AN ORDINANCE
ESTABLISHING THE MUNICIPAL ARTSCOMMISSION OF THE CITY
j OF CORPUS CHRISTI; PRESCRIBING THE DUTIES AND FUNCTIONS
`! THEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THERE IS HEREBY ESTABLISHED A MUNICIPAL ART COMMISSION
TO ACT IN AN ADVISORY CAPACITY TO THE CITY GOVERNMENT OF THE CITY OF CORPUS
CHRISTI IN CONNECTION WITH THE BEAUTIFICATION AND CULTURAL DEVELOPMENT OF
THE CITY. SUCH COMMISSION SHALL CONSIST OF FIFTEEN MEMBERS TO BE APPOINTED
BY THE MAYORS SUBJECT TO CONFIRMATION BY A MAJORITY OF THE CITY COUNCIL.
AT LEAST THREE SHALL BE LAY MEMBERS, AND THE OTHERS MAY INCLUDE MEMBERS
FROM THE FOLLOWING ARTS, PROFESSIONS AND CIVIC GROUPS: PAINTING, SCULPTURE,
MUSICS THEATERS ARCHITECTURE, LANDSCAPE ARCHITECTURES ARTS COUNCIL, PARK AND
RECREATION BOARDS ZONING AND PLANNING BOARD, THE LOCAL HISTORICAL SOCIETY,
THE COUNCIL OF GARDEN CLUBS, AND THE CORPUS CHRISTI MUSEUM. THE MAYOR MAY
SOLICIT SUGGESTED NOMINATIONS FOR SUCH APPOINTMENTS FROM THE RESPECTIVE
CULTURAL ORGANIZATIONS FOR THE NON -LAY MEMBERS.
SECTION 2. APPOINTMENTS TO SUCH COMMISSION SHALL BE FOR TWO YEAR
TERMS EXCEPT THAT ANY VACANCY SHALL BE FILLED FOR AN UNEXPIRED TERM.
SECTION 3. MEMBERS SHALL SERVE WITHOUT COMPENSATION FROM THE CITY
FOR THEIR SERVICE AS SUCH MEMBERS; BUT THIS LIMITATION SHALL NOT PRECLUDE
A MEMBER OR HIS FIRM FROM RECEIVING COMPENSATION FROM THE CITY UNDER CONTRACT
OR OTHERWISE FOR SERVICES RENDERED OUTSIDE HIS DUTIES AS MEMBER OF THE
COMMISSION.
SECTION 4. THE COMMISSION MAY ORGANIZE AND ELECT A CHAIRMAN
ANNUALLY AND ADOPT SUCH ADMINISTRATIVE PROCEDURES AS ARE NECESSARY TO
ACCOMPLISH THE PURPOSES MENTIONED IN SECTION 1. CITY OFFICERS AND THE
STAFF OF CITY DEPARTMENTS MAY CONSULT AND ADVISE WITH THE COMMISSION FROM
TIME TO TIME ON MATTERS COMING WITHIN THE SCOPE OF THIS ORDINANCE; AND THE
COMMISSION MAY LIKEWISE CONSULT AND ADVISE WITH SUCH OFFICERS.

SECTION 5. HEREAFTER WHEN ANY WORK OF ART IS CONTRACTED FOR BY
THE CITY OR PLACED ON PROPERTY OF THE CITY NOT UNDER LEASE TO PRIVATE
PERSONS, OR BECOME THE PROPERTY OF THE CITY BY PURCHASE, GIFTS OR OTHERWISE,
EXCEPT FOR A MUSEUM OR GALLERY, SUCH WORK OF ARTS OR A DESIGN OR MODEL OF
THE SAME, TOGETHER WITH THE PROPOSED LOCATION OF SUCH WORK,MAY BE SUBMITTED
BY THE CITY COUNCIL OR THE PARK BOARD OF THE CITY TO THE COMMISSION FOR ITS
RECOMMENDATION TO THE REFERRER. THE TERM "WORK OF ART" AS USED IN THIS
ORDINANCE SHALL COMPRISE PAINTINGS MURAL DECORATIONS STAINED GLASS
STATUES,. BAS- RELIEFS OR OTHER SCULPTURES, MONUMENTS FOUNTAINS, ARCHES OR
OTHER STRUCTURES OF A PERMANENT OR TEMPORARY CHARACTER INTENDED FOR ORNAMENT
OR COMMEMORATION. ANY EXISTING WORK OF ART IN THE POSSESSION OF THE CITY
AND CONSIDERED BY THE CITY COUNCIL OR CITY PARK BOARD FOR REMOVAL, RELOCA-
TION OR ALTERATION IN ANY WAY MAY BE SUBMITTED TO THE COMMISSION FOR REPORT
AND RECOMMENDATION.
THE COMMISSION MAY PREPARE SPECIFICATIONS FOR THE MAINTENANCE OF
WORKS OF ART AND SHALL INSPECT SUCH MAINTENANCE WORK FOR THE GUIDANCE OF
THE CITY DEPARTMENTS CONCERNED.
THE COMMISSION SHALL HAVE SIMILAR DUTIES TO THOSE STATED IN THE
FIRST PARAGRAPH OF THIS SECTION WITH RESPECT TOTHE DESIGN OF BUILDINGS,
BRIDGES ELEVATED ROADWAYS, GATES FENCES, STREET MARKERS LAMP STANDARDS
OR OTHER STRUCTURES ERECTED ON OR TO BE ERECTED UPON LAND BELONGING TO THE
CITY AND CONCERNING ARCHES, BRIDGES STRUCTURES, AND APPROACHES WHICH ARE
THE PROPERTY OF ANY CORPORATION OR PRIVATE INDIVIDUAL AND WHICH SHALL EXTEND
OVER OR UPON ANY STREETS AVENUES HIGHWAY, PARK OR PUBLIC PLACE OF THE CITY,
IN THE EVENT THEY OR ANY OF THEM IS SUBMITTED TO THE COMMISSION BY THE CITY
COUNCIL OR THE CITY PARK BOARD.
SECTION 6. THE COMMISSION SHALL MAKE RECOMMENDATIONS UPON MATTERS
SUBMITTED TO IT INVOLVING AN EXPENDITURE OF LESS THAN ONE THOUSAND DOLLARS
WITHIN FIFTEEN DAYS AFTER SUBMISSION, AND UPON ANY OTHER SUCH MATTERS WITH-
IN THIRTY DAYS AFTER SUBMISSION. IF IT FAILS TO DO 50, ITS RECOMMENDATION
SHALL BE CONSIDERED UNNECESSARY.
SECTION 7. THE COMMISSION MAY ADVISE WITH OWNERS OF PRIVATE
PROPERTY IN RELATION TO THE BEAUTIFICATION OF SUCH PROPERTY; AND ANYONE

CONTEMPLATING THE ERECTION OF ANY BUILDING OR MAKING ANY IMPROVEMENT
THEREON MAY SUBMIT THE PLANS AND DESIGNS OR SKETCHES THEREOF TO THE
MUNICIPAL ART COMMISSION FOR ADVICE AND SUGGESTION FOR WHICH NO CHARGE
SHALL BE MADE BY THE COMMISSION.
SECTION S. THE NECESSITY TO ESTABLISH THE MUNICIPAL ART
COMMISSION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY
EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED, THIS THE -"Idt DAY OF DECEMBER, 1966.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
