AN ORDINANCE
RELATING TO THE ESTABLISHMENT OF A PUBLIC PARK ON THE
BAYFRONT OF THE CITY OF CORPUS CHRISTI, MAKING A PUBLIC
RECORD OF THE RECEIPT OF THE DEED TO A PORTION OF THE
PROPERTY INCLUDED IN SAID PARK AND COMMITTING THE CITY
TO THE ESTABLISHMENT OF SAID AREA LOCATED ON THE BAYFRONT
FOR USE FOR PUBLIC PARK PURPOSES;AND DECLARING AN EMERGENCY
WHEREAS, THE CITY OF CORPUS CHRISTI, ACTING BY AND THROUGH ITS
MAYOR, CITY COUNCIL, CITY MANAGER, OFFICERS AND EMPLOYEES HAVE BEEN EN-
GAGED IN ESTABLISHING A SCIENCE AND ARTS PARK AND RECREATION CENTER ON
THE BAYFRONT OF THE CITY OF CORPUS CHRISTI NEAR THE CORPUS CHRISTI
NAVIGATION SHIP CHANNEL; AND
WHEREAS, AN AREA CONSISTING OF BLOCKS 93, 94, 95, 104 AND 105,
BEACH PORTION OR ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY,
TEXAS, AND THE STREETS INTERVENING BETWEEN SAID BLOCKS HAS BEEN CONTEM-
PLATED AS A SITE OF APPROXIMATELY 15 ACRES SUITABLE FOR SAID PUBLIC PARK
AND HAS IN PART BEEN ACQUIRED BY THE CITY FOR SUCH PURPOSES; AND
WHEREAS, IT IS THE INTENTION OF THE CITY THAT ALL OF SAID AREA
BE DESIGNATED AS PUBLIC PARK AREA AND ACQUIRED AND USED UNDER AND SUBJECT
TO THE PROVISIONS OF THE CITY CHARTER FOR PUBLIC PARK PURPOSES AND NO
OTHER:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE DEED DATED DECEMBER 21, 1965, FROM THE
FOUNDATION FOR SCIENCES AND ARTS, INC., CONVEYING TO THE CITY, BLOCK 95 AND
THE EAST ONE -HALF OF LOTS 1 AND 2 AND THE WEST ONE -HALF OF LOTS 11 2 AND 3
AND ALL OF LOT 10 IN BLOCK 105, BEACH PORTION OR ADDITION TO THE CITY OF
CORPUS CHRISTI, NUECES COUNTY, TEXAS, AND RECORDED BY THE CITY IN VOLUME
1155, BEGINNING AT PAGE 526, HAS BEEN ACCEPTED BY THE CITY AS A CONVEYANCE
OF SAID PROPERTY AND USE AS PART OF SAID PUBLIC PARK.
SECTION 2. THAT ALL OF SAID AREA OF APPROXIMATELY 15 ACRES,
INCLUDING BLOCKS 93, 94, 95, 104 AND 105, AND STREETS INTERVENING BETWEEN
SAID BLOCKS, BE AND THE SAME IS HEREBY DESIGNATED AS A PUBLIC PARK AS SAID
SITE ON THE BAYFRONT OF THE CITY OF CORPUS CHRISTI.

SECTION 3. THAT THE CITY MANAGER DIRECT PROPER OFFICERS AND
EMPLOYEES OF THE CITY TO PROCEED WITH THE ACQUISITION OF THE BALANCE OF
SAID PROPERTY FOR SUCH CONSIDERATIONS AS ARE APPROVED BY THE CITY COUNCIL.
THAT WHEN ACQUIRED,SAID PROPERTY SHALL BE USED FOR PUBLIC PARK PURPOSES
ONLY, INCLUDING THE CORPUS CHRISTI MUSEUM AND SUCH OTHER BUILDINGS OR
STRUCTURES AS ARE PROPERLY OWNED AND CONTROLLED BY THE CITY FOR THE USE
OF THE PUBLIC AS PROPER USES OF PUBLIC PARK PROPERTY, UNDER SUCH RULES,
REGULATIONS, CONDITIONS AND TERMS AS MAY BE IN KEEPING WITH THE TERMS OF
THE CITY CHARTER. IT IS FURTHER ORDERED THAT, UNTIL OCCUPIED BY BUILDINGS,
THE SAID AREA BE IMPROVED ACCORDING TO PLANS TO BE APPROVED BY THE CITY
COUNCIL FOR USE AS OPEN SPACES, DRIVES, WALKS, .LANDSCAPED AND RECREATION
AREAS BY THE PUBLIC.
SECTION 4. THAT THIS ORDINANCE SHALL CONSTITUTE A COMMITMENT OF
THE CITY TO ACQUIRE AND USE THE DESIGNATED PROPERTY SOLELY FOR PUBLIC PARK
PURPOSES AND A COPY OF THIS ORDINANCE CERTIFIED BY THE CITY SECRETARY MAY
BE USED IN ANY JUDICIAL PROCEEDING TO EVIDENCE SUCH COMMITMENT AND DEDICA-
TION.
SECTION 5. THAT THE NECESSITY FOR THE MAKING OF A PUBLIC RECORD
BINDING ON THE CITY OF THE FACT OF ACCEPTANCE OF THE ABOVE MENTIONED DEED
AND THE DESIGNATION OF THE ABOVE DESCRIBED AREA ON THE CITY BAYFRONT AS A
PUBLIC PARK AND DIRECTING THE CONTINUATION OF THE ACQUISITION OF SAID AREA
FOR PUBLIC PARK PURPOSES CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO
ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO-
DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL
MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH
EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE
BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER.
ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _DAY OF NOVEMBER,
1966.

SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL) I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
