HomeMy WebLinkAbout08251 ORD - 11/23/1966• 11/23/66 • TEXAS: AN ORDINANCE APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $426.30, OF WHICH $363 IS FOR THE PURCHASE OF THE LAND AND $63.30 IS FOR TITLE EXPENSE AND RELATED COSTS THERETO, ALL APPLICABLE TO PROJECT NO. 220- 53 -84, MCARDLE ROAD - CROSSTOWN EXPRESSWAY TO GREENWOOD; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A REAL ESTATE SALES CONTRACT FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THERE IS HEREBY APPROPRIATED OUT OF NO. 220 STREET BOND FUND THE SUM OF $126.30, OF WHICH AMOUNT $363 IS FOR THE PURCHASE OF THE LAND AND $63.30 IS FOR TITLE EXPENSE AND RELATED COSTS THERETO, ALL APPLICABLE TO PROJECT NO. 220- 53 -84, MCARDLE ROAD - CROSSTOWN EXPRESSWAY TO GREENWOOD, SAID PARCEL BEING MORE FULLY DESCRIBED AS FOLLOWS, TO -WIT: PARCEL NO. 1 A TRACT OF LAND 25 FEET IN WIDTH AND 211.35 FEET IN LENGTH OUT OF LOT 15, SECTION D PAISLEY SUBDIVISION OF THE HOFFMAN TRACT AS SHOWN BY MAP OR PLAT OF RECORD IN VOLUME A, PAGE 28 NUECES COUNTY MAP RECORDS, SAID TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING AT A POINT IN THE COMMON BOUNDARY LINE OF SAID LOT 15, SECTION D PAISLEY SUBDIVISION AND LOT 1, SECTION 11 BOHEMIAN COLONY LANDS SAID POINT BEING THE SOUTHEAST CORNER OF THAT CERTAIN 10 ACRE TRACT OF LAND CONVEYED TO THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT BY DEED DATED DECEMBER 30, 1955 AND RECORDED IN VOLUME 718 PAGE 56 NUECES COUNTY, TEXAS, DEED RECORDS FOR THE SOUTHWEST CORNER OF THIS TRACT; THENCE N 28° 201 E WITH THE SOUTHEAST BOUNDARY LINE OF SAID 10 ACRE SCHOOL TRACT A DISTANCE OF 25 FEET TO A POINT FOR THE NORTHWEST CORNER OF THIS TRACT; THENCE S 61° 33' 30" E PARALLEL TO THE SOUTHWEST BOUNDARY LINE OF SAID LOT 15 SECTION D PAISLEY SUBDIVISION A DISTANCE OF 211.35 FEET TO ITS INTERSECTION OF THE PROPOSED NORTHWEST RIGHT -OF -WAY LINE OF CROSSTOWN EXPRESSWAY FOR THE NORTHEAST CORNER OF THIS TRACT; THENCE S 33° 521 01" W WITH THE PROPOSED NORTHWEST RIGHT -OF- WAY LINE OF CROSSTOWN EXPRESSWAY A DISTANCE OF 25.10 FEET TO A POINT IN THE SOUTHWEST BOUNDARY LINE OF LOT 15 SECTION D PAISLEY SUBDIVISION FOR A CORNER OF THIS TRACT; THENCE N 61° 33' 30" W WITH THE SOUTHWEST BOUNDARY LINE OF LOT 15 SECTION D PAISLEY SUBDIVISION A DISTANCE OF 208.86 FEET TO THE PLACE OF BEGINNING. 8251 SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE A REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE OWNER OF THE AFORESAID PARCEL, BAYSIDE CORPORATION. SECTION 3. THAT THE NECESSITY TO APPROPRIATE THE SUM HEREINABOVE SET OUT AND TO AUTHORIZE THE PURCHASE OF THE SAID PARCEL FOR THE WARDLE ROAD CROSSTOWN EXPRESSWAY TO GREENWOOD PROJECT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE ZkOt DAY OF NOVEMBER, 1966.
