APPROVING AND ADOPTING THE WRITTEN STATEMENT AND
REPORT OF THE DIRECTOR OF PUBLIC WORKS, SHOWING
THE ESTIMATES OF THE TOTAL COSTS OF ALL THE IM-
PROVEMENTS, THE ESTIMATES OF THE COST PER FRONT
FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING
PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF,
FOR THE CONSTRUCTION OF SIDEWALKS ON THE HEREIN-
AFTER NAMED STREETS IN THE CITY OF CORPUS CHRISTI,
TEXAS, TO -WIT:

DETERMINING AND FIXING THE PORTION OF SAID COST AND THE
RATE THEREOF PROPOSED TO BE ASSESSED AGAINST AND PAID BY
THE ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF;
DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST
SAID ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF,
FOR THE PORTION OF SAID COST APPORTIONED TO THEM; ORDERING
AND SETTING A HEARING AT 3 O'CLOCK P.M., ON THE 114TH DAY OF
DECEMBER, 1966, IN THE COUNCIL CHAMBER OF THE CITY HALL OF
CORPUS CHRISTI, TEXAS, AS THE TIME AND PLACE FOR THE HEARING
OF THE REAL AND TRUE OWNERS OF SAID ABUTTING PROPERTY AND
ALL OTHERS INTERESTED IN SAID ABUTTING PROPERTY OR IN ANY
OF THE PROCEEDINGS CONCERNING SAID ASSESSMENTS AND IMPROVE-
MENTS; DIRECTING THE CITY SECRETARY OF THE CITY OF CORPUS
CHRISTI, TEXAS, TO GIVE NOTICE OF SAID HEARING AS REQUIRED
BY LAW; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, HEREBY FINDS AND DETERMINES:
(A) THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
HAS HERETOFORE BY ORDINANCE No. 8235, DULY ENACTED ON THE 9TH DAY OF
NOVEMBER, 1966, DETERMINED THE NECESSITY FOR AND ORDERED THE CONSTRUCTION
OF SIDEWALKS ON THE HEREINAFTER NAMED STREETS IN THE CITY OF CORPUS CHRISTI,
NUECES COUNTY, TEXAS, TO -WIT:

WHICH SAID PLANS AND SPECIFICATIONS HAVE HERETOFORE BEEN APPROVED AND
ADOPTED BY THE CITY COUNCIL.
(B) THAT A NOTICE DULY ENACTED IN THE NAME OF THE CITY OF CORPUS
CHRISTI TEXAS OF THE ENACTMENT OF SAID ABOVE DESCRIBED ORDINANCEp HAS
HERETOFORE BEEN FILED WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS, THE
COUNTY IN WHICH THE CITY OF CORPUS CHRISTI IS SITUATED, AND SUCH NOTICE
HAS BEEN DULY RECORDED IN THE DEED OF TRUST RECORDS OF NUECES COUNTY, TEXAS.
(C) THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
HAS CAUSED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE ESTIMATES OF
THE COSTS OF SUCH IMPROVEMENTS, AND ESTIMATES OF THE AMOUNT PER FRONT FOOT
TO BE ASSESSED AGAINST THE PROPERTY ABUTTING SAID SIDEWALKS; AND THE
DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATE-
MENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCIL, AND THE SAME
HAVING BEEN RECEIVED, EXAMINED AND APPROVED BY SAID CITY COUNCIL; AND
THAT IN ACCORDANCE WITH SAID STATEMENT OF THE ESTIMATE SO FILED BY THE
DIRECTOR OF PUBLIC WORKS AND HEREIN APPROVED, THE AMOUNT OF SAID ESTIMATED
COSTS ARE HEREIN APROVED, THE AMOUNT OF SAID ESTIMATED COSTS ARE HEREIN-
AFTER STATED AND SET OUT AND A SCHEDULE CONTAINED IN SECTION `L HEREOF.

TOTAL COSTS OF THE CONSTRUCTION OF SAID SIDEWALKS, SHOWING THE AMOUNTS PER
FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING PROPERTY AND
AGAINST THE REAL AND TRUE OWNERS THEREOF FOR SAID IMPROVEMENTS, SHOWING
TOTAL ESTIMATED COST OF THE CONSTRUCTION OF SAID SIDEWALKS PROPOSED TO BE
ASSESSED AGAINST AND PAID TO THE CITY OF CORPUS CHRISTI BY THE ABUTTING
PROPERTY AND THE REAL AND TRUE OWNERS THEREOF TO REIMBURSE THE SAID CITY FOR
A PORTION OF THE COSTS OF SAID IMPROVEMENTS AND SHOWING THE TOTAL ESTIMATED
COST OF SAID IMPROVEMENTS HAVING BEEN RECEIVED AND EXAMINED BY THE CITY
COUNCIL SAID REPORT AND THE ESTIMATES THEREIN SHOWN ARE HEREBY IN ALL THINGS
APPROVED AND ADOPTED; AND IT IS HEREBY FOUND AND DETERMINED BY THE SAID
CITY COUNCIL THAT THE ESTIMATED COSTS OF SAID IMPROVEMENTS AS ABOVE DESCRIBED

