FOR CONSTRUCTION OF UNIT III, SIDEWALKS FOR SCHOOLS, PRO- JECT N0, z2o- 64 -66; APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF 52,000, OF WHICH AMOUNT $47,381.15 IS FOR THE CONSTRUCTION CONTRACT AND $4,618.85 IS FOR CONTINGENCIES INCLUDING ENGINEERING, LABORATORY, EXPERT WITNESS AND LEGAL ADVERTISING COSTS; AUTHORIZING THE ISSUANCE OF A CHANGE ORDER FOR ADDITIONAL SIDEWALK CONSTRUCTION, INCLUDING ON SANTA FE FROM MINNESOTA TO ROSSITER AND /OR ROSSITER FROM SANTA FE TO ALAMEDA; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH STANLEY ORION & KEISEL, INC. FOR CONSTRUCTION OF UNIT III, SIDEWALKS FOR SCHOOLS, DESIGNATED AS PROJECT NO. 220- 64 -66, SAID CONSTRUC- TION TO CONSIST OF INSTALLATION OF APPROXIMATELY 21.400 L.F. OF CONCRETE SIDEWALK AND 296 cu. YD. OF SHELL SIDEWALK AND VARIOUS DRAINAGE FACILITIES AT THE FOLLOWING LOCATIONS: BALBOA FROM HIDALGO TO PINE; ON MARY FROM 20TH TO S. PORT; ON NORTON AND CASA GRANDE STREETS AT CASA LINDA PARK; ON PRESCOTT FROM CROSSTOWN EXPRESSWAY TO CUNNINGHAM SCHOOL; ON BURTON LANE FROM WILLIAMS DRIVE TO CA,YN; ON ANTELOPE AND CARANCAHUA AT THE POST OFFICE; ON MCARDLE, FRON NILE DRIVE TO ZARSKY; ON HORNE ROAD FROM PRESCOTT TO CROSSTOWN EXPRESS- WAY; ON HUDSON FROM SHAW TO CHULA VISTA SCHOOL; ON WILLIAMS DRIVE FROM STAPLES TO EVERHART; ON CARROLL LANE FROM MCARDLE 700 FEET SOUTH TOWARD PADRE ISLAND DRIVE AND ON CAIN DRIVE FROM BURTON TO STAPLES, ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF STANLEY ORION & KEISEL, INC., BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 220 STREET BOND FUND THE SUM OF $52,000, OF WHICH AMOUNT $47,381.15 15 FOR THE CON- STRUCTION CONTRACT AND $4,618.85 IS FOR CONTINGENCIES, INCLUDING ENGINEERING, LABORATORY TESTING, LEGAL ADVERTISING AND EXPERT WITNESS FEES. m- SECTION 3. AUTHORIZATION IS HEREBY GIVEN TO ISSUE A CHANGE ORDER FOR ADDITIONAL SIDEWALK CONSTRUCTION, INCLUDING ON SANTA FE FROM MINNESOTA TO ROSSITER AND /OR ROSSITER FROM SANTA FE TO ALAMEDA. SECTION 14. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE AFORE- MENTIONED CONTRACT AND THE APPROPRIATION OF THE NECESSARY FUNDS TO PROVIDE IMPROVEMENTS TO PROVIDE SIDEWALKS FOR SCHOOLS AS APPROVED BY ELECTORATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATEOF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECTqq FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE I /I-/- DAY OF DECEMBER, 1966.
