AN ORDINANCE
DECLARING ABANDONED A PORTION OF THAT 20 -FOOT UTILITY
EASEMENT LYING ON THE SOUTH PORTION OF LOT 58 AND THE
NORTH PORTION OF LOT 1 OF LEE MANOR SUBDIVISION,
EXTENDING FROM CHEVY CHASE DRIVE TO THE ALLEY IN
BLOCK 1, AND RECORDED IN VOL. 437, AT PAGES 241 AND 243,
DEED RECORDS OF NUECES COUNTY, TEXAS, THE PORTION HEREBY
ABANDONED BEING ALL OF SAID EASEMENT, SAVE AND EXCEPT THE
SOUTH 5 FEET OF LOT 58 AND THE NORTHERN 5 FEET OF LOT 1,
ALL AS MORE FULLY DESCRIBED ON THE PLAT ATTACHED HERETO
AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, A UTILITY EASEMENT CONCERNING THE SOUTH 10 FEET OF
LOT 58 AND THE NORTHERN 10 FEET OF LOT 1, IN LEE MANOR SUBDIVISION, WAS
GRANTED TO THE CITY BY INSTRUMENTS RECORDED IN VOL. 437, AT PAGES 241 AND
243, NUECES COUNTY, TEXAS, DEED RECORDS; AND
WHEREAS, ONLY A PORTION OF SAID UTILITY EASEMENT IS NEEDED BY THE
CITY AND THE PROPERTY OWNERS DESIRE TO USE THE UNNEEDED PORTIONS OF SAID
EASEMENT:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY ABANDONED AND RELEASED AND RELINQUISHED
BY THE CITY OF CORPUS CHRISTI UNTO THE PRESENT OWNERS A PORTION OF THAT 20 -FOOT
UTILITY EASEMENT LYING ON THE SOUTH PORTION OF LOT 58 AND THE NORTH PORTION
OF LOT 1 OF LEE MANOR SUBDIVISION, EXTENDING FROM CHEVY CHASE DRIVE TO THE
ALLEY IN BLOCK 1, AND RECORDED IN VOL. 437 AT PAGES 241 AND 243, DEED RECORDS
OF NUECES COUNTY, TEXAS, THE PORTION HEREBY ABANDONED BEING ALL OF SAID EASE-
MENT, SAVE AND EXCEPT THE SOUTH 5 FEET OF LOT 58 AND THE NORTHERN_5 FEET OF
LOT 1, ALL AS MORE FULLY DESCRIBED ON THE PLAT ATTACHED HERETO AND MADE A
PART HEREOF.
SECTION 2. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE
HEREINABOVE DESCRIBED EASEMENT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI-
NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND

NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND
THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT
IS ACCORDINGLY SO ORDAINED, THIS THE ✓ f DAY OF JANUARY, 1967,

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR
THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO -
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