PRELIMINARY ASSESSMENT ROLL
Summary of Sidewalk Improvements - Unit III
This project, number 220- 64 -66, and designated Unit III, callsfor the
construction of sidewalks along various streets adjacent and leading
to both private and public schools within the City. The streets along
which these sidewalks are to be constructed are as follows:
1. Balboa Street from hidalgo to Pine
2. Mary Street from 20th to South Port
3. Norton and Casa Grande Streets at Casa Linda Park
4. Prescott Street from Crosstown Expressway to Cunningham School
5. Burton Lane from Williams Drive to Cain
6. Antelope and Carancahua Streets at the Post Office
7. McArdle Road from Nile Drive to Zarsky
8. Horne Road from Prescott to Crosstown Expressway
9. Hudson Street from Shaw to Chula Vista School
10. Williams Drive from Staples to Everhart
11. Carroll Lane from McArdle Road 700 feet south toward Padre Island Drive
12. Cain Drive from Burton Lane to South Staples Street

The assessment rate for this project is calculated on the basis of 800
of the unit bid price applied to the calculated quantities for the im-
provements abutting the property, which is 4' wide, 4" thick sidewalk
at $1.53 per linear foot and for extra thickness at $1.49 per linear foot.

SECTION 3. THE COST OF SAID IMPROVEMENTS SHALL BE PAID AS
FOLLOWS, TO -WIT:
(A) THE CITY SHALL REIMBURSE ITSELF FOR NOT MORE THAN 80% OF
THE COST OF THE IMPROVEMENTS BY ASSESSMENT AGAINST THE RESPECTIVE ABUTTING
PROPERTIES AND THE REAL AND TRUE OWNERS THEREOF IN ACCORDANCE WITH THE
PROVISIONS OF SAID ARTICLE 1105B, VERNON'S TEXAS CIVIL STATUTES. NO
ASSESSMENTS SHALL BE MADE AGAINST ANY ABUTTING PROPERTY OR THE REAL AND
TRUE OWNERS THEREOF FOR COSTS IN EXCESS OF THE BENEFITS TO SUCH PROPERTY
IN ENHANCED VALUE THEREOF BY MEANS OF SUCH IMPROVEMENTS. THE AMOUNTS OF
SUCH ASSESSMENTS SHALL CONSTITUTE A FIRST AND PRIOR LIEN UPON ALL SUCH
PROPERTIES AND A PERSONAL LIABILITY OF THE REAL AND TRUE OWNERS THEREOF
WHETHER NAMED OR CORRECTLY NAMED OR NOT. ASSIGNABLE CERTIFICATES IN EVI-
DENCE OF THE ASSESSMENTS SO LEVIED SHALL BE ISSUED IN FAVOR OF THE CITY OF
CORPUS CHRISTI FOR THE AMOUNT OF THE ASSESSMENT. SAID PAYMENTS

NUECES COUNTY, TEXAS, THE FIRST OF WHICH SHALL BE PAYABLE WITHIN THIRTY (30)
DAYS FROM THE DATE OF THE COMPLETION OF SAID IMPROVEMENTS AND THEIR ACCEPTANCE
BY THE CITY OF CORPUS CHRISTIj AND ONE INSTALLMENT EACH MONTH THEREAFTER
UNTIL PAID, WITH INTEREST THEREON AT THE RATE OF FIVE PERCENT (59) PER
ANNUMy PAST DUE PRINCIPAL AND INTEREST TO BEAR INTEREST AT THE SAME RATE.
PROVIDED, HOWEVER THAT THE OWNERS OF ANY OF SAID PROPERTIES SHALL HAVE
THE PRIVILEGE OF PAYING ALL OR ANY OF SAID INSTALLMENTS AT ANY TIME BEFORE
MATURITY THEREOF BY PAYING THE TOTAL AMOUNT OF PRINCIPAL OF SUCH INSTALL-
MENT TOGETHER WITH INTEREST ACCRUED THEREON DOWN TO THE DATE OF PAYMENT.
THE OWNERS OF ANY OF SAID PROPERTY MAY PAY THE TOTAL AMOUNT ASSESSED AGAINST
THEM AND THEIR PROPERTY WITHOUT INTEREST WITHIN THIRTY (30) DAYS AFTER THE
COMPLETION AND ACCEPTANCE OF SAID IMPROVEMENTS. IF DEFAULT BE MADE IN
THE PAYMENT OF ANY OF SAID INSTALLMENTS OF PRINCIPAL OR INTERESTS PROMPTLY
AS IT MATURESy THEN AT THE OPTION OF THE CITY OF CORPUS CHRISTI] OR ITS
ASSIGNS, THE ENTIRE AMOUNT OF THE ASSESSMENT UPON WHICH DEFAULT IS MADE,

