr. Utter assured the Council that the Staff plans to
present that information in three or four weeks.
Mr. Dumas pointed out that the Staff is considering Cedar
Pass, not as a collector street, but as a street to provide
circulation within the area.

Mr. Utter announced the public hearing on Application No.
C982-12, City of Corpus Christi, to amend the zoning ordinance by
changing the zoning on the west 1/2 of Block 70 and Lots 2
through 12, Block 61, Beach Addition from "B-5" Primary Business
District to "H -C" Historical -Cultural Landmark Preservation.
Mr. Dumas displayed a map showing the area.
Mayor Jones ascertained that no one in the audience wished
to speak on this application.
A motion was made by Mayor Pro Tem Turner that the hearing
be closed, seconded by Council Member Gulley and passed
unanimously.
A motion was made by Mayor Pro Tem Turner that the Council
concur with the recommendation of the Planning Commission and
grant the zoning of "H -C" on Application No. C982-12; seconded by
Council Member Hawkins; and passed unanimously.

Assistant City Manager Utter announced the public hearing on
the proposal to amend the zoning ordinance to allow the temporary
placement of a mobile home or travel trailer on an emergency
basis. He explained that the Planning Commission recommends
approval and the amendment would allow Building Officials to
issue permits under special conditions when a residence has been
partially destroyed.
Mayor Jones inquired about how this compares with the
procedure in other cities in the State.

Mr. Utter explained that most cities have some allowances
under their existing ordinances or some emergency powers for this
type of situation. He stated that the Fire Chief anticipates
that only or two a year will be requested.
A motion was made by Council Member Gulley that the hearing
be closed, seconded by Council Member Dumphy and passed
unanimously.

amendment as explained above be approved, seconded by Council
Member Dumphy and passed unanimously.

City Secretary Read informed the Council that the ordinances
to be considered are the ones granting the zoning on the first,
third and fourth applications, as well as the zoning ordinance
listed on the Regular Council Agenda for granting the zoning on
the application of Mr. Juan J. Villarreal. He polled the Council
for their votes and the following ordinances were passed:
ORDINANCE NO. 17329:
AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 31-5 BY ADDING
THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.41, SETTING FORTH
ZONING CLASSIFICATION ON THE DESCRIBED TRACTS OF LAND, WHEN
ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACTS BEING
DESCRIBED AS 27.04 ACRES OUT OF LOTS 1, 2, 15 AND 16, SECTION 6,
FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND
DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance passed
by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins,
Kennedy and Zarsky voting, "Aye".
ORDINANCE NO. 17330:
AMENDING THE ZONING ORDINANCE BY AMENDING THE ZONING MAP BY
DESIGNATING THE WEST ONE-HALF OF BLOCK 70 AND LOTS 2 THROUGH 12,
BLOCK 61, BEACH ADDITION, WITH THE HISTORICAL -CULTURAL LANDMARK
DESIGNATION, IN ADDITION TO THE PRESENT ZONING DESIGNATION ON
SIAD PARCELS OR TRACTS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF
THE EXISTING ZONING ORDINANCE AS AMENDED; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance passed
by the following vote: Jones, Turner, Gulley, Dumphy, Hawkins,
Kennedy and Zarsky voting "Aye";

ORDINANCE NO. 17331:
AMENDING THE ZONING ORDINANCE SO AS TO AMEND ARTICLE 33, SECTION
33-1 PERMITS; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance passed
by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins,
Kennedy and Zarsky voting, "Aye".
ORDINANCE NO. 17326:
AMENDING THE ZONING ORDINANCE UPON APPLICATION OF JUAN J.
VILLARREAL BY CHANGING THE ZONING MAP IN REFERENCE TO TRACT 1
BEING A PORTION OF LOT 6, SECTION 13, FLOUR BLUFF AND ENCINAL
FARM AND GARDEN TRACTS FROM "R -1B" ONE -FAMILY DWELLING DISTRICT
TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT; AND DECLARING AN
EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance passed
by the following vote: Jones, Turner, Gulley, Dumphy, Hawkins,
Kennedy and Zarsky voting "Aye".

There being no further business to comer before the Council,
on motion by Mayor Pro Tem Turner, seconded by Council Member
Hawkins and passed unanimously, the Special Council Meeting was
adjourned at 4:05 p.m., October 27, 1982.
