AN ORDINANCE
RECEIVING AND ACCEPTING THE CONSTRUCTION OF THE
DAUGHTERS OF THE CONFEDERACY MEMORIAL FOUNTAIN AS
PERFORMED BY THE CONTRACTOR, B. R. SESSIONS, UNDER
HIS CONTRACT DATED NOVEMBER 2, 1966, AUTHORIZED BY
ORDINANCE NO. 82211; AUTHORIZING PAYMENT OF FINAL
ESTIMATE NO. 2, DATED FEBRUARY 16, 1967, IN THE
AMOUNT OF $4,172.30, A COPY OF WHICH IS ATTACHED
HERETO AND MADE A PART HEREOF, SAID PAYMENT TO BE
MADE FROM PARK CONSTRUCTION, ACTIVITY NO. 4122,
FUNDS PREVIOUSLY APPROPRIATED; APPROVING A 14 -DAY
EXTENSION OF CONTRACT TIME FOR PROJECT COMPLETION;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION I. THAT THE CONSTRUCTION OF THE DAUGHTERS OF THE
CONFEDERACY MEMORIAL FOUNTAIN, AS PERFORMED BY THE CONTRACTOR, B. R.
SESSIONS, UNDER THE CONTRACT DATED NOVEMBER 2, 1966; AUTHORIZED BY
ORDINANCE N0. 8224, HAVING BEEN PERFORMED AND COMPLETED IN ACCORDANCE
WITH THE TERMS AND PROVISIONS OF THE CONTRACT, PLANS AND SPECIFICATIONS
THEREIN CONTAINED, EXCEPT AS HEREINAFTER MORE FULLY SET OUT, AND THE
DIRECTOR OF PUBLIC WORKS HAVING INSPECTED THE SAME AND CERTIFIED TO THE
COMPLETION OF SAID WORK IN ACCORDANCE WITH SAID PLANS AND SPECIFICATIONS,
EXCEPT AS HEREINAFTER SET OUT, THE WORK AFORESAID IS HEREBY FOUND TO
HAVE BEEN COMPLETED IN ACCORDANCE WITH THE PLANS AND SPECIFICATIONS,
EXCEPT AS HEREIN MORE FULLY SET FORTH AND IS HERE AND NOW ACCEPTED AND
RECEIVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. APPROVAL IS HEREBY GIVEN FOR A 14 -DAY EXTENSION
OF CONTRACT TIME FOR COMPLETION OF THE HEREINABOVE DESCRIBED PROJECT.
SECTION 3. THAT FINAL PAYMENT 15 HEREBY AUTHORIZED AS DUE
UNDER THE CONTRACT AND AS SET OUT IN FINAL ESTIMATE N0. 2, ATTACHED
HERETO AND MADE A PART HEREOF, PREPARED BY THE DIRECTOR OF PUBLIC
WORKS, DATED FEBRUARY 16, 1967, IN THE AMOUNT OF $4,172.30, FROM FUNDS
PREVIOUSLY APPROPRIATED OUT OF ACTIVITY N0. 4122, PARK CONSTRUCTION.

SECTION . THE NECESSITY FOR COMPLETION OF SUCH WORK BY
SAID ACCEPTANCE AND FINAL PAYMENT IMMEDIATELY CREATES A PUBLIC EMERGENCY

AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE
CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR
HAVING DECLARED SUCH PUBLIC EMERGENCY AND NECESSITY TO EXIST, AND
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