AMOUNT TO BE ASSESSED AGAINST EACH PARCEL OF ABUTTING PROPERTY, AND THE
REAL AND TRUE OWNERS THEREOF, AND AS TO THE SPECIAL BENEFITS, IF ANY, TO
SAID PROPERTY TO BE RECEIVED BY SAID IMPROVEMENTS, AND CONCERNING ANY ERROR,
INVALIDITY, IRREGULARITY OR DEFICIENCY IN ANY PROCEEDING OR CONTRACT WITH
REFERENCE THERETO OR CONCERNING ANY MATTER OR THING CONNECTED THEREWITH, WHICH

OR CLAIMING ANY SUCH ABUTTING PROPERTY, OR ANY INTEREST THEREIN, AND THEIR

SOME NEWSPAPER OF GENERAL CIRCULATION IN THE CITY OF CORPUS CHRISTI, TEXAS;
SAID NOTICE SHALL BE PUBLISHED AT LEAST THREE (3) TIMES IN SAID NEWSPAPER
BEFORE THE DATE SET FOR SAID HEARING, THE FIRST OF WHICH PUBLICATION SHALL
BE AT LEAST TEN DAYS PRIOR TO THE DATE OF SAID HEARING, AND SUCH NOTICE
BY PUBLICATION SHALL BE VALID AND SUFFICIENT WITHOUT ANY FURTHER FORM OR
CHARACTER OF NOTICE, AS PROVIDED FOR BY AND IN ACCORDANCE WITH THE TERMS
AND PROVISIONS OF SAID CHAPTER 106 OF THE ACTS OF THE FIRST CALLED SESSION
OF THE 40TH LEGISLATURE OF THE STATE OF TExr., KNOWN AND SHOWN AS ARTICLE
11058, VERNON'S ANNOTATED CIVIL STATUTES OF TEXAS, AS AMENDED. THE CONTENTS
OF SUCH NOTICE OF SAID HEARING, AS REQUIRED BY LAW, SHALL BE FOR ALL PURPOSES

THEREOF FOR THAT PORTION OF THE COSTS OF SAID IMPROVEMENTS HEREINABOVE DETER-
MINED TO BE PAYABLE BY SAID ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS
THEREOF WHICH ASSESSMENTS SHALL BE A FIRST AND PRIOR LIEN UPON SAID ABUTTING
PROPERTY AND A PERSONAL LIABILITY AND CHARGE AGAINST THE REAL AND TRUE OWNERS
THEREOF. IN LEVYING SAID ASSESSMENTS IF THE NAME OF THE OWNER BE UNKNOWN,
IT SHALL BE SUFFICIENT TO SO STATE THE FACTS AND IF SAID ABUTTING PROPERTY
BE OWNED BY AN ESTATE OR BY ANY FIRM OR CORPORATION, IT SHALL BE SUFFICIENT
TO SO STATE THE FACTS AND IT SHALL BE UNNECESSARY TO GIVE THE CORRECT NAME
OF ANY SUCH OWNER AND NO ERROR OR MISTAKE IN ATTEMPTING TO NAME SUCH OWNER OR
IN DESCRIBING ANY OF SAID PROPERTY SHALL INVALIDATE ANY ASSESSMENT OR CERTI-
CATE ISSUED IN EVIDENCE THEREOF; BUT NEVERTHELESS THE REAL AM TRUE OWNERS
OF SAID ABUTTING PROPERTY SHALL BE LIABLE AND THE ASSESSMENT AGAINST SAID
ABUTTING PROPERTY SHALL BE VALID WHETHER OR NOT SUCH OWNER BE NAMED, OR
CORRECTLY NAMED OR SAID PROPERTY CORRECTLY DESCRIBED THEREIN.
SECTION E. EACH PORTION OF SAID STREETS HEREINABOVE DESCRIBED
AND DESIGNATED BY UNIT NUMBERS CONSTITUTES A SEPARATE AND INDEPENDENT UNIT
OF THE IMPROVEMENTS AND SHALL BE IMPROVED AND THE IMPROVEMENTS CONSTRUCTED
THEREIN AS SEPARATE AND INDEPENDENT FROM EACH AND EVERY OTHER UNIT OF SAID
STREETS, AND THE ASSESSMENTS TO BE LEVIED FOR SAID IMPROVEMENTS IN EACH
UNIT OR PORTION OF SAID STREETS SHALL BE ALTOGETHER SEPARATE AND DISTINCT
AND INDEPENDENT OF AND FROM THE ASSESSMENTS TO BE LEVIED IN EVERY OTHER
OF SAID UNITS AND PORTIONS OF SAID STREETS, AND, IN MAKING AND LEVYING SAID
ASSESSMENTS AGAINST THE PROPERTYABUTTING UPON ONE OF SAID UNITS, NO MATTER
OR CIRCUMSTANCE IN CONNECTION WITH ANY OTHER OF SAID UNITS SHALL BE CON-
SIDERED OR HAVE ANY EFFECT UPON THE OTHER, ALL AS FULLY AND TO THE SAME

SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE
